HomeMy WebLinkAbout10473 RESOLUTION NO. /;?/,!;;3 2 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DECLARING THE FACT THAT THE OWNER OF ALL THE LAND IN CERTAIN 3 TERRITORY CONTIGUOUS TO SAID CITY HAS REQUESTED ANNEXATION TO THE CITY OF SAN BERNARDINO, AND APPROVING THE ANNEXATION OF DISTRICT NO. 255 (LAFC 927). 1 4 5 WHEREAS, the Mayor and Common Council of the City of San Bernardino 6 have duly received a request by the owner of all the land within certain 7 territory contiguous to said city, as shown on the records of the San Bernar- 8 dino County Assessor, and asking that said territory be annexed to the City of 9 San Bernardino; and 10 WHEREAS, at its meeting of September 30, 1970, the Local Agency 11 Formation Commission of San Bernardino County approved the proposed annexation 12 and gave consent to proceed without notice, pursuant to Government Code 13 Section 54797.1. 14 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF 15 THE CITY OF SAN BERNARDINO AS FOUOWS: 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 SECTION ONE: That pursuant to Chapter 1, Article 1, Section 35015 of the Government Code, the annexation of that certain territory contiguous to the City of San Bernardino, designated as Annexation District No. 255 (LAFC 927), be and the same hereby is approved. Said territory is described as follows: That portion of Lot 143, Tract No. 2243 as per plat thereof recorded in Book 32 of Maps, Pages 21 and 22, records of the County Recorder of San Bernardino County, State of California and that portion of the adjoining street, described as follows: Beginning at a point on the present corporate limits of the City of San Bernardino, said point being the intersection of the center line of California Street with the Easterly pro- longation of the South line of said Lot 143, said point also being 660 feet South of the center line of Darby Street; thence West along said Easterly prolongation and said South line, a distance of 330 feet to the Southwest corner of said Lot 143, said point being the Southwest corner of that certain parcel described in the document recorded May 1, 1967; Docu- ment No. 529 in Book 6812, Page 571, Official Records of said County; thence North along the West line of said Lot 143 and the West line of said above mentioned parcel, a distance of 145 feet to the Northwest corner of said above mentioned parcel; thence East along the North line of said parcel and the Easterly prolongation thereof, a distance of 330 feet to the center line of said California Street and said City Limit Line; thence South along said center line and said City Limit Line, a distance of 145 feet to the point of beginning. (Containing 1.10 acres more or less) -1- 1 SECTION TWO: That the above described property will be subject to 2 taxation equally with the property within such municipal corporation to pay 3 its proportion of the following bonded indebtedness of the City of San 4 Bernardino, which said bonded indebtedness was outstanding or theretofore 5 authorized and is outstanding at the time of said annexation, to wit: 6 A bonded indebtedness of $490,000.00 incurred for the acquisition 7 and construction of a public library, including additions to and enlargements 8 of the public library system of said city, the outstanding indebtedness thereon 9 being $265,000.00, bearing interest at the rates of 4-3/4%, 3-1/4% and 3-1/2% 10 per annum; 11 A bonded indebtedness of $1,116,000.00 incurred for the acquisition 12 and construction of additions to, relocations of and replacements of the 13 fire fighting system of said city, the outstanding indebtedness thereon being 14 $765,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2% 15 per annum. 16 SECTION THREE: That the area included in the above annexation 17 is hereby detached from County Service Area No. 70. 18 SECTION FOUR: That the property herein annexed is declared to be a 19 part of Ward 6, and the boundaries of Ward 6 are hereby altered to include 20 said annexed territory, and said annexed territory is placed and declared to 21 be in the R-1-7200 Single Family Residential Zoning District. 22 I HEREBY CERTIFY that the foregoing resolution was duly adopted by 23 the Mayor and Common Council of the City of San Bernardino at a regular 24 meeting thereof, held on the 19th day of October, 1970, by the following vote, 25 to wit: 26 AYES: Councilmen vj;r,<J/);'/d/ /?t:,01/~'i~ ;{~1/;z/?;:7/ ,,-?:6'b~';;',<'I~; j?lAd f/~ffiJl" /7fE./',/PC;/ NOES: 7' ~~/Z// ABSENT: 7" l,'/i/ / 27 28 29 30 31 c-7f;:"~f'i~ The foregoing resolution is hereby approved this /-,;'/!,-:,f/ day of 32 -2- 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 1 October, 1970. 2 3 4 Approved as to form: ,7 / .., " FILED Ul,; I 20 1970 ~~~::2/:~,~~(::.': -3- May
