AN ORDINANCE OF THE CITY OF SAN BERNARDINO
APPROVING THE FORMAL ACT OF ENTERING INTO
A LEASE WITH THE REDEVELOPMENT AGENCY OF
THE CITY OF SAN BERNARDINO
The Mayor and Common Council of the City of San
Bernardino do ordain as follows:
Section 1. Lease Approval. The act of entering
into a formal lease agreement by and between the City of San
Bernardino and the Redevelopment Agency of the City of San
Bernardino, which agreement is a "public leaseback" as that
term is defined by Government Code ~54240(b), is hereby
approved. A copy of the lease dated as of January 1, 1982,
enti tled "Public Facilities Lease" (hereinafter "Lease"), is
on file with the City Clerk of the City, it being the intent
that the lease state the purpose thereof and the maximum
obligation to be undertaken by the City and that it be
suitably amended as necessary in accordance with the neces-
sities of financing.
Section 2. Effective Date, Referendum. This
Ordinance is an urgency measure and is adopted on the day of
its introduction. The facts constituting such urgency are
that the Lease relates to a fire station and public parking
facilities. The fire station is essential to the public
safety of the citizens of the City, and the immediacy arises
because the lowest bid for the construction thereof is an

excellent bid and must be accepted promptly or the oppor-
tunity to have the fire station constructed at such a
favorable price may be lost. The financing of the parking
facilities fits in with the financing of the fire station so
that, from a financial viewpoint, both must be financed.
For these reasons it is necessary for the immediate preser-
vation of the public health that the Ordinance be adopted on
the day of its introduction as an urgency measure under the
City Charter, subject, however, to the referendum require-
ments of Government Code Sections 54240 to 54245, inclusive.
The City Clerk shall cause this Ordinance to be
published as provided in the City Charter and this Ordinance
shall take effect on the thirty-first (31st) day after its
approval of the Mayor.
I HEREBY CERTIFY that the foregoing Ordinance was
duly adopted by the Mayor and Common Council of the City of
San Bernardino at a regular meeting thereof, held on the
7th day of December ,1981, by the following vote, to
wit:
