BACKGROUND
The applicant filed a Conditional Use Permit (CUP) application to establish retail sales of
motorized scooters at the existing "Jet Ski - Rent Me" business. The business currently leases
and sells jet skis, accessories, and motorized scooters. However, the California Department of
Motor Vehicles (DMV) now requires scooter dealers to have a valid dealer's license, which
necessitated approval from the City before the DMV would issue a license. The project site is
located at 1680 S. Camino Real in the CG-I, Commercial General land use district (see Exhibit I
- Location Map). The existing businesses in the center are: Empire Marine (boat sales and
service), Empire Auto Wholesale (office use only for vehicle wholesales), Tent Sale
Management (promotions manager for auto dealers), and Precision Powder Coating (electrostatic
coating of metal parts/products). The boat sales/service use has a current CUP, however, the
business has been successful and has overgrown the property boundaries. The auto wholesale
business was approved for an office use only, and the display and retail sales of autos are not
permitted in the Commercial General, CG-Iland use district without an approved CUP.
The Planning Commission reviewed the project on June 7, 2005. The Planning Commission staff
report (Exhibit 2 - Staff Report) explains the detailed analysis for the project. Staff had
recommended approval of the application because no expansion of the existing business was
proposed. The CUP was requested in order to comply with the new DMV licensing requirement.
Commissioners expressed concerns about inadequate parking on-site for customers, illegal signs,
and the property owner's role and responsibilities if the CUP was approved. Commissioners also
had concerns about the extent to which Empire Marine has exceeded the conditions of its CUP,
the ability of the property to physically accommodate the existing and proposed uses, and how
other businesses in the center have been negatively impacted. Commissioner Coute stated that he
believed the Precision Powder Coating business could not take deliveries on-site. Some
Commissioners also stated their intent to deny the application because the Findings of Fact could
not be made to support approval. The Planning Commission continued the project to June 21,
2005, to allow the property owner and other tenants to attend the meeting and answer
Commissioners' questions.

At the Planning Commission hearing on June 21, 2005, with several tenants in attendance, the
Planning Commission considered a staffmemorandurn that presented revised Findings (Exhibit 3
- Memorandum). After the public hearing, the Commission determined that all Findings could
not be made to support approval and denied the application. Commissioners Coute, Enciso, and
Sauerbrun voted in favor of the motion to deny the application. Commissioners Durr and
Heasley voted against the motion to deny, and Commissioners Brown, Morris, and Powell were
absent.
The applicant disagreed with the Commission's decision and filed an Appeal application (Exhibit
4 - Appeal). The specific basis for the appeal is that there is a new property owner, and the
applicant and new property owner believe they can rectify all problems within 3 to 6 months.
The appellant is requesting that the Planning Commission's decision be overturned and that the
CUP be granted, subject to resolution of the issues identified by the Planning Commission within
6 months. Due to the limited size of the property and the existing conditions, staff is skeptical
about the potential for quick resolution of the parking and outdoor storage issues identified by the
Planning Commission. Therefore, staffrecommends that the Planning Commission's action be
upheld.
FINANCIAL IMPACT
e None. The applicant paid the processing fees.

RECOMMENDATION
Staff recommends that the Mayor and Common Council:
1) deny the appeal and uphold the Planning Commission's denial of Conditional Use Permit No.
05-07; and,
2) permit the appellant to file another CUP application within 12 months, pursuant to Development
Code S19.52.130.

The project site is located at 1680 S. Camino Real in the CG-I, Commercial General land use
district (Attachment A - Location Map). The applicant requests approvalofa Conditional
Use Permit under authority of Development Code SI9.06.030(2)(D) to establish retail sales of
motorcycles and motorized scooters at the existing "Jet Ski - Rent Me" business. The business
currently leases and sells only jet skis and accessories.
The business will utilize the site and structure as it currently exists. The display area for the
motorcycles, motor scooters, and jet skis will be adjacent to the street within the front parking
area (see Attachment B - Site Plan and Floor Plan).
SETTING & SITE CHARACTERISTICS
The entire site is approximately 63,000 square feet (or 1.45 acres) in size. There are three
structures on the property with a total of 17,748 square feet of floor area. Each structure has
roll-up bay doors to allow indoor work on vehicles, and previous uses in the center had
included auto repair. Businesses currently in the site include: Empire Marine (boat sales and
service), Empire Auto Wholesale (office use only for vehicle wholesales), Tent Sale
Management (promotions manager for auto dealers), and Precision Powder Coating
(electrostatic coating of metal parts/products).

