2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION CF AN AGREEMENT WITH THE COUNTY OF SAN BERNARDINO
3 RELATING TO THE RESURFACING OF PALM AVENUE, FROM HIGHLAND AVENUE
TO CITRUS STREET.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
5 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San Bernardino is
7 hereby authorized and directed to execute on behalf of said City
8 an agreement with the County of San Bernardino relating to the
9 resurfacing of Palm Avenue, from Highland Avenue to Citrus
10 Street, a copy of which is attached hereto, marked Exhibit "A"
11 and incorporated herein by reference as fully as though set forth
13
12 at length.
SECTION 2. The contract authorized by this resolution shall
14 not take effect until fully signed and executed by both parties.
15 Neither party shall be obligated hereunder unless and until the
16 contract is fully executed and no oral agreement thereto shall be
17 implied or authorized.

IT IS HEREBY AGREED AS FOllOWS:
(Use space below and additional bond sheets. Set forth service to be rendered, amount to be paid, manner of payment, time
for performance or completion, determination of satisfactory performance and cause for termination, other terms and
conditions, and attach plans, specifications, and addenda, if any.)
WHEREAS, Palm Avenue between Highland Avenue and Citrus Street, is in
need of resurfacing to prevent further deterioration of the existing pavement
and to improve riding quality; and
WHEREAS, jurisdiction for operation and maintenance of Palm Avenue is
split between COUNTY and CITY; and
WHEREAS,
participate in
Avenue; and
COUNTY and CITY mutually desire to cooperate and jointly
the proposed resurfacing of the above noted section of Palm
WHEREAS, COUNTY and CITY desire to set forth the responsibilities and
obligations of each agency in relation to the performance of the proposed
resurfacing.
NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS:
CITY SHALL:
1. Act as lead agency for the resurfacing of Palm Avenue.
2. Perform the full width resurfacing of Palm Avenue, between Highland
Avenue and Citrus Street, with an average one (1) inch thickness
of asphalt concrete, and replace traffic striping and pavement
markings.
3. Initially finance the total cost of the proposed resurfacing,
estimated at $27,900.
4.
Obtain a no-cost permit from COUNTY for work within the COUNTY'S
right of way.

5. Require its contractors to maintain Worker's Compensation Insurance
on all employees and a Public and Property Liability Insurance
Policy of not less than $1,000,000 combined single limit liability
coverage for bodily injury and/or property damage which shall name
the City of San Bernardino and the County of San Bernardino as
additional insured parties.
COUNTY SHALL:
1. Reimbur se the CITY for the cost incurred for resurfacing the
portion of Palm Avenue that is under jurisdiction of the COUNTY
wi thin thirty (30 l days after receipt of a billing from the CITY.
The COUNTY'S share shall be the cost of resurfacing the portion of
Palm Avenue under the COUNTY'S jurisdiction, including the cost of
replacing traffic striping and pavement markings, and is estimated
to be $12,700 and shall in no event exceed $14,000 unless approved
in writing by the COUNTY.
BE IT FURTHER AGREED THAT:
1. Neither party to this Agreement nor officers nor employees thereof
shall be responsible for any damage or liability occurring by
reason of anything done or omitted to be done by the other party
to the Agreement under or in connection with any work authority or
jurisdiction not delegated to the parties under this Agreement.
It is also agreed that, pursuant to Government Code Section 895.4,
each party shall fully indemnify and hold the other party harmless
from any liability imposed for injury (as defined by Government
Code Section 810.8loccurring by reason of anything done or omitted
to be done under or in connection with any work authority of
jurisdiction under this Agreement.
2. Upon completion of the resurfacing, the CITY and COUNTY will
maintain the portion of the work within their respective areas of
jurisdiction.
3. This Agreement may be amended or modified at any time upon mutual
agreement of the parties hereto.

COUNTY/CITY OF SAN BERNARDINO,COOPERATIVE AGREEMENT
RE: PALM AVENUE RESURFACING PROJECT (HIGHLAND/CITRUS)
RECOMMENDATION: Approve cooperative agreement between County and City of
San Bernardino for resurfacing of Palm Avenue from Highland Avenue to Citrus
Street.
BACKGROUND: This agreement sets forth the conditions under which the County
and City of San Bernardino will cooperate in the resurfacing of Palm Avenue.
The City will act as lead agency for the resurfacing project. Palm Avenue
from Orchid Street north to San Bernardino City limits is within the unincor-
porated area of the County and the remaining portion of the project is in
the incorporated area of the City of San Bernardino.
REASON FOR RECOMMENDATION: This agreement is needed to set forth the respon-
sibilities of the City and the County in this cooperative project.
REVIEW BY OTHERS: On November 25, 1985 the agreement was reviewed by Deputy
County Counsel Ed Robinson as to legal form. On November 19, 1985 the
agreement was reviewed by the Department Affirmative Action Representative
for contract compliance.
FINANCIAL DATA: The total estimated cost for this project is $27,900. The
County's estimated share of the total cost is $12,700. Funding for the
County's share of the project cost is available from the SB300 special road
repair funds added to the Road Budget by Board of Supervisors' action on
November 25, 1985.
