2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER 2.04
OF THE SAN BERNARDINO MUNICIPAL CODE TO ESTABLISH THE PERSONNEL
3 DEPARTMENT, PROVIDE THAT THE PERSONNEL DIRECTOR MAY SERVE AS CIVIL
SERVICE CHIEF EXAMINER IF APPOINTED BY THE CIVIL SERVICE BOARD,
4 ADDING THE FUNCTIONS OF LABOR RELATIONS AND EQUAL EMPLOYMENT
OPPORTUNITY/AFFIRMATIVE ACTION AND DELETING THE ADMINISTRATION OF
5 THE WORKER'S COMPENSATION PROGRAM, PAYROLL, AND SAFETY PROGRAM FRO~
THE DUTIES OF THE PERSONNEL DIRECTOR.

7 ORDAIN AS FOLLOWS:

SECTION 1. Chapter 2.04 of the San Bernardino Municipal Code
9 is hereby amended to read:
10 "Chapter 2.04
II PERSONNEL DEPARTMENT

2.04.010 Department established.
13
A Personnel Department is established which shall be
14 administered by a Personnel Director. The position of Personnel
15 Director shall be filled by appointment of the Mayor with the
]6 approval of the Common Council.

2.04.020 Civil service responsibilities.
18 The civil Service Board may, but is not required to, appoint
19 the Personnel Director or an employee within the Personnel
20 Department as the Chief Examiner and Secretary of the Board. The
21 Board may appoint such subordinates to serve under the Chief
22 Examiner as the Mayor and Co~non Council prescribe from among the
23 employees in the Personnel Department. The Chief Examiner and
24 subordinates appointed by the Civil Service Board shall perform
25 civil service duties specified by the City Charter and prescribed
26 in the Civil Service Rules or assigned by the Civil Service Board,
27 and additional personnel functions in the Personnel Department,
28 under the supervision of the Personnel Director. Nothing herein

shall be construed to require the Civil Service Board to appoint a

particular person to the position of Chief Examiner or a

subordinate position contrary to the provisions of Section 247 of
4
the Charter.

2.04.030 Functions and responsibilities.
6 The Personnel Director shall, under the supervision and
7 direction of the City Administrator, have charge of the personnel
8 program of the City, except functions relating to personnel in the
9 Municipal Water Department and the Free Public Library, and except
10 as the Charter may otherwise provide. The Personnel Director
11 shall perform the following functions:

A. Administer the position classification plan and make
13 recommendations to the City Administrator for changes in
14 classifications where warranted.

B. Administer the wage and salary schedules or plans
16 established by the Mayor and Common Council and make
17 recommendations to the City Administrator for changes in
18 accordance with accepted standards of wage setting.
19
C. Develop and administer systematic evaluation of
20 employees' performance during and after probation.
21
D. Develop plans with department heads for the training and
22 efficient utilization of employees and conduct studies as a basis
23 for improvement of in-service practices and procedures.
24
E. .1aintain records of turnover, absences and other indices
25 of the effectiveness of personnel administration and recommend
26 ethods of improving the personnel program.

F. Maintain personnel records of all City employees.

G. Administer employee insurance programs and contracts and

the contract with the Public Employees' Retirement System.
H. Review all personnel action forms for co~pliance with
City ordinances, resolutions and orders related thereto.
2.04.040 Equal employment opportunity and affirmative
action.
Programs for maintenance of equal employment opportunity in
the City jurisdiction, as achieved through an affirmative action
plan or other means, shall be a function within the Personnel
Department. Direction and coordination of programs to assure
compliance with applicable state and federal laws shall be
directed by an Affirmative Action Officer. The Affirmative Action
Officer shall perform those duties set forth in the Affirmative
Action Plan for equal employment opportunity adopted by the Mayor
and Common Council and such other duties as are assigned by the
Mayor or the Mayor and Common Council.
2.04.050 Labor-management relations.
Administration of a comprehensive labor and management
relations program shall be a function within the Personnel
Department. Administration of the program may be by or coordinate
with the person, or authorized representative, designated by
resolution of the Mayor and Common Council as the City's
representative in matters of employer-employee relations pursuant,
to Section 12 of Resolution No. 10584, as amended, and Government
Code Sections 3500, et seq., or any superceding resolution or law.
The labor-management relations program shall include the
administration of the provisions of Section 186 of the City
Charter for fixing salaries, classifications, and working
conditions of employees in the Police and Fire Departments and

such other duties as are assigned."
