RESOLUTION NO, 2005-91 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR THE SAN BERNARDINO POLICE DEPARTMENT TO PARTICIPATE AS A MEMBER OF THE SAN BERNARDINO COUNTY MOVEMENT AGAINST STREET HOODLUMS. SECTION 1: The Mayor and Common Council of the City of San Bernardino, authorizes the Mayor or her designee, to execute an agreement between the City of San Bernardino Police Department and the San Bernardino County Sheriffs Department authorizing the San Bernardino Police Department to participate as a member of the San Bernardino County Movement Against Street Hoodlums (S,M,AS,H,) SECTION 2: The authorization to execute the above referenced memorandum of understanding is rescinded if it is not executed within sixty (60) days of the passage of this resolution. Memorandum of Understanding Policy and Procedure A CONCERTED EFFORT SAN BERNARDINO COUNTY LAW ENFORCEMENT S.B.s.D. 01/1312005 MAR-21-2005 14:36 FROM: TO: 93884950 P.003/01il7 ARTICLE THREE: OVERSIGHT COMMITTEE The operating policy and procedures of S.M-A.S.IL win be reviewed and Implementedbytbe Ovel'lltght Committee. The Oversight Committee will be the Sheriff, or Chief or their deslKJIee from agencies participating In S.M.A.S.H. operations. ARTICLE FOUR: PARTICIPATION IN S.M.A.S.&. 1. It will be incumbent upon tht)..~ law enforcement a~cles that are participating In S.M.A.S.IL to proride personnel trained in gang activities and make some or aU of those perRonnel available in the event a S.M-A.S.H. operatlo~ is planned. An a2Cncles participating in SoM.A.S.1L will be asked to provide ot least one or more officers (personnel) for eoch operation that is planned. 2. It will be incumbent upon thl)Sc law enforcement agencies that parijclpate In S.M.A.S.Il. operations to provide personnel who partleipate in ID OlJeratlon with the necessary equipment (oar, radio, etc.) to condud field operations. 3. . Participating agencies agree to be responsible for the negligent or wrongful acts or OIl1issions of their respective employees, and be solely liable for barm or loss C8lJSed by Its members. Participating agencies llballlndemnify, defend, and hold harmless all other agencies. 4. Each ~ency shan be respon.~lble to pay all compensation, worker's compensation, and benefit~ of Its members. ' ARTICLE FIVE: ASSET SEIZURES AU forfeiture proceedings wUl be Initiated and administrated by the host agency where tbe forfeiture action originated. ARTICLE SIX: STRUCTURE OF COMMAND OFS.M.A.S.II. 1. Persortnel working S.M.A.S.H. will be under the command of tbelr agency. l)uring the duration or the planned S.M.A.S.H. operatibn, personnel will be under tbe db:ed command of the chief law enforcement oftic:er or his designee of the host agency. 2. Jointly on street gang activity for the mutual beneftt of all of those agencies. ARTICLE EIGHT: REQUEST FOR S.M.A.S.H. OPERATION 1. It shall be the policy of the S.M.A.S.H. project to respond to all requests for ~sistanee from any law enforcement agency that has a street gang ~ndition that demands expertise or resources beyond their existing limitations. 2. The San Bernardino County Sheriff's Department's Criminal Intelligence Divlsi~n and the host a~ncy will be Jointly responsible for coordinating, planning, and executing S.M.A.S.H. operations witbln the host's geographical.lurtsdiction. 3. Requests for S.M.A.S.H~ operations nmst follow a strict request PrCltocol through the appropriate chaln~of -command. The SheritT, Chilli' or his designee of the affected agency wUl make a request through tlIe Sheriff's Specialized Operations Bureau Deputy Chief or his designee. The Sheriff's Department's Criminal Intelligence Division will be notified for coordination with the requesting agency. ARTICLE NINE: PREss RELATIONS 1. The S.M.A.S.H. project will COoperate wUh the media in their effort, to obtain information on matters of public: interest. Due to the sensitive nature of 8.l\.lA.s.H. operations, and the concerns of the different jurisdictions involved, 8.M.AS.H. personnel will operate as a unit when engaged in an operation. 