ln May 1, 1995, Council directed staff to negotiate an agreement with Taormina Industries, Inc. for the
;rocessing of commingled recyclables from the residential waste stream. Staff prepared the attached cost
analysis, based on the following information.
Taormina possesses experience and knowledge of processing and marketing recyclables. In their original
proposal, Taormina proposes a three phase approach to servicing the City of San Bernardino. Phase I
includes expansion of the current operation for additional tonnage. This will be a continuation of the
present arrangement in which collected recyclables are dumped by the residential collection vehicles in
an area of the City Yard, and reloaded into larger transfer vehicles to be hauled approximately 47 miles
one way by Taormina. During Phase I, the City would continue to be responsible for reloading the
materials into the transfer trailers at the City Yard.
Taormina proposes a Phase II which includes development of a new transfer site for the City's recyclables.
This light transfer site would allow Taormina to use 130 cubic yard transfer trailers to be loaded by an
in-ground conveyor system. This will replace the current system of loading smaller, 40 cubic yard roll-off
bins. Taormina agreed to develop this facility within ninety (90) days after the issuance of all required
City permits for the facility. Taormina has not provided staff with a location for this facility; however,
they have expressed their intent to locate the facility within the City.
The City anticipates approximately 70 tons of commingled recyclables per day for delivery to this facility
upon full roll out of the residential curbside recycling program. Taormina intends to market the remaining
130 tons per day of capacity to other entities. Taormina has agreed to pay the City a $2.00 per ton host
~e for any non-City generated materials delivered to this facility. This host fee will be used to offset
,naintenance costs to City infrastructure that may result from operation of this facility. Since the City
anticipates delivering 70 tons per day to this facility, staff calculated the $2.00 per ton fee on the
remaining 130 tons per day capacity for annual revenue of $68,000.
Since this agreement was developed, the County of Orange Board of Supervisors has authorized an
increase in the tipping fee, effective July 1, 1995, from $22.75 per ton to $35.00 per ton. This translates
into an increase in residual disposal cost from $31.00 per ton to $43.25 per ton. This was factored into
the attached cost analysis.
Staff received a formal protest from the third vendor, CR&R regarding the selection of Taormina
Industries, Inc. for the processing of this material. Copies of their correspondence are attached.
RECOMMENDATION
Council adopt the resolution authorizing the Mayor to execute the agreement with Taormina Industries,
Inc. to process the City's residential commingled recyclables for a two year period, with three one year
options for a maximum of five years.

By comparison, the City would pay $630,000 to dispose of the 18,000 tons ofrecyclables by landfilling
at $35.00 per ton. This represents a first year savings of $623,950.00 and a second year savings of
$617,582.00.

Reference: Commingled Recyclables Processing Contract
Dear Mr. Penman:
Per the enclosed letter from Pat Malloy, my concerns have been directed to your
attention. It is CR&R's intention to formally protest the award of this contract.
Very simply, as stated in my previous letters dated May 2, and May 23, for the selected
option #1, CR&R is the lowest qualified bidder by some $569,780. To continue to utilize
options #2 and #3 as evaluation criteria is simply irrelevant to the selected option # 1.
Let me try and simplify how CR&R approached the bid and how I am sure all the other
bidders did as well. Everyone knows that when a bid contains more than one option, that
you bid as aggressively as possible on the option you desire to get. Likewise, on the
options you do not want or only desire it if they are very lucrative you bid very
conservatively.
If option #2 was selected, I would not be protesting the selection of another contractor,
but that is not the circumstance. The bottom line being, CR&R is the most cost effective .
contractor, and when it comes time to cut the actual check to the selected contractor,
CR&R's will be 56% smaller than their closest competitor. Option #1 is the best option
for the City regardless of the contractor, and CR&R is the best priced contractor for
option # I, so I am still confused how the City can ignore $569,780, which could actually
be $1,424,450 over the entire potential contractual term.
Please inform me on how to proceed with my formal protest. If you have any questions or
desire a meeting, please call me directly.