At least half of the parking lot on the site is being utilized by Empire Marine as a display area
for boats. The vacant lot to the south, approximately 1.73 acres in size, is also used as a
parking and storage area for boats (staff estimates that there are approximately 100 boats
between the two properties). Also, Empire Auto Wholesale has 12 to 15 vehicles parked on
the site for display and sale, which is a retail use and would not be consistent with the Zoning
Verification Review Form that had been completed for that business.
The areas surrounding the property are either automobile dealerships or unimproved parcels.
To the north and northwest are automobile dealerships in the CR-4, Commercial Regional
land use district. To the west is a vacant unimproved parcel in the CR-4, Commercial
Regional land use district. To the south is a vacant unimproved parcel in the CG-!,
Commercial General land use district. To the east is Interstate 215.
BACKGROUND
The Department's files for the property indicate that all of the existing businesses have
previously obtained Zoning Verification Review approvals and have been legally established.
One or more of the businesses have been very successful and have expanded so that they have
outgrown the property's boundaries.

The Development & Environmental Review Committee (D/ERC) reviewed the proposed
project on May 5, 2005, and moved to the Planning Commission. The proposed project is
Categorically Exempt from the California Environmental Quality Act, pursuant to Section
15301 for Existing Facilities.

e FINDINGS & ANALYSIS
1. Is the proposed use conditionally permitted within the subject land use district, would
it impair the integrity and character of the subject land use district, iinddoes it comply
with all of the applicable provisions of this Development Code?
Yes, the proposed motorcycle and scooter sales are conditionally permitted, and will
be compatible with the existing vehicle and boat dealerships in the area. The proposed
use will not impair the integrity or character of the land use districts in the vicinity.
The proposed project will comply with all applicable provisions of the Development
Code as shown in Table 'A.'

Is the proposed use consistent with the General Plan?
e
Yes, the proposed use is consistent with a number of General Plan policies and
objectives. Land Use Policy 1.19.11 states, "Permit the development of new and used
car dealerships and auto-related retail and service uses... with a Conditional Use
Permit to ensure compatibility with adjacent uses." Policy 4.15.1 in the Economic
Development Element allows for intensification of existing commercial corridors in
accordance with the Land Use Policies for Land Use Objective 1.19. Also, Policy
4.16.1 in the Economic Development Element states that existing retail outlets should
be encouraged to remain at or near their current locations. Approval of the Conditional
Use Permit will implement these General Plan policies and objectives.

Is the approval of the Conditional Use Permit for the proposed use in compliance
with the requirements of the California Environmental Quality Act and Section
19.20.030(6) of the Development Code?
Yes, the project is exempt from CEQA under Section 15301 - Existing Facilities,
and complies with the requirements of Development Code ~ 19.20.030(6).
4. Are there potentially significant negative impacts upon environmental quality and
natural resources that could not be properly mitigated and monitored?
No, the proposal will not have any significant negative impacts upon environmental
quality or natural resources. The property has been previously developed and has no
value as habitat for any endangered, rare, or threatened species.
5.
Are the location, size, design, and operating characteristics of the proposed use
compatible with the existing and future land uses within the general area in which the
proposed use is to be located and will it create significant noise, traffic or other
conditions or situations that may be objectionable or detrimental to other permitted
uses in the vicinity or adverse to the public interest, health, safety, convenience, or
welfare of the City?
Yes, the proposed motorcycle and scooter retail sales will be compatible with the
existing land uses in the vicinity. The Auto Plaza district is immediately adjacent on
the north and west sides of the site. Also, the proposed use will not adversely impact
neighboring businesses within the center.
6.
Is the subject site physically suitable for the type and density/intensity of use being
proposed?
Yes, the site is an appropriate size for displaying motorcycles and scooters, in addition
to the jet skis that are currently leased and sold. The display area for the motorcycles,
scooters, and jet skis will be adjacent to the street within the front parking area
(Attachment B - Site Plan & Floor Plan). The site design is suitable for proposed
use, in that the proposal meets all development standards.
According to the applicant, there is no formal arrangement for distributing parking
spaces among the several businesses. The applicant expects to utilize the seven
parking spaces between the street and the building as the display area. Boats from
Empire Marine,.as well as the on-site vehicles from the auto wholesale office, have
impacted the availability of on-site parking.
7.
Are there adequate provisions for public access, water, sanitation, and public utilities
and services to ensure that the proposed use would not be detrimental to public health
and safety?
Yes, all departments responsible for reviewing access and providing water, sanitation,
and other public services have had the opportunity to review the proposal and can
serve the location. The project will not be detrimental to public health and safety.

