ORDIN.ANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION
8.60.120 OF THE SAN BERNARDINO MUNICIPAL CODE TO CLARIFY THE HIGH
FIRE HAZARD AREA, AND DECLARING THE URGENCY THEREOF.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN. AS FOLLOWS:

SECTION 1. Section 8.60.120 of the San Bernardino Municipal
7 Code is amended to read:

"8.60.120 Permissible locations for discharge.
9
A. The use of fireworks in the City shall be limited to
10 private property except as otherwise provided in this chapter. No
11 fireworks shall be discharged on public, semipublic or private
12 open areas such as parking lots, vacant properties, or in a public
13 street or right-of-way, except in public parks and those areas
14 approved by the chief engineer of the fire department.

B. No fireworks shall be discharged in the high fire hazard
16 area described in Section 8.63.130 and within the area bounded by
17
Highland Avenue, Del Rosa Avenue, Pacific Street and Perris Hill
18
Drive, commonly known as Perris Hill."

SECTION 2.
This ordinance is an urgency measure necessary

Ifor the immediate preservation of the public peace, health or

safety and shall go into effect immediately upon its adoption and
22 approval. The facts constituting such emergency are:
23 San Bernardino Municipal Code Section 8.60.120, relating to
24 fireworks, contains an obsolete description of the boundaries of
25 the high fire hazard area. The description has been kept current
26 in Section 8.63.130. For the protection of life and property, it
27 is urgent that the high fire hazard area as described in Section
28 8.60.120 be revised prior to the commencement of fireworks sales
