RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE
2 APPLICATION FOR BLOCK GRANT FUNDS UNDER THE PROVISIONS OF THE
3 ROBERTI-Z'BERG-HARRIS URBAN OPEN-SPACE AND RECREATION PROGRAM FOR
THE CONSTRUCTION OF RESTROOM FACILITIES AT PERRIS HILL PARK.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
5 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Recitals.
7 (a) The people of the State of California have enacted the
8 Roberti-Z'Berg-Harris Urban Open-Space and Recreation Program Act
9 (Public Resources Code Sections 5620, et seq.) which provided
10 funds to the State of California and local agencies for acquiring
II lands and developing facilities for public outdoor recreation
12 purposes.
13 (b) The State Department of Parks and Recreation has been
14 delegated the responsibility to administer the program, and to
15 establish procedures governing application by local agencies for
16 funds.
17 (c) Procedures established by the State Department of Parks
18 and Recreation requires the applicant to authorize by resolution
19 the filing of applications for funding.
20 (d) Public Resources Code Section 5626 requires grant
21 applicants to certify compliance with certain laws and
22 regulations.
23 (e) Adopted procedures require the applicant to have
24 adopted a plan showing parks and recreation lands and facilities,
25 existing and proposed.
26 (f) The City's General Plan was first adopted by the Mayor
27 and Common Council on October 3, 1964.

1 (g) The proposed project at perris Hill Park appears on the
2 City's General Plan. The Plan is consistent with the California
3 Outdoor Recreation Resources Plan and is in conformity with the
4 State Environmental Goals and Policy Report.
(h) The project is compatible with the land use plans of

6 those jurisdictions immediately surrounding the project.
7 SECTION 2. The Mayor and Common Council approve the filing
8 of applications for grant assistance under the ROberti-Z'Berg-
9 Harris Urban Open-Space and Recreation Program Act.
10 SECTION 3. The Mayor and Common Council certify that the
11 City of San Bernardino understands the certifications set forth
12 in the application, and authorize the City Attorney to make the
13 certifications.
14 SECTION 4. The Mayor and Common Council certify that the
15 City of San Bernardino has or will have sufficient funds to
16 operate and maintain the project.
17 SECTION 5. The Mayor and Common Council certify that the
18 City of San Bernardino meets the planning requirements and that
19 the project is compatible with the land use plans of those
20 jurisdictions immediately surrounding the project.
21 SECTION 6. The Director of Parks, Recreation and Community
22 Services Department of the City of San Bernardino is authorized
23 and directed to execute on behalf of the City application for
24 block grant funds under the provisions of the ROberti-Z'Berg-
25 Harris Urban Open-Space and Recreation Program, a copy of which
26 is attached, marked Exhibit "A". The Director of the Parks,
27 Recreation and Community Services Department is authorized to
28 administer any grant funds which may be received, and to provide

to the State of California such additional information as may be

IMPORTANT
Y Oll may incur costs against the grant only after your project has been approved by the Legislature and the State has
received YOllr application signed by your attorney. All State requirements must be met and an agreement signed before
any funds will be disbursed.
An audit may be performed before or after final payment.
GRANT APPLICATION
A complete application consists of one each of the following 11 items.
1. __ A completed application form signed by the peison authorized in your resolution and by your attorney.
2. __ The resolution from your governing body authorizing the application.
3. _ Environmental Impact Report or Negative Declaration and a copy of Notice of Determination showing County
Clerk's stamp, or, if applicable, a copy of the Notice of Exemption if the project is categorically exempt, or the
reason why CEOA does not apply. Clearinghouse response is required if you have an EtR or Negative Declaration
for the project.
4. _A city or county street map showing the project location in sufficient detail to find the site.
5. ~ If property to be developed is not owned in fee, evidence of adequate land tenure. (Copies of leases, joint powers
agreements, permits, etc.)
6._~ A site plan for development projects. Map of the overall park showing location of project facilities, details of
access, water, power and sanitation.
7 '__~ Cost estimate. A detailed estimate of all projects costs.
H.~__Acquisition map and acquisition schedule listing number of parcels, size and approximate date of acquisition and
cost (acquisition projects).
9._ __A list of all funds, over and above the grant requested, that will be used for the project.
1 a._Copies of any permits, leases, agreements, etc. affecting project lands or operation and maintenance.
11. _~ Photos of the project site.
Assurances
The applicant hereby gives assurances and certifies with respect to the grant that:
It possesses legal authority to apply for the grant, and to finance, acquire and construct the proposed project; that a
resolution, motion or similar action has been duly adopted or passed as an official act of the applicant's governing body,
authorizing the filing of the application, including all understandings and assurances contained therein, and directing and
authorizing the person identified as the official representative of the applicant to act in connection with the application
and to provide such additional information as may be required.
It will provide and maintain competent and adequate architectural engineering supervision and inspection at the con-
struction site to insure that the completed work conforms with the approved plans and specifications; that it will furnish
progress reports and such other information as the State may require.
It will give the State's authorized representative access to and the right to examine all records, books, papers, or
document related to the grant.
It will cause work on the project to be commenced within a reasonable time after receipt of notification from the State
that funds have been approved and that the project will be pursued to completion with reasonable diligence.
It will not dispose of or encumber its title or other intrests in the site and facilities without permission from the State
Legislature.
It will comply where applicable with provisions of the California Environmental Ouality Act and any other State, and/or
local laws, rules and/or regulations.
In cases involving leased property, it agrees to maintain and operate the property and/or facilities acquired or developed
for an agreed to period commensurate with the type of project and the proportion of state grant funds and local funds
allocated to the capital costs of the project.