The proposal is consistent with the General Plan and Development Code, and meets all
necessary Findings of Fact for approval. ".
RECOMMENDATION
Staff recommends that the Planning Commission approve Conditional Use Permit No. 05-07
based upon the Findings of Fact contained in this Staff Report, and subject to the Conditions
of Approval (Attachment D).

CONDITIONS OF APPROVAL
Conditional Use Permit No. 05-07
1. This permit authorizes the developer to establish retail sales of motorcycles and
motorized scooters at the existing "Jet Ski - Rent Me" business. The business is
located at 1680 S. Camino Real.
2. Within two years of development approval, commencement of construction shall have
occurred or the permit/approval shall become null and void. In addition, if after
commencement of construction, work is discontinued for a period of one year, then the
permit/approval shall become null and void. However, approval of the Conditional
Use Permit does not authorize commencement of construction. All necessary permits
must be obtained prior to commencement of specified construction activities included
in the Conditions of Approval and Standard Requirements.
Expiration Date: June 7, 2007

The review authority may grant a one-time extension, for good cause, not to exceed 12
months. The applicant must file an application, the processing fees, and all required
submittal items, 30 days prior to the expiration date. The review authority shall ensure
that the project complies with all Development Code provisions in effect at the time of
the requested extension.
4. In the event this approval is legally challenged, the City will promptly notify the
applicant of any claim, action or proceeding and will cooperate fully in the defense of
this matter. Once notified, the applicant agrees to defend, indemnify and hold
harmless the City of San Bernardino (City), the Economic Development Agency of
the City of San Bernardino (EDA), any departments, agencies, divisions, boards or
commission of either the City or EDA as well as predecessors, successors, assigns,
agents, directors, elected officials, officers, employees, representatives and attorneys
of either the City or EDA from any claim, action or proceeding against any of the
foregoing persons or entities. The applicant further agrees to reimburse the City for
any costs and attorneys' fees which the City may be required by a court to pay as a
result of such action, but such participation shall not relieve applicant of his or her
obligation under this condition.
The costs, salaries, and expenses of the City Attorney and employees of his office
shall be considered as "attorneys fees" for the purpose of this condition.
As part of the consideration for issuing this permit, this condition shall remain in
effect if this Conditional Use Permit is rescinded or revoked, whether or not at the
. request of applicant.

