ORDINANCE OF THE CITY OF SAN BERNARDINO CALLING A SPECIAL
EL.~CTION TO BE HELD IN THE FOURTH WARD OF SAID CITY ON TUESDAY,
Till:: SECOND DAY OF NOVEMBER, 1982, FOR THE PURPOSE OF FILLING A
VACANCY IN THE COMMON COUNCIL REPRESENTING THE FOURTH WARD,
REQUESTING THE BOARD OF SUPERVISORS TO CONSOLIDATE THE SPECIAL
MUNICIPAL ELECTION WITH THE STATEWIDE GENERAL ELECTION OF NOVEMBER
2, 1982, AND SHORTENING THE TIME FOR FILING OF NOMINATION
DOCUMENTS. (URGENCY)

SECTION 1. Recitals.

(a) Ann Botts, member of the Common Council representing the
10 Fourth Ward, has resigned from the Common Council.

(b) The Mayor and Common Council of the City of San
12 Bernardino desire to call a special election for the purpose of
13 filling the vacancy in the Fourth Ward created by said
14 resignation, and desire to have the special election consolidated
15 with the Statewide General Election to be held November 2, 1982.

(c) To etfect such "0r.,:;olidation, it is necessary that the
17 tiue tor fil i.ng of nomination documents under Elections Code
18 Section 23302.5 be shortened, as authorized by Section 14-A of the
19 City Charter.

SECTION 2. Special MunicipaL ~12~Lion. A special election
21 lis called in the Fourt,h Ward of the City of San Bernardino to be
22 hela on Tuesday, the second day of November, 1982, for the purpose
23 of electing a member of the Common Council in and for the Fourth
24 Ward of the City of San Bernardino to fill the unexpired term
25 ending on the first Monday in June, 1985. The person receiving
26 the highest number of votes at said election shall be declared
27 elected to fill the vacancy in the Fourth Ward.

SECTION 3. Consolidation with Statewide General Election.

1 The Mayor and Common Council of the City of San Bernardino request
2 that the_Board of Supervisors of U1e County of San Bernardino
3 consolidate the special municipal election called hereby with the
4 Statewide General Election to be held November 2, 1982, and reques
5 that the County Board of Supervisors direct that, in the Fourth
6 Ward of the City of San Bernardino, the precincts, polling places
7 and election officers for the two elections be the same; that the
8 Board of Supervisors of the County of San Bernardino canvass the
9 returns of the City election; and that the Statewide General
10 Election and the special municipal election be held in all
Jl respects as if there were only one election.
]2 SECTION 4. Time for Filing of Nomination Documents.
]3 Pursuant to the authority of Section 14-A of the City Charter, the
14 provisions of Elections Code 23302.5 relative to the time for
]5 filing of nomination documents shall be changed to the effect that
16 the period for the filing of nomination documents by candidates
]7 seeking election to the Common Council to fill the vacancy in the
]8 Fourth Ward shall commence on the date of adoption of this
19 ordinance, and nomination documents shall be filed not later than
20 five p.m. on the 88th day prior to the special municipal election
21 in the Office of the City Clerk of the City of San Bernardino,
22 during regular office hours. The City Clerk is authorized and
23 directed to make such nominating papers available to candidates
24 seeking election to the Common Council to fill such vacancy who
25 reside within the boundaries of the Fourth Ward as established by
26 San Bernardino Municipal Code Section 1.16.050, and the City Clerk
27 shall accept completed nomination papers from candidates for such
28 vacancy who reside within the boundaries of the Fourth Ward as so

established.

Elec.tion Procedures and Time Limits. The
SECTION 5.
3 election is hereby called in accordance with and under and
4 pursuant to the Cha[;c'~ .:>f the ctc.y, and will be conducted in
5 accordance with the provisions of the Elections Code of the State
6 of California, except as herein otherwise specifically provided.

SECTION 6. Urgency Matter. The passage of this ordinance is
8 an urgency matter relating to elections, and said ordinance shall
9 be in force and take effect immediately after its passage.
