HomeMy WebLinkAboutMC-227 -~ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ..~..~:.. ~ : ORDINANCE NO. ~-i~r._ 2,:;",' UlWINANCE OF THE CITY OF SA;, flEI{NARDINO A2'IENDING SECTIONS 5.04.17S AND 5.04.370 OF THE SAN BERNARDINO MUNICIPAL CODE TO PROVIDE THAT RODEOS AND CARNIVALS SHALL BE INCLUDED AMONG THE CJ\TEGORlES OF EXHIBITIONS REQUIRED TO HAVE A BUSINESS LICENSE AND REQUIRED TO OBTAIN APPROVAL OF THE ~\AYOR AND COMi'lON COUNCIL PRIOR TO GRANTING OF A BUSINESS LICENSE, PROVIDING FOR AN ANNUAL LICENSE FOR SUCH BUSINESSES, AND SPECIFYING ADDITIONAL FOOD AND CONFECTION SALES REQUIRING BUSINESS LICENses. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1. Section 5.04.175 of the San Bernardino Municipal Code is amended to read: "5.04.175 Circus, rodeo, carnival, or other exhibition. A. Every person, firm or corporation conducting, managing or carrying on a circus, rodeo or other similar exhibition with a seating capacity of more than four thousand persons shall pay two hundred dollars per day. B. Every person, firm or corporation conducting, managing or carrying on a circus, rodeo or other similar exhibition having a seating capacity of four thousand persons or less shall pay one hundred dollars per day. C. Every person, firm or corporation conducting or "wnaCJing a circus procession or circus parade, and not having a license for conducting, managing or carrying on a circus within the limits of the City shall pay two hundred dollars for each such procession or parade. D. Every person, firm or corporation conducting, managing or CoL ryinlj on a carnival at which food booths, entertainment rides, midway attractions, and similar undertakings are conducted, except nonprofit or charitable organizations conducting such enterprises wi~hout a commercial operator, shall pay twenty-five dollars per ~. -. In addition, the carnival operator shall be responsible for and shall tender the established fees for all individual food booths, rides, midway attractions and other concessions to be operated under licensee's jurisdiction. Such fees shall be tendered at the time payment for the carnival license is sought, except that, where an annual license has been obtained, fees for such individual operations shall be paid by the carnival operator prior to the opening of each event. E. Any applicant for a license under this section shall first file a written application therefor setting forth the following: 1. A description of the place or property, including the name and address of its owner, where such business is to be conducted; if an annual license is sought for use in various locations, each separate event shall be subject to review by the Mayor and Common Council as to appropriate location; 2. The names and addresses of the owners or operators of the business; 3. The approval of the Chief of Police, unless an annual license has previously been approved in the current year. Upon the filing of such application with the City Clerk, it shall be presented to the Mayor and Common Council for consideration. If the Mayor and Common Council are satisfied as to the moral character and integrity of the applicant, and that the site proposed is properly zoned and suitable for such purpose, they may grant approval of the license applied for, under such conditions as they deem appropriate. The revenue provisions of this section, but not the regulatory provisions thereof, shall apply to activities conducted during the annual citrus fair held under the auspices of the National Orange Show on its showgrounds," SECTION 2. Section 5.04.370 of the San Bernardino Municipal Code is amended to read: "5.04.370 Seller from booth or stand - Peddler - Flags, banners, balloons, toys, foods and confections. For every person, firm or corporation engaged in carrying on the business of a seller from a booth or stand, or a peddler who sells or offers for sale flags, banners, balloons, canes, horns, trumpets, musical or noise-making instruments of any kind, toys, badges, buttons, shoestrings, hairpins, lead pencils, combs, similar trinkets and items, souvenirs of any kind, hot dogs, hamburgers, tacos, burritos, soft drinks, ice cream, ice milk, popcorn, cotton candy, candy apples, snow cones, and any similar food or confection, or any combination thereof, the license fee is t\lO dollars per day. A person licensed to sell ice cream or ice milk products from a vehicle or a cart under Section 5.04.375 shall be exempt from the fees imposed in this section."