5.
Construction shall be in substantial conformance with the plan(s) approved by the
Director, Development Review Committee, Planning Commission or Mayor and
Common Council. Minor modification to the plan(s) shall be subject to approval by
the Director through a minor modification permit process. Any modification which
exceeds 10% of the following allowable measurable design/site considerations shall
require the refiling of the original application and a subsequent hearing by the
appropriate hearing review authority if applicable:
a. On-site circulation and parking, loading and landscaping;
b. Placement and/or height of walls, fences and structures;
c. Reconfiguration of architectural features, including colors, and/or modification of
finished materials that do not alter or compromise the previously approved theme;.
and,
d. A reduction in density or intensity of a development project.
6.
No vacant, relocated, altered, repaired or hereafter erected structure shall be occupied
or no change of use of land or structure(s) shall be inaugurated, or no new business
commenced as authorized by this permit until a Certificate of Occupancy has been
issued by the Department. A temporary Certificate of Occupancy may be issued by the
Department subject to the conditions imposed on the use, provided that a deposit is
filed with the Department of Public Works prior to the issuance of the Certificate, if
necessary. The deposit or security shall guarantee the faithful performance and
completion of all terms, conditions and performance standards imposed on the
intended use by this permit.
7. This permit or approval is subject to all the applicable provisions of the Development
Code in effect at the time of approval. This includes Chapter 19.20 - Property
Development Standards, and includes: dust and dirt control during construction and
grading activities; emission control of fumes, vapors, gases and other forms of air
pollution; glare control; exterior lighting design and control; noise control; odor
control; screening; signs, off-street parking and off-street loading; and, vibration
control. Screening and sign regulations compliance is important considerations to the
developer because they will delay the issuance of a Certificate of Occupancy until they
are complied with. Any exterior structural equipment, or utility transformers, boxes,
ducts or meter cabinets shall be architecturally screened by wall or structural element,
blending with the building design and include landscaping when on the ground.
8. All signage shall comply with the provisions of Chapter 19.22 (Sign Standards). Signs
are not approved as a part of this permit. Prior to establishing any new signs, or
replacing existing signs, the applicant shall submit an application, and receive
approval, for a sign permit from the Planning Department. Signs painted on the
building are prohibited. Animated, moving, flashing, blinking, reflecting, revolving,
or similar signs are prohibited. Banners, flags, pennants, and similar signs are
prohibited unless a Temporary Sign Permit is obtained.
9.
The project shall comply with the requirements of other outside agencies (e.g. San
Bernardino County Department of Environmental Health, California Department of
Motor Vehicles, California State Board of Equalization, etc.), as applicable.

10.
The project shall comply with all applicable requirements of the Public Works
Division, the Building Division, the Fire Department, the Water Department, the
Public Services Department, Refuse Division, and/or the City Clerk's Office, Business
Registration Division.
11. All graffiti must be removed within 24 hours of its occurrence. The management shall
take a photograph of the graffiti and provide to the Police Department before
removing the graffiti.
12. All parking shall comply with provisions of Chapter 19.24 (Off-Street Parking).
13. The display area for jet skis, motorcycles, and scooters shall be limited to the seven
parking spaces and drive aisle located between the street and the front building. There
shall not be any displays or parking of jet skis, motorcycles, scooters, etc. on public
streets.
14. All parts, accessories, etc. shall be stored within a fully enclosed structure.
15. All loading or unloading of vehicles, motorcycles, jet skis, scooters, etc. shall occur on-
site and not in adjoining streets. There shall not be any loading or unloading of jet skis,
motorcycles, scooters, etc. on public streets.
16.
No service or repair work shall occur except within a fully enclosed structure.

At the Planning Commission hearing of June 7, 2005, staff presented the proposed
Conditional Use Permit findings and a recommendation for approval. The Planning
Commission discussed the merits of the project and stated concems about suitability of
the site (e.g. parking, loading, and access) for the proposed use. The Planning
Commission stated their intent to withhold approval and continued the item to June 21,
2005, to allow staff to contact the property owner and tenants within the center so that
they may attend the public hearing.
On June 8, 2005, Planning staff mailed letters to the owner and tenants to request
their presence at the next Planning Commission meeting. On June 16, staff
contacted the parties by telephone to encourage attendance.
Regarding signs for the Jet Ski - Rent Me business, the applicant intends to present
conceptual sign plans at the Planning Commission meeting.

At the meeting of the Mayor and Common Council held on October 3, 2005, the following
action was taken relative to Conditional Use Permit No. 05-07 (Appeal No. 05-16), an appeal of
the Planning Commission's denial of a request to establish retail sales of motorized scooters in
an existing multi-tenant center located at 1680 S. Camino Real.
The Mayor and Common Council closed the hearing and granted the appeal
approving Conditional Use Permit No. 05-07, based upon the Findings of Fact,
Conditions of Approval and Standard Requirements contained in the staff report to
the Planning Commission.