In response to your letters dated May 2, and May 23, 1995, the following response is respectfully
submitted.
On May 12, 1995 Lynn Merrill, Recycling Coordinator, met with Bob Williams from your fIrm
and reviewed the process which the City went through in order to select the fInal vendor for the
commingled recyclables processing agreement. During this meeting, we provided Mr. Williams
with copies of our evaluation forms, point scales and summary report. While cost was indeed
one of the factors by which we evaluated each proposal, it was not the sole determining factor.
As was explained to Mr. Williams, the City developed a complete process by which to evaluate
each proposal. This process included an objective point scale, a subjective reading by a fIve
member team of City staff, and cost analysis based on Option One, Option Two and the Floor
Pricing. In order to standardize the analysis, all revenues were based on the prices each vendor
was paying for each commodity in June 1994. Each of these areas were weighted the same, so
that price was not the sole awarding factor.
Based on this fIrst analysis, Jack's Disposal, Taormina Industries, and your fIrm were invited to
make a formal presentation to staff. As a result of all the information presented, at the
conclusion of the formal evaluation process your fIrm was placed number three. First place was
Jack's Disposal, aka Inland Resource Management, and second place was Taormina Industries.
As you are aware, staff submitted a recommendation to Council to award the agreement to Inland
Resource Management.
Upon the voluntary withdrawal of Inland Resource Management from the selection process, on
May 1, 1995, Council directed staff to negotiate an agreement with Taormina Industries.

While we recognize your disappointment in not receiving award of this agreement, the City
believes that the process by which staff evaluated each proposal permitted a fair and equitable
analysis of the many factors which each company presented to the City. We also wish to remind
you that this agreement is for a two year period with three additional one year options for a
maximum of five years. Additionally, the City is currently soliciting responses from qualified
firms for a Material Recovery Facility to he located within the City. We would certainly
encourage you to pursue a response to this Request for Qualifications.
You may contact either the City Attorney or the City Clerk if you wish to pursue a formal protest
of award regarding this item. We are currently scheduling this agreement for recommendation
at the June 19th council meeting.
We hope this letter has clarified some of the issues for you, and wish you the best ofluck in your
future endeavors.

1. WORK PLAN AND METHODOLOGY
TRANSPORTATION
PHASE I---EXPAND CURRENT OPERATION FOR ADDITIONAL TONNAGE
Transportation of material from San Bernardino would continue to
be coordinated by city staff and the C.V.T. Recycling
Transportation Dispatch Manager. A collection schedule would be
arranged based on the tonnage and delivery schedule of route
vehicles off loading at the city's existing transfer site. CVT would
ensure that the recyclable material would be transported for
processing on a "same day" schedule as to maintain the cleanliness
of the current city transfer site.
PHASE II---INTERIM REGIONAL "LITE TRANSFER" SITE DEVELOPMENT
Working with City staff, Taormina Industries would develop a new,
clean, well managed transfer site for the city's current residential
and future waste reduction programs. This "lite transfer" site
would utilize 130 yard transfer trailers that would be loaded by
in-ground conveyor systems. All loads would be weighed on site by
CVT personnel. This procedure would maximize the total number
of tons per trip and reduce the total cost of recyclable material
transportation for the city. This same type of "lite transfer" type of
facility has been approved by the City of Pomona, and will be
operational within 60 days. (Attachment 1). For the City of San
Bernardino, total construction and development project time will be
under six months. This type of interim facility is not capital
intensive and provides a low cost, quality short-term solution.
With such a facility, the city will have the ability to "host" other
waste streams for processing from local communities in the region.
This will beain the process of achieving the long-term goal of a
regional waste processing facility within the City of San
Bernardino.
PHASE 1lI---REGIONAL MATERIAL PROCESSING FACILITY.
After the establishment of a regional joint users group of
municipalities and private haulers for the management of solid
waste, Taormina Industries would develop a full scale regional
waste processing facility within San Bernardino. The full scale

