ORDINANCE NO.
2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER
15.04 OF THE SAN BERNARDINO MUNICIPAL CODE TO CHANGE CERTAIN FEES
3 APPLICABLE TO BUILDINGS.
4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:

SECTION 1. Section 15.04.080 of the San Bernardino Municipal
7
Code is amended to read:

"15.04.080 UBC Subsection 304 (a) amended - Fees.
9
UBC Section 304 (a) is amended to read as follows:
10
Section 304. (a) Permit fees. The fee for each permit shall
11 be as set forth in Table Nos. 3-A through 3-D of the Uniform
12 Administrative Code, 1979 Edition, subject to such amendments
13 thereto as are adopted in this chapter.
14 The determination of value or valuation under any of the
15 provisions of this code shall be made by the building official,
16 based upon the latest publication of building valuation data
17 printed by the International Conference of Building Officials
18 bimonthly Building Standards magazine. The value to be used in
19 computing the building permit and building plan review fees shall
20 be the total value of all construction work for which the permit
21 is issued as well as all finish work, painting, roofing,
22 electrical, plumbing, heating, air conditioning, elevators, fire-
23 extinguishing systems and any other permanent equipment."

SECTION 2. Section 15.04.082 is added to the San Bernardino
25 Municipal Code to read:

"15.04.082 UBC Subsection 304 (b) amended - Fees.
UEC Section 304 (b) is amended to read as follows:
Section 304. (b) Plan Review Fees. When a plan or other

1 data is required to be submitted by Subsection (b) of Section 302,
2 a plan review fee shall be paid at the time of submitting plans
3 and specifications for review. Said plan review fee shall be
4 65% of the building permit fee as shown in Table No.3-A. A fee
5 of 10% of building plan check fee shall be charged for residential
6 and non-residential plan check and inspections to meet any State
7 mandated energy requirements. A fee of 10% of building plan check
8 fee shall be charged for plan check and inspections of any State
9 mandated regulations relating to handicappers imposed upon
10 commercial, multi-family and public buildings.
11 Where plans are incomplete or changed so as to require
12 additional plan review, an additional plan review fee shall be
13 charged at the rate shown in Table No.3-A."
14 SECTION 3. Section 15.04.085 is added to the San Bernardino
15 Municipal Code to read:
16 "15.04.085 Uniform Administrative Code, 1979 Edition, Table
17 No. 3-A amended - Building Permit Fees.
18 Uniform Administrative Code, 1979 Edition, Table No. 3-A is
19 amended by adding items 5, 6 and 7 to Other Inspections and Fees:
20 5. A fee in the sum of fifty dollars ($50.00) for the
21 inspection of any existing property or building required to be
22 made by the Department of Building and Safety for compliance with
23 the National Housing Act, Section 221 (d) (2) or other lending
24 institutions and regulations thereunder shall be paid to the City
25 by the applicant for such inspection service.
26 6. A fee in the sum of twenty-five dollars ($25.00) for
27 the inspection of a room addition, garage, patio, or other portion
28 of a building when the entire building need not be inspected.

1 7. An annual sign permit fee shall be ten dollars
2 ($10.00) due and payable on the second day of January in any year,
3 which fee shall be doubled if the permit is not obtained by the
4 thirty-first day of January; however, where the sign is first
5 erected after January 31 of that year, only the ten dollar
6 ($10.00) fee shall apply."
7 SECTION 4. Section 15.04.087 is added to the San Bernardino
8 Municipal Code to read:
9 "15.04.087 Uniform Administrative Code, 1979 Edition, Table
10 NO. 3-B is amended by adding thereto New Commercial Buildings:
11 NEW COMMERCIAL BUILDINGS: The following fees shall include
12 all wiring and electrical equipment in or on each building or
13 other electrical equipment on the premises constructed at the same
14 time, $.015 per square foot."
15 SECTION 5. Section 15.04.090 of the San Bernardino Municipal
16 Code is amended to read:
17 "15.04.090 UBC subsection 307 (f) added - Certificate of
18 Occupancy.
19 UBC subsection 307 (f) is added to read as follows:
20 Section 307. (f) Before final approval is given for a
21 building or portion thereof, the building shall be ready for
22 occupancy with all defects corrected and all construction debris,
23 spots and stains removed and the site shall be graded to final
24 grade.
25 Buildings or structures or yard shall have final inspection
26 and approval by all departments before the public utilities may
27 connect gas or electricity to the building.
28 EXCEPTION: The Building Official may grant permission to

connect one or more utilities to the building before final
inspection is approved when it can be shown that withholding a
utility will be detrimental to health and safety.
The rules and regulations of the 'California Administrative
Code, Title 8' shall apply to the issuance of Certificates of
Occupancy for apartment houses, hotels, and lodging houses; and
none of such buildings shall be used or occupied until the owner
or operator thereof has been issued a valid Certificate of
Occupancy.
For buildings or structures or portions thereof in Groups A,
E, I, H, B or R Division I Occupancy, a new Certificate of
Occupancy shall be obtained whenever:
1. The building has been vacant for one hundred eighty (180)
continuous days; or
2. There is a change of occupancy, ownership, lessee(s), or
of the use; or
3. There is a change of occupancy classification of the
building or portion of the building; or
4. There is a temporary use not exceeding thirty (30) days.
Said new Certificate of Occupancy must be obtained prior to
any person, firm or corporation using or occupying a building or
structure under conditions requiring the obtaining of a new
Certificate of Occupancy.
Before an application for a Certificate of Occupancy is
accepted, a fee shall be paid by the applicant to cover the cost
of the inspection as follows:
For a Commercial Building $30.00
