Staff Report
SUBJECT:
Authorization to proceed with the de-annexation of a 3.62 acre parcel ofland generally located at
the northeast corner of the city at the top of Church Street.
BACKGROUND:
The City of Highland is requesting that the City of San Bernardino consider de-annexing a 3.62
acre parcel which is generally located at the northeast corner of the city at the top of Church
Street for the purpose of annexing into the City of Highland (See Attachment A). The proposed
development for this property consists of five (5) residential parcels, all approximately Y, acre
each. Currently, the only way to access this property is through the City of Highland. Various
City of San Bernardino Departments reviewed this request and determined that because of
access, the City of Highland may be better suited for providing service to this area (i.e. refuse,
street and sidewalk maintenance, safety, etc.).
On July 12, 2005, the City of Highland approved the request to annex the 3.62 acre vacant lot
into the City of Highland and staff was authorized to process the anticipated Local Agency
Formation Commission (LAFCO) application as the lead agency (See Attachment B).
On August 2, 2005, this annexation request from the City of Highland was submitted to the
Legislative Review Committee (LRC). Based on staff input and review, the LRC recommended
that the annexation request of the City of Highland be brought before the Mayor and Common
Council for authorization to proceed with the de-annexation of this 3.62 acre parcel from the City
of San Bernardino. If authorization to proceed is given, the City of Highland will take the lead by
presenting this reorganization to LAFCO
FINANCIAL IMPACT:
None. The City of Highland will be paying all the fees associated with the reorganization
process.

SUBJECT. Request for annexation of a 3.62 acre vacant lot cumntly within the City of
San Bernardino located at the northerly terminus of Applewood Street
(APN: 1199-341-15). Property Owner' David & Hyun Chong
RECOMMENDA nON: Staff recommends the City Council consider supporting, in concept, the
request to annex the subject property into the City of Highland corporalB
boundsI)', snd authorize Staff to process the anticipated Local Agency
Formation Commission (lAFCO) Application as the lead agency. Slid
Application would not be accepted until such time as the City of Sin
Bemardino agrees to detach the subject property

FISCAL IMPACT: Cost associated from the anticipated annexation application (Inclusive of
LAFCO Application and related fees) will be paid by the subject property owner/applicant, which could
range from $50,000,00 to $70,000.00. Long term fiscal and service Impacts to the City of Highland,
would be determined by a Fiscal Impact and Services Analysis (both required by LAFCO).
BACKGROUND: The subject property owners, David and Hyun Chong, recently meet with Riel<
Hartman, Community Development Director, as wen as representatives from the City of San Bemardino
to obtain support for a Mure annexation application with LAFCO On June 27, 2005, the subject
property owners officiany notified the City of San Bernardino of their Intentions to deannex from the City
of San Bernardino (see Attachment 1, letter dated June 27, 2005). A tentative tract map forflve (5) Iota
is currently being processed by the City of San Bernardino. Teri Baker for the City of San Bernardino
Administrator's Office informed Staff she would present this item to their Legislative Subcommittee for

SUMMARY: Based on a preHminary review of the subject Site, both by Highland and
San Bemardino Staff, It is ~mllnded the subject property be annexed into the City of
Highland's corporate boundary to provide a greater level of service then could be provided
by the City of San Bernardino due to restricted access from San Bemardino (see
Attachment 2, Location Map),
Although up to this point, Staff's recommendation was based on the physical environment
which indudes the following:
1 Potential to extend the existing stub out at the northerly terminus of
Applewood Street to SelVe future development on the subject property and
provide direct access for City services, such as fire, police, and trash;
2. With the approval of East Highlands Ranch housing tracts along the eastem
side of the subject property, Church Street no longer extends northerly into
the City of San Bemardino and contiguous to the subject property;
3.
No direct access Is planned within the Highland Hills North Projee1located
north and west of the subject property (Rancho San Andreas Company ~
Aaron W. Hodgdon, property owner);

.. Existing a~gnment of Cook Canyon Creek along the northerly subject
property boundary could bea natural barrier between both Cities.
Staff is anticipating a General Plan Land Use designation of Low Density and a Zoning
designation of R1-20 (single family unit on a minimum lot size of 20,000 square feet) for
consistency with surrounding residentiqll neighborhoods, Excluding Hnlside Development
Standards, the proposed zoning could potentially generate six (6) or seven (7) single
family detached housing units.
Potential fiscal and City service impacts have not yet been determined.- In the past.
Highland does not collect as much property tax from the detached I annexed property as
it does from property already in the City limits. However, 215 part of ttle LAFCO Applicstion
and CEQA process, impacts related to the potential fiscal and services will be analy.zed
