TO THE SAN BERNARDINO MUNICIPAL CODE BY AMENDING AND CODIFYING
3 ORDINANCE NO. 3873 RELATING TO THE PLANNED LOCAL DRAINAGE
FACILITIES FUND.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:

"Chapter 3.38
PLANNED LOCAL DRAINAGE FACILITIES FUND
3.38.010 Need for facilities.
11 The need for additional drainage facilities throughout the
]2 City of San Bernardino has been clearly demonstrated in
13 Comprehensive Storm Drain Plan Nos. 3, 4, 6 and 7 prepared for
14 Zones 2 and 3 of the San Bernardino County Flood Control District,
15 copies of which are on file in the office of the City Clerk of the
16 ci ty of San Bernardino.

3.38.020 Adoption of drainage plan.
18 The entire City of San Bernardino is hereby designated to be
19 single local drainage area, and Comprehensive Storm Drain Plan
20 Nos. 3, 4, 6 and 7 of the San Bernardino County Flood Control
21 District are hereby adopted as the drainage plan for the City of
22 San Bernardino.

3.38.030 Fund established.
The Planned Local Drainage Facilities Fund is hereby
25 established. The Planned Local Drainage Facilities Fund is deemed
26 to be the fund provided for in Section 66483 of the Subdivision
27 ap Act of the State of California. Monies in said fund shall be
28 expended solely for the design and construction of local drainage

1 I facilities within the City.
2 I 3.38.040 Drainage fee.
3 There is hereby imposed a drainage fee on all land
4 development within the City. The amount and payment schedule for
5 said fee shall be established by resolution of the Common Council.
6 All drainage fees collected shall be deposited in the Planned
7 Local Drainage Facilities Fund.

3.38.050 Disposition of certain funds.
9 All monies in the Planned Local Drainage Facilities Fund not
10 immediately required for construction purposes shall be invested
]1 in a manner provided by law in the State of California and all
12 interest paid for such investment shall accrue to said fund.

3.38.060 Credit to subdividers.
14 For any development for which drainage facilities in excess
15 of a 30" diameter storm drain are required as a condition of
16 approval, a nontransferable credit shall be granted against
17 drainage fees due when a building permit is sought by that
18 developer for any parcel or parcels in that tract, limited to the
19 difference between one-half the construction cost of 60" RCP and
20 one-hal f the construction cost of 30" RCP. size in excess of 30"
21 being determined to be for the benefit of property not within the
22 subdivision. Such credits shall be available only to developer,
23 and only upon request of developer at the time such fees are
24 payable."