facility would require no caoital investment on the part of the city.
Such a development will be designed in such a manner as to create
jobs for local residents, improve commercial property values,
increase the city's tax base and provide the opportunity for San
Bernardino to generate host fee revenues from regional users of the
facility. This would be a major project that would take two to
three years for development and would come ~ the interim "lite
transfer" facility was operational, including adequate tonnaoe flow
commitments to provide for the needed economies of scale.
PROCESSING
During the Phase I and Phase II operation of the existing and
interim "lite transfer" facilities, all material would be transferred to
CVT's regional processing facility in Anaheim. The actual
processing methods would not change from the current "pilot"
recycling program that is in place for the City of San Bernardino at
this time. As tonnage increased during Phase I and Phase II, the
material characterization would be expanded to include
"up-graded" processing and additional commodities thus increasing
the recovery rate and the value of material recovered. The actual
methodology of material recovery is detailed under section 2(4). It
is critical to understand that, without the ability to process and
market your material, you have no waste reduction program.
CVT's recovery facility is universally recognized as the
"state-of-the-art" in solid waste material recovery. It is fully
operational with long-term commitments for the purchase of our
recovered materials. We currently recover and sell over 25,000
tons of material each month. CVT's customers include the cities of
Anaheim, Brea, Fullerton, Placentia, Villa Park, Vorba Linda and the
Garden Grove Sanitary District and the waste streams for Waste
Management, Western Waste, BFI, and 35 other municipalities.

METHODS OF MARKETING
Taormina Industries currently markets in excess of 25,000 tons of
recyclables per month. Through our worldwide markets, Taormina
Industries has developed a reputation for oualitv and become one
of the largest suppliers on the west coast. Our markets are

relationships have developed through continued supply and regular
visits both here and abroad. Taormina Industries' commitment to
markets has gone one step farther this year. In 1 994 we are
pleased to say we have opened two new offices in the Pacific Rim.
These offices will not only enhance our current relationships but
offer future opportunities with the world's largest, growing
end-user markets.
Taormina Industries currently diverts over 70 different commodities
from the landfill. Some of the more common materials include:
newspaper, cardboard, glass, plastics, etc. In addition to the
common materials we recover, Taormina Industries had led the
industry in recovering new and innovative materials. Taormina
Industry was the first Southern California recycler to recover:
aseptic packaging, polystyrene and kraft carrier board. Other
innovative materials include: green and wood waste. Although
these two materials are commonly recovered today. they were not
eight years ago when Taormina Industries started to recover them.
The benefits of Taormina Industries recovering all of these
materials is an overall increased recovery rate percentage for our
. customers.
Taormina Industries has a unique philosophy in marketing our
recyclable materials. Taormina's aualitv creates demand for our
materials. All materials recovered meet or exceed their industry
standards. Taormina Industries commitment to quality starts with
in house characterizations and internal rejection procedures. These
procedures not only help us monitor our quality but insure markets
today and into the future. By creating materials that are of better
quality than our competitors. the end users consistently demand
more of our materials.
Another unique aspect of the Taormina Industry philosophy is what
we do after we sell our recycled commodities. We encourage and
develop opportunities for our customers to "buy recycled."
Through buying recycled products we are able to help create more
demand for the materials we recover. In several cases we have
put together programs that "close the loop". Materials we recycle
are recycled, made into new products and then bought, reused. for
the same customer.

