2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE
O. 3974 ENTITLED IN PART "ORDINANCE . . . ADOPTING THE UNIFORM
3 BUILDING CODE, 1979 EDITION . . .", AND THE APPROPRIATE SECTION OF
THE SAN BERNARDINO MUNICIPAL CODE; AMENDING SECTION 1704 OF THE
4 UNIFORM BUILDING CODE RELATING TO ROOF COVERINGS; REPEALING
SECTION 8.63.110 OF THE SAN BERNARDINO MUNICIPAL CODE; AND
5 DECLARING THE URGENCY THEREOF.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:

SECTION 1. Finding.
9 Pursuant to California Health and Safety Code Sections
10 17958.5 and 17958.7, the Mayor and Common Council of the City of
11 San Bernardino find that certain changes and modifications in the
12 provisions of state building standards are necessary because of
13 local conditions. The changes and modifications relate to Section
14 1704 of the Uniform Building Code, 1979 Edition, and are set forth
15 in Section 2 of this ordinance. The local conditions which
16 necessitate the changes are the low humidity climatic conditions,
17 the extremely high wind conditions which periodically occur and
18 the proximity of development to brush covered areas. The history
19 of local fires, including the disastrous fires of November, 1980,
20 demonstrate the danger and provide evidence of the need for the
21 changes and modifications.

SECTION 2. Amendment of Certain Provisions.
23 Ordinance No. 3974 Section 3 and the appropriate section of
24 the San Bernardino Municipal Code are amended by amending Section
25 1704 of the Uniform Building Code, 1979 Edition, to read:

"Section 1704. Roof coverings shall be fire retardant, with
27 the following exceptions:

(a) Ordinary roof covering may be installed on buildings

of Group R and Group M Occupancies except that wood roof covering
2 shall have a minimum of a Class C rating for these occupancies.
3 (bl In the high fire hazard area as defined in Section
4 8.63.130 of the San Bernardino Municipal Code, no new wood roof
5 covering shall be installed, except for repairs to wood roofs not
6 exceeding 25% of the existing roof area. Such repairs shall be
7 with materials with minimum Class C rating for Group R and Group M
8 Occupancies and Class B for all other occupancies.
9 Skylights shall be constructed as required in Chapter 34.
10 Penthouses shall be constructed as required in Chapter 36.

]4 SECTION 3. Repeal of Certain Provisions.
]5 Section 8.63.110 of the San Bernardino Municipal Code is
]6 repealed.
]7 SECTION 4. Urgency.
]8 This ordinance is an emergency and urgency measure necessary
]9 for the immediate preservation of the public peace, health or
20 safety and shall go into effect immediately upon its adoption and
2] approval. The facts constituting such emergency are:
22 (al low humidity climatic conditions, extremely high wind
23 condicions which periodically occur, and the proximity of
24 development to brush covered areas.
25 (bl the history of local fires, including the disastrous
26 fires of November, 1980, demonstrate the danger to life and
27 property.
