The Mayor and Conunon Council of the Gty of San Bernardino are hereby authorized to obligate and expend the allocated Justice Assistance Grant monies in the amount of $245,615 from the U.S. Department of Justice and Bureau of Justice Assistance for law enforcement support expenditures as outlined in the attached Expenditure Plan submitted by the Ollef of Police (Exhibit" A"). SECTION 2. The Mayor and Conunon Council of the Gty of San Bernardino hereby authorize the Mayor, Cty Attorney, and Cty derk to sign a multi-jurisdiction JAG grant Memorandum of Understanding between the cities within San Bernardino County and the County of San Bernardino. Penman, City Attorney BY: L~ J-.P~ o Judith Valles, Mayor City of San Bernardino 2 2005-69 EXHIBIT "A" San Bernardino Police Department FY 05/06 Justice Assistance Grant Expenditure Plan Narrative ID Bureau Supervisor The need for an on-site supervisor (Forensic Specialist III) was identified in an independent audit of the Property Room conducted in August 1998. Since FY 99/00 this position has been funded by LLEBG funds. In FY 03/04, the Forensic Specialist III position funded by the General Fund and assigned to the ID Bureau was eliminated due to budget cuts. The remaining Forensic Specialist III now supervises both units. We need to maintain the current level of staffing and supervision in the Property and Evidence facility and ID Bureau to provide adequate staffing to collect, process, store, and safeguard property and evidence in police custody and protect the department and City from liability arising from the mishandling or loss of these items. Maintaining this position will provide additional safeguards to minimize the City's exposure to liability in this critical area of police operations. For FY 05/06, the salary and benefits of the Forensic Specialist III will be $69,891. Additional Dispatchers In 2003, the Police Dispatch Center handled more than 500,000 telephone calls, including 138,089 calls on 9-1-1 lines. From these calls, a total of 109,317 resulted in a police response to calls for service from the public. This workload makes the dispatch center one of the busiest centers servicing medium sized cities. Since FY 99/00, LLEBG funding has been used to augment their staffing, providing funding for three additional dispatcher positions. In January 2005, the Police Department will implement Split Frequency Dispatching, utilizing two primary dispatch channels during peak periods for calls for service. These positions are essential to maintain quality service for the public and department personnel and handle 9-1-1 calls and other calls for police service. For FY 05/06, the salary and benefits of the three grant funded Dispatcher II's will be $146,849. Police Equipment The remaining $28,875 in JAG funds will be spent for police safety equipment needed to support department operations and not funded through the General Fund due to budgetary constraints. These items would include Handie-Talkie (HT) radios, digital recorders, pursuit spike strips and SW AT equipment. ~- . 2005-69 San Bernardino Police Department FY 05/06 Justice Assistance Grant Line Item Budget Account Number Descrintion AMOUNT 001-219-50xx (1) Forensic Soecialist III $69,891 001-221-50xx (3) Disoatcher IIII $146,849 786-213-5704 Police eauipment $28,875 Totals $245,615 - 2005-69 OJP GRANTS MANAGEMENT SYSTEM (GMS}-GENERA TED APPLlCA TlON #2005-FI380-CA-DJ INTERLOCAL AGREEMENT BETWEEN THE TOWN OF APPLE VALLEY AND THE CITIES OF ADELANTO, BARSTOW, CHINO, COLTON, FONTANA, HESPERIA, HIGHLAND, MONTCLAIR, ONTARIO, RANCHO CUCAMONGA, REDLANDS, RIAL TO, SAN BERNARDINO, UPLAND, VICTORVlllE, AND THE COUNTY OF SAN BERNARDINO, CA CONCERNING DISTRIBUTION OF THE 2005 BYRNE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD This Agreement is made and entered into this ,g) d day of /11tVd!..A ,2005, by and between THE COUNTY OF SAN BERNARDINO, acting by and through its governing body, the Board of Supervisors (hereinafter referred to as "COUNTY"), and the aforementioned TOWN (hereinafter referred to as "TOWN") and named CITIES (hereinafter referred to as "CITIES"), acting by and through their respective governing bodies, the Town Council and City Councils, all of whom are situated within the County of San Bernardino County, State of California, as follows: WHEREAS, each governing body, in performing governmental functions or in paying for the performance of governmental functions hereunder, shall make that performance or those payments from current revenues legally available to that party; and WHEREAS, each governing body finds that the performance of this Agreement is in the best interests of all parties, that the undertaking will benefit the public,. and that the division of costs fairly compensates the performing party for the services or functions under this Agreement; and WHEREAS, the COUNTY agrees to release to TOWN and CITIES their respective grant allocation from the JAG Award within sixty (60) days upon receipt of funds, less five percent (5%) for administrative fees, as reflected on Appendix 1 here attached and hereby incorporated by reference as part of this agreement; and COUNTY agrees to use the five percent (5%) of JAG award funds received from TOWN and CITIES under this agreement for administrative fees toward the administration of TOWN's and CITIES' programs during the entire permissible duration of said programs; and TOWN and CITIES agree to deposit their JAG award funds into a separate trust account in accordance with JAG guidelines; and TOWN and CITIES each agree to the five percent (5%) reduction of their respective grant allocation from the JAG award, as reflected on Appendix 1 for administrative fees toward the administration of this program; and additionally the TOWN and CITIES each agree that it is their responsibility to ensure these funds are expended in accordance with JAG guidelines, and that the interest generated from such funds shall be solely applied and expended in accordance with these same JAG guidelines; and WHEREAS, the CITY and COUNTY believe it to be in their best interests to reallocate the JAG funds, NOW THEREFORE, the COUNTY and TOWN and CITIES agree as follows: DST:smc I#2549f17 Page 1 Interlacal Agreement re: 2005 JAG Award r OJP GRA N TS MA NA GEMEN T SYS TEM (GMS)-GENERA TED APPLlCA TION #2005-FI380-CA-DJ Section 1. Section 4. Nothing in the performance of this Agreement shall impose any liability for claims or actions against COUNTY other than what is authorized by law. Section 5. Nothing in the performance of this Agreement shall impose any liability for claims or actions against TOWN and/or CITIES other than what is authorized by law. Section 6. Each party to this Agreement will be responsible for its own actions in providing services under this Agreement and shall not be liable for any civil liability that may arise from the furnishing of the services by any other party. Section 7. The parties to this Agreement do not intend for any third party to obtain a right by virtue of this Agreement.
