HomeMy WebLinkAbout2005-035 ... 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2005- 35 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CONFIRMING THE EXISTENCE OF A LOCAL EMERGENCY AND RATIFYING THE MAYOR'S ISSUANCE OF A PROCLAMATION DECLARING THE EXISTENCE OF A LOCAL EMERGENCY BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: WHEREAS, on January 17,2005, the Mayor issued a Proclamation, copy of which is attached as Exhibit "A," declaring the existence of a local emergency caused by the intense rains; and WHEREAS, the Mayor and Common Council do hereby confirm that conditions of peril to the safety of persons or property have arisen within the City of San Bernardino caused by intense rains, including damage to storm drain channels, infrastructure, building structures, and from the accumulation of debris within roadways at multiple locations; and WHEREAS, the aforesaid conditions of extreme peril warranted and necessitated the proclamation of the existence of a local emergency; and WHEREAS, The Mayor and Common Council do hereby ratify the Mayor's issuance of a Proclamation declaring the existence of a local emergency; and WHEREAS, IT IS FURTHER ORDERED that said local emergency shall be deemed to continue to exist until its termination is proclaimed by the Mayor and Common Council; and III III III III III ~ 2005-35 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CONFIRMING THE EXISTENCE OF A LOCAL EMERGENCY AND RATIFYING THE MAYOR'S ISSUANCE OF A PROCLAMATION DECLARING THE EXISTENCE OF A LOCAL EMERGENCY WHEREAS, IT IS HEREBY ORDERED that a copy of this Resolution be forwarded to the County of San Bernardino Office of Emergency Services with the request for a Governor's state of emergency declaration; and WHEREAS, IT IS FURTHER RESOLVED that Fred Wilson, City Administrator, is hereby designated as the authorized representative for public assistance and Rick Blackburn, Disaster Preparedness Coordinator, is hereby designated as the authorized representative for individual assistance of the City of San Bernardino for the purpose of receipt, processing, and coordination of all inquiries and requirements necessary to obtain available state and federal assistance. PENMAN, City Attorney B'rt.P- 2005-35 EXHIBIT "A" PROCLAMATION OF THE CITY OF SAN BERNARDINO DECLARING THE EXISTENCE OF A LOCAL EMERGENCY WHEREAS, Chapter 2.46 of the Municipal Code of the City of San Bernardino empowers the Mayor to proclaim the existence or threatened existence of a local emergency when said City is affected or likely to be affected by a public calamity and the Common Council is not in session; and WHEREAS, at the time of the issuance of this Proclamation, the Mayor and Common Council are not in session, therefore, the undersigned, as Mayor of the City of San Bernardino do hereby find that conditions of peril to the safety of persons or property have arisen within the City of San Bernardino caused by intense rains, including damage to storm drain channels, infrastructure, building structures, and from the accumulation of debris within roadways at multiple locations; and WHEREAS, the aforesaid conditions of peril warrant and necessitate this proclamation of a Local Emergency; NOW, THEREFORE, IT IS HEREBY PROCLAIMED that a local emergency now exists throughout said City commencing on or about 9:00 a.m. on January 7, 2005; and IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said local emergency the powers, functions, and duties of the emergency organization of this City shall be those prescribed by state law, by ordinances, and resolutions of this City, and by the City of San Bernardino Emergency Plan. IT IS FURTHER PROCLAIMED AND ORDERED that the Common Council shall ratify this proclamation within seven (7) days of the issuance of this Proclamation.
