TO THE SAN BERNARDINO ~lUNICIPAL CODE. TO CREATE A COM11UNITY

ORDAIN AS FOLLOWS:

SECTION 1. Chapter 2.42 is added to the San Bernardino
7 Municipal Code to read as follows:
8 "COMMUNITY TELEVISION Cot1MISSION

2.42.010 Creation.
10 There is created and established a Community Television
11 Commission, consisting of nine members who are users of cable
12 television within the City. The Mayor and Common Council declare
J3 that the individuals appointed to the Commission are intended to
J4 represent and further the interests of consumers of cab' '?
J5 television services and to serve the public interests.

2.42.020 Nomination - Terms.
17 Each Council member shall nominate one Commission member who
J8 shall serve during and for the term of the nominating Council
]9 member. The Mayor shall nominate two members who shall serve
20 during and for the term of the Mayor. The terms of Commission
2] members shall coincide with the term of the nominating Council
22 member or ~layor. provided that when a vacancy shall occur in the
23 office of a Council member or the Mayor, the applicable term of
24 the member of the Commission shall continue until a successor has
25 been appointed by the Mayor upon nomination by the Council
26 menber or Mayor elected to fill such vacancy.

2.42.030 Appointment - Residency requirement.

Each member of the Commission. after having been nominated.

1 shall be appointed by the Mayor, subject to the approval of the

Common Council,
Each member shall be and remain a local elector,
3 and each Commission member nominated by a Council member shall be
4 a resident of the ward of such Council member during the term of
5 appointment. Members shall serve, without compensation, at the
6
pleasure of the Mayor and COMnon Council.
Subsequent vacancies
7 shall be filled and appointments shall be made in the manner
8
hereinbefore
set forth.

2.42.040 Chairman
Meetings - Absences.

The Commission shall elect a Chairman from among its

11 members, and the Chairman shall serve for a term of one year. The
12 Commission shall meet not less than once a month in the Council
13 Chambers, City Hall, San Bernardino, California, or such other
14 place as the Commission may select.

B.
If a member of the Commission fails to attend three
]6 consecutive regular meetings without notice to the Chairman prior
17 to each of said consecutive meetings, he shall automatically cease
18 to be a member of the Commission, and his vacant office shall be
19 filled by an appointment made for the unexpired term in the manner
20 of the original appointment.

Each meeting of the Commission shall be open to the

22 public and shall be governed by the provisions of the Ralph M.
23 Brown Act, Sections 54950.5, et seq., California Government Code.

2.42.050 Responsibilities.

The Commission shall:

Prescribe such rules and regulations as it deems
27 necessary or expedient for the administration of its duties,
28 including a procedure for complaint resolution, subject to

1 approval by the Mayor and Common Council.

Review all City franchises. ordinances. resolutions. and

3 procedures relating to cable television service, and make
4 recomraendations to the Mayor and Common Council regarding
5 amendment or revision of ordinances or procedures or the adoption
6 of any new rules or regulations relating to services provided by
7 cable television companies.

Review and make reconwendations to the Mayor and Common

9 Council on requested rate increases. Establish criteria for
10 determining whether or not rate changes should be recommended.
]1 Recomrnend changes designed to afford all users within the City
]2 comparable service at comparable cost.

D.
Investigate, hear and resolve complaints regarding
]4 community cable television services and non-compliance with
15 applicable ordinances and law.

E.
Study developments in cable television technology to
]7 determine whether and when to recommend that service to the San
18 Bernardino cor.ununi ty should be expanded or improved.
19
F.
Establish criteria for the solicitation and granting of
20 additional franchises for providing service within the City.

Recommend action to be taken by the Mayor and Common
G.
22 Council in regard to state or federal administrative and
23 legislative action. including but not limited to applications,
24 licensing. studies, and legislative enactments.

Upon request. maintain the confidentiality of business

26 documents and information which are not public records, and the
27 same shall not become public records by reason of disclosure to
28 the Commission."