Taormina Industries is proud of the reputation we have for quality
commodities and new and innovative programs. Our sales and
brokerage department works year round on new and existing
markets.
HOUSEHOLD HAZARDOUS
Taormina Industries currently is processing residential co-mingled
material from over 250.000 single family households. We have
found. with educational programs on proper disposal of household
hazardous materials, the amount of hazardous materials
encountered is very minimal. Any household hazardous material
that is discovered during the sorting process is removed from the
waste stream and is properly disposed by utilizing the household
hazardous drop-off center located on our processing site.
DISPOSAL OF SPOILED OR REJECTED NON-HAZARDOUS MATERIALS
Currently approximately 15 percent of the material processed from
San Bernardino is non-recoverable and is required to be landfilled.
At this point in time. the County of Orange landfill system accepts
only county generated waste. Therefore, Taormina Industries is
currently transferring "non-recovered" material from outside Orange
County to BKK landfill in West Covina and other Los Angeles
County landfills. This has been our standard practice for a number
of years. However, the County of Orange is now reviewing the
policy of disposal of non-recoverable material generated from
"recycle processing" facilities. Within the next twelve months this
policy may change to classify this waste material as a by-product
of "in- county" processing, thus allowing for local landfill usage.
Taormina Industries is open to utilizing any sites the City of San
Bernardino would request, if any.

Taormina Industries has been in the solid waste and recycling
handling business since 1949. The company was founded by the
late Cosmo Taormina as a waste and salvage firm with two
employees servicing the City of Anaheim. Today the company
employs over 500 people, serves seven cities by exclusive
integrated waste handling contracts, and processes recyclables
from over 35 municipalities in five southern California counties.
Long-term, evergreen contracts ensure the stability of Taormina
Industries well into the 21 st century.
Taormina Industries, Inc. is a privately owned corporation
based in Anaheim, California. The owners of the company
are brothers, William. C. and Vincent C. Taormina. Both
have worked in the firm since their childhood and remain
directly involved in the operations and administration of the
company. Taormina Industries is the lareest orivatelv
owned solid waste collection and recycling firm in the
State of California.
The Material Recovery Facility (MRF) was engineered and designed
in-house by Taormina Industries to accommodate solid waste
handling and processing needs for various municipalities and
commercial haulers throughout Southern California. The facility
first opened in 1984 and currently has a permitted processing
capacity of 4,168 tons per day. Revised permits will increase the
capacity to 8,265 tons per day. Current design capacity as stated
in our State operating permit is 8,000 tons per day. The facility
was designed to accommodate residential, commercial, industrial,
landscape and public waste streams. The facility was also
designed so as to easily expand it's functions into various waste
reduction technologies such as waste-to-energy and manufacturing
plants onsite that will utilize the recovered recyclable materials.
The facility is sited on 27 acres at the junction of the 57 and 91
freeways in Anaheim, California. The processing facility for
material currently being processed from San Bernardino is over
280,000 square feet under one roof. The material recovery facility
is the lareest oermitted orocessine facility in the State of California.

5,263,591. As mentioned earlier, the Phase III development of a
full-scale regional facility for San Bernardino will replicate the
existing CVT facility in Anaheim, thus saving design and
engineering costs. Further, based on the success of the Anaheim
facility design, the San Bernardino Phase III project is assured to be
cost effective and successful.
Current processing is accomplished with a combination of infeed
processing lines feeding a series of conveyors and mechanical
sizing equipment to make various separations of the material to be
processed. Material is then recovered manually by sorters
strategically located on the sorting system and mechanically by
overhead magnets, vibrating finger screens, vibrating perforated
screens, gravity separation and overhead air vacuum collection.
All systems are fully integrated with computer controlled operation
of the speed and flow of material processed. After materials are
separated by type and size, additional processing is done to ensure
that all materials are "up-graded", thus generating the maximum
return on the materials marketed and the recoverv of material
processed. The material processing lines are designed to be
flexible for processing different flows of material simultaneously or
at different times. Redundancv has been engineered into the
system to minimize the impact of equipment failure. All materials
processed are weighed on site by state certified scales and then
credited to the actual jurisdiction by type of material processed.
Waste characterizations are up-dated regularly for all processing
customers. Highly detailed and audited monthly summaries are
computer generated in order to correctly report the actual waste
recovery percentages and value of material recovered.
William C. "Bill" Taormina, Chairman of the Board, 43. Years with
company--27. Bill is the eldest son of the company founder with a
Master's degree in Business Administration from the University of
Portland, Oregon. Like the entire Taormina family, Bill has literally
been raised in the business and is extremely knowledgeable in all
areas of operations and finance.
Vince Taormina, Chief Executive Officer, 38. Years with
Company--22. Vince is the youngest child of the company founder
and holds a degree in Business Administration from Chapman
College, California. Like the entire Taormina family, Vince has also

