ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTIONS
13.28.010, 13.28.020, 13.28.030, AND 13.28.060 OF THE SAN
BERNARDINO MUNICIPAL CODE TO PROVIDE FOR COLLECTION ON TAX BILLS
OF DELINQUENT WATER OR OTHER MUNICIPAL UTILITY CHARGES IN ADDITION
TO RUBBISH AND SEWER CHARGES.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:

SECTION 1. The Title of Chapter 13.28 of the San Bernardino
8 Municipal Code is amended to read:
9 "Chapter 13.28
10 COLLECTION OF DELINQUENT WATER, RUBBISH,
11 SEWER OR OTHER MUNICIPAL UTILITY CHARGES"

SECTION 2. Section 13.28.010 of the San Bernardino Municipal
13 Code is amended to read:

"13.28.010 Collection of water, sanitation, sewer or other
15 utility charges pursuant to State statute.
16 The City hereby elects to avail itself of the provisions of
17 Article 4 of Chapter 6 of Part 3 of Division 5 of the California
18 Health and Safety Code, Section 5470, et seg., which set forth an
19 alternative method of collecting charges for services and
20 facilities furnished in connection with sanitation, sewerage, or
21 any other utility, whereby the same are collected by the county
22 tax collector."

SECTION 3. Section 13.28.020 of the San Bernardino Municipal
24 Code is amended to read:

"13.28.020 Collection of delinquent water, sanitation, sewer
26 or other utility charges.

A. The City hereby elects to avail itself of the provisions
28 of Section 5473 of the Health and Safety Code, and elects to have

1 delinquent water, sanitation (rubbish, garbage, by-products),
2 sewer and other utility charges, if any, collected on the tax roll
3 in the same manner, by the same persons, and at the same time as,
4 together with and not separately from, its general taxes, provided
5 this chapter is approved by two-thirds vote of the Common Council.

'Delinquent charges' for the purposes of this chapter,

those charges which remain unpaid for a period of sixty days
8
depositing an invoice for said charges in the United States
9 mail, postage prepaid, to the property owner, landlord, or
10 customer."

SECTION 4. Section 13.28.030 of the San Bernardino Municipal
12 Code is amended to read:

"13.28.030 Description of parcel receiving services to be
14 filed with City Clerk.
15 A written report shall be prepared and filed with the City
16 Clerk which shall contain a description of each parcel of real
17 property receiving such water, sanitation, sewer or other utility
18 services and the amount of the delinquent charges for each parcel
19 computed in conformity with charges prescribed by resolution of
20 the Mayor and Common Councilor pursuant to the rules and
21 regulations of the Board of Water Commissioners. The real
22 property may be described by reference to maps prepared in
23 accordance with California Revenue and Taxation Code, Section 327,
24 and on file in the Office of the County Assessor or by reference
25 to plats or maps on file in the Office of the City Clerk."

SECTION 5. Section 13.28.060 Subsection B of the San
27 Bernardino Municipal Code is amended to read:

"B. The City Administrator may file a notice of pendency of

1 administrative action with the County Recorder for any parcel or
2 parcels of real property against which any water, sanitation,
3 sewer or other utility charge is found to be delinquent hereunder
4 by the Mayor and Common Council."