2. All S.M.A.S.H. personnel invo1ved in an operation will refer to themselves as members of 8.M.A.S.H. and will not release information relative to the agency they represent (exclucUng D.A., parole, probation, etc.) to the press. 3. The bosting agency will desil'late a person to act in the capacity of media relations officer. The media relations officer will strictly adhere to the policy of not releasing Information prior to, or durIng a S.M-A.S.H. operation. , . 3 . , MAR-21-F005 14:36 FROM: TD:93884950 P.1a05/007 ARTICLE TEN: MULTI-AGENCY ADMINISTRATIVE CONCERNS 1. CITIZEN COMPLAINTS Any complaint from an individual alleging misconduct by any member of any S.M.A.S.H. operation will be Investigated by the agency which the affected law enforcement omcer represents. 2. INJURIES When any member of any S.M.A.s.H. operation is injured durlnlt the performance of hilllher official duties, the reporting policy of that otticer's employer shall be followed. The hDllt agency will document the in,lury/inc:ldent as per that agency's policy. 3. MOTQR VEIDCLE ACCIDENTS If a S.M.A.S.H. officer is Involved in a tramcaccldent during a planned S.M.A.s.H. operation it will be the bosting agency's responsl.,iUty to conduct the colli~ion Investiltiltion. Any administrative investiJlation related to thllcollision will be investigated by the S.MA.S.H. officer's agency. 4. OFFICER INvOL VEn SHOOTJNGS Any S.M-A.S.H. officer, who becomes involved in a shooting while engaged in a S.M.A.S.H operation, shall immediately follow hislher agency's policy for offi.cer involved, shootings. Notification shaD be made Immediately to the hosting agency's watch coinmander. The hosting agency alid the officer's agency shall both be tesponsible for complete documentation of the incidenL S. TACTICAL RESPONSE In the event a tactical situation evolves out of a S.M.A.S.IL contact the S.M.A.S.H officers Involved will contain the situation. Notification will be made to the hosting agency, and its pottcles and procedures pertaining to tactical situations shall be implemented. 4 MRR-21-2005 14:37 FROM: TO: 93884950 p.006/007 ARTICLE ELEVEN: TRAIN1NG 1. ARTICLE TwELVE: UNIFORM THE S.M.A.S.H. UNIFORM SBALL CONSIST OF THE FOLLOWING ITEMS: . smRT. Short-sleeve, polo type, forest green in color, and have the following features: . Polyester/cotton blend material. . Two inch (2'') rib ~It shirt collar. . Front openin~ neckline with a nve inch (5'') placket two (2) button closure. . ,",e collar shall be approximately two and one-half Inebes (2 V~") in width with a rib knit type construction. . Short sleeves, witb a one Inch (I") rib knit sleeve band on the bottom of the sleeve. . The material of the shirt breast is to be Identical in nature to that of the collar. . Tlte agency's badge shall be silk.screened on the upper left side of the shirt, approximately four lnches (4'') below the shoulder seam and centered between tbe placket and sleeve seam. . The word "SMASH" sball be silk-screened in one Inch (1") goll;! lettering and centered approximately four Inches (4") below the shoulder seam and centered between the placket and sleeve seam. . TiJe "SMASH" 1020 patch sholl be affixed on the upper right side of the shirt and approximately four Inches (4") below the shoulder seam and centered between the placket and sleeve seam. . NAME TAG. The ot1icer'~ I1nt Initial and last name sholl be embroidered onto the shirt in black thread in one-half Inch (112") letters on the right breast of the shirt, centered directly below the SMASH logo. . . The word "SHERIFF', or ''POLICE'' shoJI be silk-screened in three and one-half inch (3 Vi') gold letterIng across the back of the shIrt . approximately five Inches (5") below the neck seam. . The agency's shoulder patches and appropriate chevrons shall be silk- screened in flUid lettering on each sleeve (refer to section 61208.30). . TlOUSERS.
