ORDINANCE NO. MC-194
ORDINANCE OF THE CITY OF S^N BERNARDINO N1ENDING SECTION
5.04.030 OF THE SAN BERNARDINO MUNICIPAL CODE TO PROVIDE THAT
DISHONOR OF INSTRUMENTS SHALL CAUSE LICENSE ISSUED THEREFOR TO
BE VOID FROM INCEPTION AND THAT PAYMENT FOR LICENSE FEES MUST
THEREAFTER BE BY CASHIER'S CHECK, MONEY ORDER OR CASH.
THE MAYOR AND Cm'.MCN COuNCIL OF THE CI'I'Y OF SAN BERNARDIN
DO ORDAIN AS FOLlOWS:
SECTION 1. Section 5.04.030 Subsection A is hereby
amended to read:
"A. All license fees shall be paid in advance in legal
currency of the United States at the office of the City Clerk, or
by check, draft or other instrument in the discretion of the City
Clerk. Any license, the fee for which has been paid by an instru
ment such as a check, draft or money order which is dishonored
upon presentation for payment, shall be void and of no effect froc
its inception, upon notice from the City Clerk of such dishonor.
The City Clerk may, in his or her discretion, withhold the effec
of this provision if the fee is promptly paid. Payment of licens
fees following a dishonor of such an instrument upon presentment
for payment shall thereafter be made only by cashier's check,
mon~y order or cash, which fee shall include any applicable
penalty, as well as the service fee under Section 3.10.010 for
such dishonored instrument. The City Clerk shall be authorized
to reject payment other than by cash, cashier's check or money
order from such licensee for a period of two years following any
such dishonor.