Dave Ault, President, 48. Years with company---10. Dave is a
graduate of the University of California at Irvine. Dave previously
worked at Disneyland for 18 years as head of the Administrative
Services Division. Dave is responsible for the entire mixture of
operations throughout the company as well as monitoring our
municipal contract relationships. Dave's ability to interpret the
goals and demands of our municipal customers has enabled him to
be a staff resource for City managers and staff in the cities we
serve.
Glenn Nygard, CPA, Corporate Finance, 43. Years with
company-oS. Glenn is a graduate of the University of Southern
California where he received his Master's degree in Accounting.
Glenn is a licensed California real estate broker and is a former
accounting professor at Cypress College.
Tom Vogt, Vice President-Facilities, 38. Years with company---S.
Tom is a graduate of California State University, Fullerton. Tom
has an extensive background in equipment maintenance and
construction management. Tom is solely responsible for setting
the framework of our current maintenance department and the
design and construction of our material recovery facilities. Tom is
also deeply involved with our special projects in development of
the company and has overall responsibility for Risk Management,

Stuart Lee, Vice President-Material Recovery and Transfer Facility,
33. Years with company--5. Stuart is a graduate of Harvard
University in Cambridge, Massachusetts and has an extensive
background in statistical analysis. Stuart was instrumental in the
development of all waste characterizations used by all cities in
Orange County as required by ABS3S, and maintains the
quantitative methods necessary to manage our material recovery
facility. Stuart's major areas of management responsibilities are

recycling market has provided him with knowledge of overseas
markets and mills which assist him in moving over 25,000 tons of
material each month to over 50 different end-users. Barry is
responsible for managing a full-time staff of commodity brokers to

Dorothy Mendenhall, Director Human Resources, 54. Years with

3. RELATED EXPERIENCE
Taormina Industries is the largest processor of co-mingled clean
recyclable material in North America. In the case of recycle
processing and marketing, "Bigger is Better." Taormina Industries'
tremendous growth in the processing and marketing of recycle
material is not by coincidence. Taormina Industries will celebrate
45 vears in the waste and recycling industry. The company has
earned the respect of the industry by doina what is riaht for our
customers. We have focused on the long-term and have reinvested

4. PROJECT SCHEDULE
Taormina Industries is currently transporting and processing
material from San Bernardino. We are fully operational and will
"step-up" our transportation and processing on any schedule that
the City of San Bernardino would select for ease of
implementation of the collection and educational programs as
outlined in Section 1. When the city approves the concept of a
"lite transfer" facility, that facility would be operational within
three to six months. The long-term concept of a regional material
processing facility would be a two to three year project. As you
can see from our proposals, Taormina Industries is able to support
anv processing tonnage and any schedule that would best work
for the City of San Bernardino.

Taormina Industries would be willing to utilize the "Official Board
Market" (OBM yellow sheet), or any other publication the City
could provide as the basis for commodity pricing for the term of
the contract to process material for the City of San Bernardino. A
number of our commercial accounts use this publication for the
base value of single recovery purchase programs. The monthly
values reflected in this publication represent the current market at
the retail value of primary recycle commodities. The downside
from this method of establishing market value is that the market
trends may greatly change from month to month, based on local
market demand. However. all of our municipal customers and the
great majority of our other city programs have chosen to utilize
the following proposed method of establishing a market value of
the actual material recovered from their respective recycling
programs.
With our volume of sales, Taormina Industries actually creates
markets and has established an internal sales value for each of
the commodities we process. A majority of our sales are based
on contracts to supply product at a fixed rate for a number of
years, in some cases up to five years. In a "hot" market our price
structure does not reflect the "peaks" of individual commodity
pricing, but has a stabilizing effect on the long-term price
structure. This is extremely important to city recycling programs
when the market turns downward. For example. less than twelve
months ago mixed paper was of no value in the Southern
California market. In most city programs mixed paper represents
upward of 20 percent of the total recovery. Because of our
long-term commitments we avoided this downward spiral in
value, while our competitors considered this material to be spoiled
or rejected waste. The result to our customers was a stabilized
rate base and no fee increases.
Taormina Industries proposes to return 80 percent of the
established commodities value to the City of San Bernardino, we
would retain 20 percent as our marketing margin. The reasons
for this 80/20 split is to create an incentive for us not only to
recover the maximum amount of material, but to also upgrade
the recovered material to achieve maximum value to both the

city and our company. With this "shared" concept. both parties
are highly motivated to achieve the highest standards in public
education for recycling and methods of recovery. This
methodology is working extremely well for over 250,000
individual homes throughout Southern California. Our approach
is verv conservative, but is of great value to cities in the
long-term administration of their residential recycling programs.

To quote a floor price is unrealistic at best, and could result in an
unfair market position for a processor. A contract should be fair
to both parties, with a reasonable operating margin for the

1. The propoeed loading and traneferring of clean, pre-eorted recyclable
materiale (i.e., newepaper, cardboard, glaee, plaetic containere, tin
cane, aluminum cane and mixed paper) uee meete the intent of, and ie
consistent with, the goale, objectives and policies of the General Plan,
in that the proposed use is consistent with the following policy ot the
Community Design Element.
"To insure that industrial areas function to their full potential and are
a positive element in the City'S environment.-
2. The proposed use meets the stated purpose and general intent of the
dietrict in which the use is proposed to be located, in that the proposed
loading and transferring of clean, pre-sorted recyclable materials use is
compatible to other uses allowed in the M-l zone such as distributing
plants and treatment of articles from previously prepared materials like
paper and plastic.
3. The proposed use does not adversely impact the public health, safety and
general welfare ot the City's residents, in that the proposed use muet
meet all 1991 Uniform Building COde, 1991 Fire Code and other City codes
prior to establishment of such use.
4. The proposed use shares characteristics common with, and will not be of
greater intensity, density or generate more environmental impact than,
those uses listed in the land use district in which it is to be located,
in that the proposed trucking facility for loading and transferring of
recyclable materials parts use is s~ilar to a distributing plant and
treatment of articles from previously prepared materials like paper and
plastic, which are permitted uees in the M-l zone.
This decieion has been based on the provisions of Section SOl-A of the City of
Pomona Zoning Ordinance. The decision of the City Planner shall be final
unless an appeal to the Planning Commission is made within ten (10) days after
the decision.

ElNQINGS
1. Description of the facility design and operation.
A. The Consolidated Volume Transporters Regional Material Recovery
and Transfer Facility is an existing large volume transfer station
owned by William C. and Vincent C. Taormina and operated by
Consolidated Volume Transporters Incorporated, CVT Recycling,
wholly owned subsidiary of Taormina Industries Incorporated.
B. The facility address is 1131 North Blue Gum Street. Anaheim, CA
92806. It occupies an 11.4 acre site and is located at the junction
of the 57 and 91 Freeways in Anaheim's East Canyon Industrial
Area. The Report of Station Information (RSI), Rgures 1-5 include a
site plan, site map, legal description of the property and aerial
views of the facility and all on-site structures, with the scale as
noted on the aerials.
C. The 'facility's physical plant consists of the Material Recovery
Facility building, a Transfer Facility building, two Material
Recovery and Processing buildings, a Corporate Offices building,
Scales and Scale houses containing automated weighing/billing
equipment. There is also a Household Hazardous Materials
Collection Center, a Public Recycling/Buy back center and a Public
Disposal area at this location.
D. The facility only accepts non-hazardous solid waste from
residential commercial and industrial sources. Inert material and
other demolition material are also accepted. No special waste is
accepted.
E The maximum load capacity of this facility is 4,168 tons per cay
and the average daily throughout over the last year was 3,000 tons
per day. Design capacity of the facility is 8,000 tons per day.
F. All traffic enters the facility from Blue Gum Street through the
main entrance which is guarded. The vehicles then take one of

