This is the time and place set for an Adjourned
Regular Meeting of the Mayor and Common Council of the
City of San Bernardino at the Regular Meeting held at 9:12
a.m., Tuesday, September 6, 1988, in the Council Chambers
of City Hall, 300 North "D" Street, San Bernardino,
California.
The City Clerk has caused to be posted the Notice of
Adjournment of said meeting held on Tuesday, September 6,
1988, at 9:12 a.m., and has on file in the Office of the
City Clerk an affidavit of said posting together with a
copy of said Notice which was posted at 11:00 a.m.,
Wednesday, September 7, 1988, in the Council Chambers of
ci ty Hall, 300 North "D" Street, San Bernardino,
California.
The Adjourned Regular Meeting of the Mayor and Common
Council of the City of San Bernardino was called to order
by Mayor Wilcox at 9:03 a.m., Wednesday, September 14,
1988, in the Council Chambers of City Hall, 300 North
"D" Street, San Bernardino, California.

INVOCATION
The Invocation was given by John Lowe, Campus Crusade
for Christ.
PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Council Member
Miller.
ROLL CALL
Roll Call was taken by City Clerk Clark with the
following being present: Mayor Wilcox; Council Members
Reilly, Minor, Pope-Ludlam, Miller; Acting City
Administrator Robbins; City Clerk Clark. Absent: Council
Members Estrada, Flores, Maudsley; City Attorney Penman.
PROPOSED AGREEMENT - CITY AND STATE OF CALIFORNIA -
ACQUISITION OF STATE-OWNED SURPLUS LAND -
PATTON FARMS
In a memorandum dated August 30, 1988, Council Member
Reilly explained that the Community Development Department
staff has been corresponding with the State Department of
General Services regarding acquisition of approximately
69.43 acres of vacant, surplus property, commonly known
as Patton Farms, located in the general vicinity of sixth
street, Ninth Street, Del Rosa Avenue and Tippecanoe

Avenue. The property is owned and offered for sale by the
State. The City is interested in buying the land for the
development of affordable housing. (1)

Ken Henderson, Director of Community Development,
stated that his staff had just completed a long round of
negotiations with the State of California Department of
Housing and Community Development in an effort to acquire
property on behalf of the City for transfer to Norton Air
Force Base.
Mr. Henderson explained that a survey has shown that
Norton Air Force Base has one of the most intractable
housing problems of a community air force base in the
United States. The development of housing units for
Norton would relieve this problem and in addition, free up
additional low and moderate income property within the
City of San Bernardino.
Mr. Henderson has put together a package for the
development of 400 units with the possible addition of 300
units. This project will be built by a private developer,
but Norton will manage and maintain the units for 20
years. If, in fact, the Air Force has no use for the
project after 20 years, it may revert to private
ownership.

The City will enter into a 14 month escrow with the
Department of General Services. The City will provide a
$300,000 earnest money deposit. Funds will be provided
by the Army Corps of Engineers on behalf of Norton Air
Force Base. Norton Air Force Base will issue an RFP for a
developer. Once the developer is selected, the developer
will obtain financing and acquire the land in question
from the City. With a portion of the developer's loan
proceeds, the remaining amount of money to be provided to
the State, approximately $2.7 million, will be sent to the
State by the City and the City will convey the property to
the developer for the construction of the 400 units.
The Director of Community Development explained the
purpose of the two resolutions before the Council and what
is necessary to complete the transaction. The State
Department of Public Works must approve the sale of the
land to the City. They are meeting on Friday, September
16, 1988, to address this project. NAFB has to have the
money in hand by September 30, 1988, to consummate this
transaction or the project will lose its funding.
Mr. Henderson introduced Colonel Deegan, Tom Calhoun,
Ms. Webber, and the legal counsel from NAFB, Mr.
Jurlinsky.

The Director of Community Development answered
questions of the Council regarding the "deal". He
explained that if the deal fell through all parties would
return to their initial position. However, there might be
language in the agreement regarding the administrative
costs of the State. These costs would be paid for by the
Army Corp of Engineers on behalf of the Air Force.
He also stated that San Bernardino has a higher need
than there is housing available, therefore the vacated
units will be easily leased. There has been a tightening
up of the market because of the reduction in the
construction of new units.

Attorney Penman
arrived at
the
City Attorney Penman presented his objections to
certain language in the agreement with respect to the
City's designation as the vendor of the property when the
City in fact is not the owner. He was also concerned
about the vagueness of who pays the administrative costs.
City Attorney Penman answered questions.

RECESS MEETING - 4:00 P.M.
At 9:30 a.m., Council Member Member Pope-Ludlam made a
motion, seconded by Council Member Reilly and unanimously
carried, that the meeting be recessed until 4:00 p.m., in
the Council Chambers of City Hall, 300 North "D" Street,
San Bernardino, California.
RECONVENE MEETING
At 4:00 p.m., the Adjourned Regular Meeting of the
Mayor and Common Council reconvened in the Council
Chambers of Ci ty Hall, 300 North "D" Street, San
Bernardino, California.
ROLL CALL
Roll Call was taken by City Clerk Clark with the
following being present: Mayor Wilcox; Council Members
Reilly, Minor, Pope-Ludlam, Miller; Deputy City Attorney
Wilson, City Clerk Clark, Acting City Administrator
Robbins. Absent: Council Members Estrada, Flores,
Maudsley.
Council Member Minor made a motion, seconded by
Council Member Reilly and unanimously carried, that
further reading of the following resolutions be waived and
that said resolutions be adopted:

RES. 88-348 - RESOLUTION OF THE CITY OF SAN
BERNARDINO AUTHORIZING THE EXECUTION OF AN
AGREEMENT BETWEEN THE CITY OF SAN BERNARDINO
AND THE STATE OF CALIFORNIA FOR THE PURCHASE
OF 69.43 ~ACRES OF STATE LAND IN THE CITY OF
SAN BERNARDINO.
RES. 88-349 - RESOLUTION OF THE CITY OF SAN
BERNARDINO AUTHORIZING THE EXECUTION OF AN
AGREEMENT WITH TIrE UNITED STATES DEPARTMENT
OF THE ARMY FOR AN OPTION TO PURCHASE 69.43~
ACRES IN THE CITY OF SAN BERNARDINO.
Resolution Nos. 88-348 and 88-349 were adopted by the
following vote: Ayes: Council Members Reilly, Minor,
Pope-Ludlam, Miller. Noes: None. Absent: Council
Members Estrada, Flores, Maudsley.
Deputy City Attorney Wilson explained the changes that
had been agreed upon between his office and Community
Development. He stated that the City has a maximum
exposure of $2500 if the project does not come to
fruition.

ADJOURNMENT
At 4:10 p.m., Council Member Miller made a motion,
seconded by Council Member Minor and unanimously carrled,
that the meeting be adjourned to 9:00 a.m., Monday,
September 19, 1988, in the Council Chambers of City Hall,
300 North "D" Street, San Bernardino, California.
