STAFF REPORT
The San Bernardino Spirit Baseball Team is requesting approval of a low-level fireworks
display at Fiscalini Field on the Fourth of July. The Spirit will be playing a home
game on that date and a fireworks display will enhance the game as well as provide
additional revenue to the team and City through the lease agreement.
The Spirit Baseball Team is proposing a low-level display in order to minimize any
potential fire hazards and will comply with all Fire Department requirements including
an engine company on standby and a fire marshall on site during the show. The Spirit
will bear all costs associated with the Fire Department inspection and standby.
Further, the Spirit will provide additional security measures to prevent unauthorized
use of fireworks in the parking lot areas. Only seated ticket holders will be allowed
to view the show inside the stadium as California League regulations prohibit fan seatin~
in the field areas during fireworks displays.

there have been problems in the past in FiNealini Field in1'eiiudsio tl1e distance of the
fans from the tiring area for the fireworks. This problem 'w.illn,,?~1,9nger be an issue
because of new California League rules prohibiting ~ans .froni' entering the field of play at

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SUBSECTION
C TO SECTION 8.60.120 OF THE SAN BERNARDINO MUNICIPAL CODE
RELATING TO FIREWORKS IN HIGH FIRE AREAS IN THE 1995 SEASON.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION 1. Subsection C is hereby added to Section 8.60.120
of the San Bernardino Municipal Code to read as follows:
"C. Notwithstanding subsection B, and for the 1995
season only, fireworks may be discharged in the areas
described in subsection B, but only if a permit is
issued by the San Bernardino Fire Department pursuant
to Health and Safety Code Section 12640( c) and 19
California Code of Regulations Section 982 et. seq."
SECTION 2. This ordinance expires on December 31, 1995, and
thereafter shall be of no further force and effect.
SECTION 3.
This is an urgency ordinance that will take
effect immediately upon its enactment. The facts establishing the
18 urgency are that the controlled use of fireworks at a major
19 location of public assembly will greatly limit the private and
20 individual use of such fireworks in areas that are high fire
21 danger, and will therefore protect the public health, safety and
22 welfare.