several routes depending upon purpose and type of vehicle. The RSI,
Figure 2 depicts traffic patterns, access and eg ress of the facility.
G This facility conducts extensive material recovery/recycling
activities in addition to the transfer operation. The Material
Recovery Facility (MRF) processes commingled recyclables using
state-of-the-art mechanical and manual sorting systems.
The facility also diverts office paper, corrugated paper products.
green waste, wood and inert materials into reuse applications. The
RSI, Scope of Operations (pages 3-5) and Description of Processes
(pages 5-11) explain the operations in the various buildings and
areas within the facility.
Hazardous waste shall be handled in a manner approved by the Local
Enforcement Agency (LEA) and the California Integrated Waste
Management Board (CIWMB) as per Title 22, California Code of
Regulations.

H The discovery of hazardous waste in the waste stream is handled in
three ways. The small quantities of hazardous wastes from the
residential waste stream that are unidentifiable as to origin are
disposed of through a contract with the County Household Hazardous
Matfirials Collection Center. Hazardous wastes identified as to
source are returned to the source for proper disposal. The removal
of other hazardous wastes from facility operations, materials
abandoned by the public or somehow wrongfully injected into the
solid waste stream are handled utilizing private, appropriately
licensed and permitted haulers and contractors. The facility EPA
generator number is CAD981378201. In addition, signs are posted
at the facility stating the prohibition on the dumping of hazardous
waste.
The hazardous waste screening and load check programs are
described in the RSI, pages 18 & 19. Training and spill response are
described in the RSI Attachment D, Examples of Employee Training
Materials. Emergency phone numbers are listed on page 26 of the
RSI. Additional measures regarding hazardous material may be
required by the LEA or the CIWMB.
1. The major anticipated changes in the design/ operation of this
facility are listed in the RSI on page 27. The anticipated changes

processing of recyclables. Tub grinders and hammer mills may be
installed to process green, brown and construction waste. Glass
and plastic may be further processed at the facility. .. Currently
these items are separated and shipped out as is.
J. This facility's various operations occur during all or part of a 22
hour period from 4 am to 2 am seven days a week, excluding major
holidays. Essentially, the facility operates 24 hours a day. The RSI,
pages 13 & 14, list the precise hours for each operation.

Anaheim General Plan. (Resolution 83R-127).
4. The design and operation of this. facility are in compliance with the
State Minimum Standards for Solid Waste Handling and Disposal as
determined by the LEA in November, 1992.
5. The Anaheim City Council has made a written finding that surrounding
land use is compatible with the facility operation.
6. Negative Declarations 2398, 3266 & 3359 and Notices of Determination

CONDITIONS
Reauirements
1. This facility must comply with the State Minimum Standards for Solid
Waste Handling and Disposal.

2. This facility must comply with all federal, state, and local
requirements and enactments including all mitigation measures given
in any certified environmental documents filed pursuant to PRC Section
21081.6.
3. Additional information concerning this facility must be provided if
required by the LEA.
4. The operator must comply with all notices and orders issued by any
enforcement agency to monitor the mitigation measures contained in
any of the documents referenced within this permit pursuant to PRC
Section 21081.6.
5. The operator shall maintain a copy of this Permit at the facility so as
to be available at all times to facility and enfqrcement agency
personnel.
Prohibitions
The following actions are prohibited at this facility:

4. Acceptance of sewage sludge or septic tank pumpings.
Soecifications
1. No significant change in the design or operation of the facility, as
stipulated in the FINDINGS section of this permit is allowed without a
revision of this permit.
2. This facility has a permitted daily capacity of 4168 tons of solid.
waste per operating day. It shall not receive more than 4168 tons per
day unless the operator first obtains a revision of this permit.
3. A change of operators of this facility will require a new permit.
4. The enforcement agency, through the permit, may prohibit or condition
the handling or disposal of solid wastes to protect the public health
and safety, protect. rehabilitate, or enhance the environment. or to
mitigate adverse environmental impacts.
5. This revision of the Permit supersedes the permit originally issued on
March 15, 1990.

