ORDINANCE OF THE CITY OF SAN BERNARDINO A~lliNDING CHAPTER
18.20 OF THE SAN BERNARDINO MUNICIPAL CODE TO MAKE ALL DECISIONS
CONCERNING TENTATIVE TRACT ~~PS FINAL UPON APPROVAL OF THE PLANNING
CO~~ISSION, SUBJECT TO APPEAL TO THE MAYOR AND CO~10N COUNCIL.
THE MAYOR AND CO.~JON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION 1. section 18.20.090 of the San Bernardino
1unicipal Code is amended to read:
"18.20.090 Acceptance of tract maps.
The map and application shall be considered filed when
che office of the Planning Department has notified the applicant
'n writing that the application is complete. The Planning
ommission shall take action at a public hearing within forty-
ive days after the filing of the application."
SECTION 2. Section 18.20.100 of the San Bernardino
Junicipal Code is amended to read:
"18.20.100 Basis for Commission decision.
The Commission decision shall be based on conformity of
he tentative map with this title, with other applicable ordinances
nd the quality of the design of the subdivision. The Commission
hall not approve a map unless it has found that the proposed
ubdivision, together with the provisions for its design and
mprovement, is consistent with the General Plan required by
rticle 5 (commencing with Section 65300) of Chapter 3 of
J ivision 1 of the Government Code. The Commission shall deny
he tentative map if it makes any of the following findings:
hat the proposed map or the design of improvement of the proposed
ubdivision is not consistent with applicable general and
pecific plans; that the site is not physically suitable for

the type of development or density of development; that the
design of the subdivision or the proposed improvements are likely
to cause substantial environmental damage or substantially and
avoidably injure fish or wildlife or their habitat, or is likely
to cause serious public health problems; or that the design of
the subdivision or the type of improvements will conflict with
easements acquired by the public at large for access through or
use of the property within the proposed subdivision."
SECTION 3. Section 18.20.110 of the San Bernardino
Municipal Code is amended to read:
"18.20.110 Discharge of waste in violation of requirements.
The Commission shall also determine whether the discharge
of waste from the proposed subdivision into the existing community
sewer system would result in violation of existing requirements
prescribed by the California Regional Water Quality Control Board,
Santa Ana Region, pursuant to Division 7 (commencing with Section
13000) of the Water Code. In the event the Commission finds that
the proposed waste discharge would result in or add to violation
of requirements of such board, it may disapprove the tentative
map or maps of the subdivision."
SECTION 4. Section 18.20.120 of the San Bernardino
Municipal Code is amended to read:
"18.20.120 Disapproval of map - Reasons to subdivider.
If the Commission disapproves the tentative tract map, the
subdivider shall be furnished with the statement of the reasons fo
such recommendation. If the Commission grants conditional
approval, the subdivider shall be furnished with a complete
statement of the proposed conditions of approval."

committee, the filing fee less a processing fee in the amount of
twenty-five dollars shall be refunded to the subdivider. If the
request is made subsequent to the preparation, there shall be no
refund. "
SECTION 9. Section 18.20.170 of the San Bernardino
Municipal Code is amended to read:
"18.20.170 Unincorporated territory.
A. A tentative map may be filed for property located out-
side the boundaries of the City. Said map may, in the discretion
of the Commission, be acted upon in the manner prescribed by this
title, except that if it is approved, such approval shall be
conditioned upon annexation of the property to the City within suc
period of time as shall be specified by the Commission.
B. No final map shall be approved until annexation of the
property to the City has been completed. If annexation is not
completed within the time specified or any extension thereof grante
by the Commission, the tentative map shall expire and the approval
f such map shall be null and void."
