CDCj2005-6 RESOLUTION NO. 2005-53 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE DISPOSITION OF THE AGENCY LOT TO MEADOWBROOK PARK HOMES, INC., PURSUANT TO THE APPROVED 2005 MEADOWBROOK SINGLE FAMILY RESIDENTIAL DISPOSITION AND DEVELOPMENT AGREEMENT (IVDA REDEVELOPMENT PROJECT AREA) 3 4 5 6 WHEREAS, the Redevelopment Agency of the City of San Bernardino (the "Agency") 7 is a public body corporate and politic; and WHEREAS, the Agency owns real property at 188 North Allen Street (APN: 0135-291- 8 9 17); and 10 WHEREAS, the parcel ofland identified above is referred to as "Agency Lot"; and 11 WHEREAS, the Agency acquired the Agency Lot using low- and moderate-income housing tax increment set-aside funds in the amount of $148,000 and estimated demolition cost 12 13 of$IO,OOO for a total expenditure of$158,000; and 14 WHEREAS, the Agency proposes to transfer the Agency Lot to Meadowbrook Park 15 Homes, Inc" a California corporation (the "Developer") in accordance with the terms and conditions of the approved agreement entitled "2005 Meadowbrook Single Family Residential 16 17 Development Agreement (Meadowbrook Restoration Area)", dated as of January 10,2005 (the 18 "2005 Agreement"); and 19 WHEREAS, the Developer shall develop and improve Agency Lot as may hereafter be transferred by the Agency to the Developer pursuant to the 2005 Agreement with a New Home, 20 using the design and improvement standards which are consistent with City Development 21 Permit III No. 03-34, as previously approved by the Planning Commission on November 18, 22 2003 under the 2003 Agreement; and 23 WHEREAS, the Agency has prepared and published a notice of joint public hearing i The San Bernardino County Sun Newspaper on February 7 and 14, 2005, regarding th 24 25 consideration and approval of the Disposition and Development of Agency Lot; and -1- P:\Agendll!l\Reso]ulioll!l\ResoJulioll!l\2005\05-02-22 Agency 1..01-] 88 N. MCC Resodoc , . 2005-53 WHEREAS, pursuant to Health and Safety Code Section 33433, the Agency ma 2 transfer Agency Lot to the Developer subject to the Mayor and Common Council adopting Resolution authorizing the Agency to transfer such Agency Lot in light of the findings set fort 3 4 herein, and the Agency has prepared a Summary Report that describes the salient points of th Disposition of Agency Lot to the Developer and identifies the cost of the 2005 Agreement to th 5 6 Agency. 7 NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND ORDERED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 8 9 10 Section 1. The Recitals of this Resolution are true and correct. Section 2. On February 22, 2005, the Mayor and Common Council conducted a ful 11 12 and fair joint public hearing with the Commission, and considered the written Agency staf report relating to the Disposition and Development of Agency Lot, the Summary Report and th 13 testimony submitted relating to the disposition and redevelopment of Agency Lot by th 14 Developer pursuant to the terms and conditions of the approved 2005 Agreement. The minute 15 of the City Clerk for the February 22, 2005, joint public hearing of the City Council and th 16 17 Commission shall include a record of all communication and testimony submitted to the Cit Council and the Commission at the joint public hearing by interested persons relating to th 18 Summary Report and the Disposition and Development of Agency Lot. 19 Section 3. This Resolution is adopted in order to satisfy the provisions of Health an 20 Safety Code Section 33433 as those provisions relate to the disposition of Agency Lot by th Agency to the Developer on the terms and conditions set forth in the approved 2005 Agreement. The City Council hereby finds and determines as follows: 21 22 23 (i) The Summary Report contains the information described in Health and Safet 24 Code Section 33433(a)(2)(B); 25 (ii) The disposition and redevelopment of Agency Lot by the Developer is i accordance with the approved 2005 Agreement and is consistent with th -2- P:\Agendas\ResQlutions\Resolutions\2005\OS_02.22 Agency Lot-IS8 N. " . , 2005-53 2 affordable single family housing supply preservation and expansion programs 0 the Agency Housing Implementation Plan; 3 Section 4, The Mayor and Common Council hereby find and determine that th 4 environmental review of the approval of the Disposition and Development of Agency Lo 5 contemplated thereunder is a "categorically exempt project" for the reasons indicated in th 6 Agency Staff Report. No potentially adverse environmental effects are anticipated to b associated with the redevelopment ofthe Project. 7 8 Section 5. The Mayor and Common Council hereby receIve and approve th 9 SUlllffiary Report pursuant to the approved 2005 Agreement in the form as submitted at this join 10 public hearing. Section 6. 11 Agency Lot by the 12 Agreement. 13 Section 7. The Mayor and Common Council hereby approve the disposition 0 Agency to the Developer on the terms set forth in the approved 2005 The City is not a party to the 2005 Agreement, and nothing in thi 14 Resolution shall be deemed to constitute an approval by the City of any application for 15 development project permit or approval which the Developer may hereafter be required to obtai 16 from the City as a condition precedent to the performance of the Developer's obligation unde 17 the 2005 Agreement with respect to the redevelopment of the Project and/or the construction 0 18 any New Home on Agency Lot.
