RESOLUTION NO. 2005-120
2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
3 SAN BERNARDINO AUTHORIZING SUBMITTAL OF 2005/2006 USED OIL
RECYCLING BLOCK GRANT APPLICATION FOR GRANT FUNDS FROM THE
4 CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
6 OF SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. That the State of California Oil Recycling Enhancement Act
8 provides funds to cities and counties for establishing and maintaining local used oil
9 collection programs that encourage recycling of used motor oil and filters;

SECTION 2. That the California Integrated Waste Management Board has been
delegated the responsibility for the administration of the program with the State, setting
12
up necessary procedures governing applications of cities and counties under the
13
14 program;
15 SECTION 3. That the City of San Bernardino, as applicant, will enter into the
16 agreement with the State of California for the implementation and maintenance of a
17

Used Oil Recycling Program that offers used oil and filter recycling opportunities for
residents and encourages the proper disposal of used motor oil and filters;

SECTION 4. That the Mayor and Common Council of the City of San Bernardino
authorize the submittal of an application to the California Integrated Waste Management
22 Board for the 2005/2006 Used Oil Recycling Block Grant (attached hereto as Exhibit
23 "A"). The Mayor of the City of San Bernardino, or her designee, is hereby authorized to

execute in the name of the City of San Bernardino all necessary contracts, payment
requests, agreements, and amendments hereto for the purposes of securing grant
funds to implement and carry out the purposes specified in the grant application.

Entities that receive grant funding from CIWMB for this grant program must comply with the following principles of
Environmental Justice. Environmental Justice is defined in Government Code Section 65040.l2(c) as: "...the fair
treatment of people of a1\ races, cultures, and incomes with respect to the development, adoption, implementation, and
enforcement of environmental laws, regulations, and policies." Public Resources Code Sections 72000(a) & 72001
broadly require a1\ California Environmental Protection Agency boards, departments, and offices to conduct their
"programs, policies, and activities that substantially affect human health or the environment in a manner that ensures the
fair treatment of people of a1\ races, cultures, and income levels, including minority populations and low-income
populations of the state."