1. This permit is subject to review and may be suspended, revoked, or
modified at any time for sufficient cause.
2. A copy of the most recent printing of the State Minimum Standards for
Solid Waste Handling and Disposal, and a copy of this and all other
permits issued for the operation of this facility must be kept at the
site. These documents must be available for review by authorized
representatives of the LEA or the CIWMB.
3. A copy of the most recent inspection report resulting from an
inspection of the facility by representatives of the LEA must be
maintained at the site.
') 4. Appropriate safety equipment including hard hats, hearing protection
and safety goggles shall be available to all persons working within the

facility and must be used when appropriate. Workers hand picking
salvageable items shall be required to wear heavy duty gloves.
Self-Monitori no:
1. A quarterly monitoring report is to be submitted to the LEA. The report
shall contain. daily totals of tonnage and vehicles using the facility and
summarized by month.
2. The results of the hazardous waste screening program shall also be
included in the monitoring report.
3. A log of special occurrences, (fires, explosions, accidents, hazardous
wastes, etc.), shall be maintained and reported to the LEA on a
quarterly basis, in accordance with the monitoring report schedule.
4. The monitoring report shall be submitted to the LEA in accordance with
the following schedule.

The City Council reviews the action of the Planning Commission on all
petitions. Twenty-two (22) days following the resolution of the Commission,its
decision will become final and effective, unless during that time you or an
opponent file an appeal to the Council in writing or the Council elects to hold
an additional public hearing on the petition. All appeals must be filed in
writing with the City Clerk. Within sixty (6D) days following the receipt of
an appeal, a date for public hearing before the Council will be set by the City
Clerk and an advertised public hearing ~ill be held. The decision of the
COuncil, approving or disapproving the Action of the COmmission at any public
hearing held by the Council on appealed petitions, will be forwarded to you and

Rc: Protest of Recycling Contract Award Process
Dear Mr. Merrill:
I am writing this letter to formally protest the Cities contract award of the City of San
Bernardino's commingle recyclables processing contract. It was very disturbing to learn of
the recent turn of events which have transpired since the bidding process began in October
1994.
According to an article in 'The Sun' dated Tuesday, March 2, 1995, the City has
apparently made the decision to award this contract to Taormina Industries, even though
they are not the lowest bidder. According to the article, this decision was based on the
fact that Jack's Disposal (the lowest bidder) had informed the City of their intent to
withdraw their bid due to the revised term of the contract (from 5 years to 2 years).
City Staff and Council never toured CR&R's facilities or requested further information as
they had obviously done with Taorimina Industries. CR&R was not notified ofJacks'
Disposals' withdrawl or the City Council meeting even though we have been part of the
process since day 0ne. Again, obviously Taormina Industries was completely uprla~ed due
to their attendance at the City Council meeting.
As a leader in the recyclables collecting, processing, and marketing industry, CR&R was
shocked to learn of the level of which council member Ralph Hernandez, William
Taormina, and Gil Lara became involved during the contract awarding process. I am at a
loss as to why CR&R was specifically instructed by yourself on several occasion not to
contact the City directly during this process but to wait for the City to update us as to the
status of the process of which CR&R never received any written response or update.
Further, we intend to investigate in detail the relationship between Gil Lara and Ralph
Hernandez. In my opinion, this relationship played a major roll in the awarding of this

instructions, we would have been awarded the contract. I am requesting a formal
response as to why CR&R should not seek legal help to ensure an equal and fair
opportunity to obtain this contract.
