Said Council Meeting will be held in the Council Chambers in City Hall, 300 North "0" Street, San Bernardino, California. The purpose for which this meeting has been called is as follows: 1. Consider and act upon counterproposal to Local Agency Formation Commission Executive Officer presentation to Mayor and Council Committee on Relations with Unincorporated Territories. . 2. Take any other action relating to the foregoing counterproposal or modifications thereof. 3. Instruct the Mayor of San Bernardino to deliver the Council approved proposal, subject: Solution to the East San Bernardino/Highland boundary issue to the Local Agency Formation Commission at the Commission's public hearing meeting scheduled for April 13, 1983 at 9:00 a.m. /s/ SHAUNA CLARK City Clerk City of San Bernardino, California April 12, 1983 . The Special Meeting of the Mayor and Common Council of the City of San Bernardino was called to order by Mayor Holcomb on Tuesday, April 12, 1983, at 4:00 p.m., in the Council Chambers of City Hall, 300 North "0" Street, San Bernardino, California. INVOCATION The Invocation was given by Reverend Trudy Sorsdahl, Coordi- nator of the Lutheran Social Services of San Bernardino. ROLL CALL Roll Call was taken by the City Clerk with the following be- ing present: Mayor Holcomb; Council Members Reilly, Hernandez, Marks, Quiel, Hobbs, Strickler; City Clerk Clark. Absent: Coun- cil Member Castaneda; City Attorney Prince, City Administrator Matzer. . COUNTERPROPOSAL - EAST SAN BERNARDINO/HIGHLAND BOUNDARY ISSUE Council Member Marks presented in a memorandum dated April 8, 1983, a counterproposal for settling the boundary dispute between the County and the City regarding the eastern City boundaries. Council Member Marks recommended in his memorandum that the pro- posal for incorporation before the Commission be withdrawn by the County or denied by LAFCO. In lieu of the Hammer proposal for incorporation, the City, County and LAFCO would agree to the following process: . . . That the City of San Bernardino, within a ninety-day period, initiate a request for the entire unincor- porated area from Waterman Avenue eastward to Boulder Avenue to be annexed to the City of San Bernardino. That an election by all affected unincorporated voters be held on the question of annexation to the City of San Bernardino and that said election be held by July 1, 1984. If the annexation submitted to the voters is defeated, the City, County and LAFCO would jointly consider all remaining viable alternatives, including the feasi- bility of an election on Highland cityhood. For the purpose of considering Highland cityhood, the parties involved shall examine the feasibility of incorporat- ing territory from within the Redlands sphere of in- fluence into the proposed Highland cityhood boundaries. Any Highland cityhood boundary plan proposing a de- tachment of territory from the City of San Bernardino must be approved by the City of San Bernardino as a condition precedent. . If the option of a Highland cityhood election is de- termined to be the most feasible viable option avail- able should the above referenced San Bernardino an- nexation election be defeated, all unincorporated area east of Waterman to Boulder (or Church) not included in the boundaries for Highland cityhood, shall also be submitted to the voters at the same time for ap- proval of annexation to the City of San Bernardino. If the Highland cityhood election fails, the area en- compassed within the cityhood boundary plan (except territory originally within the Redlands sphere of influence) would remain within the City of San Bernar- dino's sphere of influence. If the "annexation to San Bernardino election" fails pursuant to the fourth step, the area encompassed within said annexation boundary plan would remain within the City of San Bernardino's sphere of in- fluence. . COUNCIL MEMBER CASTANEDA ARRIVED At 4:05 p.m., Council Member Castaneda arrived at the Council Meeting and took his place at the Council Table. Mayor Holcomb presented his objections to the counterproposal and offered a suggestion that the Council instruct the Planning Department to initiate annexation procedures for the entire zone of influence for the City, instruct the Planning Department to go ahead to start the environmental review process and the Plan- ning Department be authorized the establishment of Senior Planner and Planning Technician in the Planning Department to prepare the environmental impact report. DEPUTY CITY ATTORNEY FENTON ARRIVED At 4:15 p.m., Deputy City Attorney Fenton arrived at the Council Meeting and took her place at the Council Table. Mayor Holcomb and Council Member Marks discussed the counter- proposal and the advisability of holding two elections. . COUNCIL MEMBER HERNANDEZ EXCUSED At 4:50 p.m., Council Member Hernandez was excused from the Council Meeting. - 2 - 4/12/83 . . . . . . After further discussion, Council Member Quiel made a motion, seconded by Council Member Strickler and unanimously carried, that the proposal for incorporation before the Commission be withdrawn by the County or denied by LAFCO. In lieu of the proposal for in- corporation, the City, County and LAFC would agree to the follow- ing process: That the City of San Bernardino, within a ninety- day period, initiate a request for the entire unincorporated area from Waterman Avenue eastward to Boulder Avenue to be annexed to the City of San Bernardino. Council Member Marks made a motion, seconded by Council Mem- ber Quiel and unanimously carried, to direct the Planning Depart- ment to initiate an application to the Local Agency Formation Commission to annex, subject to prezoning, all unincorporated property within the City's Sphere of Influence lying east of Waterman Avenue, south of the U. S. Forest Service boundary, and north of Norton Air Force Base and generally west of Boulder Ave- nue. Council Member Marks made a motion, seconded by Council Mem- ber Quiel and unanimously carried, to instruct the Environmental Review Committee to review an Initial Study, to be prepared by the Planning Department, on the proposed pre zoning and annexation of all unincorporated property within the City's Sphere of In- fluence lying east of Waterman Avenue, south of the U. S. Forest Service boundary, and north of Norton Air Force Base and generally west of Boulder Avenue, for compliance with the California En- vironmental Quality Act and City environmental guidelines. Council Member Marks made a motion, seconded by Council Mem- ber Quiel and unanimously carried, to refer to the Personnel Com- mittee the establishment of two positions, one Senior Planner and one Planning Technician, within the Planning Department to prepare planning studies and accompanying environmental impact report, if necessary, on the proposed prezoning and annexation of all un- incorporated property within the City's Sphere of Influence lying east of Waterman Avenue, south of the U. S. Forest Service bound- ary, and north of Norton Air Force Base and generally west of Boulder Avenue. ADJOURN MEETING At 5:10 p.m., Council Member Castaneda made a motion, seconded by Council Member Quiel and unanimously carried, that the meeting be adjourned.
