2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER
19.08 OF THE SAN BERNARDINO MUNICIPAL CODE PERTAINING TO SINGLE-
3 FAMILY RESIDENTIAL DISTRICT, TO SPECIFY PERMITTED ACCESSORY USES
AND STRUCTURES, TO SPECIFY MINIMUM LOT SIZES AND DIMENSIONS, AND
4 TO SPECIFY ~~XIMUM LOT COVERAGE, MINIMUM FLOOR AREA, MINIMUM
DISTANCE BETWEEN BUILDINGS ON THE SAME LOT, BUILDING HEIGHT,
5 STRUCTURAL SETBACK AND YARD, PERMITTED ENCROACHMENTS, TEMPORARY
TRAILERS, AND ANIMAL REQUIREMENTS.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
7 ORDAIN AS FOLLOWS:

SECTION 1. Chapter 19.08 of the San Bernardino Municipal
9 Code is amended as follows:

"19.08.010 Regulations generally.
11 The regulations set forth in this chapter shall apply to the
12 R-l, Single-Family Residential zones.
13
19.08.020 Permitted primary uses and structures.
14 No building or land shall be used and no building shall be
15 erected, structurally altered, enlarged or maintained except for
16 the following uses:
17
A. Single-family residences on a permanent foundation. No
18 more than one dwelling unit per lot is permitted.
19
B. Public and private uses as follows, subject to a
20 conditional use permit:

1. Churches,
22
2. Public libraries,
23
3. Educational institutions of a nonprofit nature,
24
4. Civic or community clubs,
25
5. Country clubs and golf courses, except miniature golf
26 courses and similar commercial enterprises,
27
6. Fire and police stations,

7. Museums not operated for profit,

1 8. Electrical substations,
2 9. Children's nurseries,
3 10. State authorized, certified or licensed family care
4 homes, foster homes or group homes serving six or more mentally
5 disordered or otherwise handicapped persons or dependent and
6 neglected children,
7 11. Guest houses,
8 12. Such other uses as the Commission determines to be
9 similar and equally essential to serve the public welfare.
10 19.08.025 Permitted accessory uses and structures.
11 A. If incidental to a permitted primary use, accessory
12 buildings and uses, including a private garage of a capacity not
13 to exceed three automobiles, recreation room(s), or private
14 greenhouses or gardening sheds, shall be permitted, provided that
15 the combined floor area of all accessory buildings shall not
16 exceed fifty percent of the floor area of the primary structure
17 for lots within the R-1-7,200 or R-l-lO,800 residential zones;
18 B. For recreational vehicle regulations, see Section
19 15.52.020.
20 19.08.030 Minimum lot area and dimensions.
21 The following minimum areas and widths shall apply in the R-l
22 zones, except that a lot having a width or area of less than such
23 applicable minimum area or width which was of record on September
24 10, 1953, or which lot was annexed to the City when it was legally
25 conforming to the minimum area or width of the applicable county
26 ordinance, shall be deemed to comply with the applicable minimum
27 area or width of the zone:
28 A. Minimum area and width. Except as provided for above,

1 the minimum lot area in the R-l zones shall not be less than
2 seventy-two hundred square feet. Specifically, the following
3 minimum lot areas and widths are required for each zone listed:

B. Minimum depth. Minimum depth shall be one hundred feet.

19.08.035 Development review.

An administrative review of plans shall be required for all R
12 1 zone developments. Site plans, floor plans and conceptual
13 elevations shall be submitted in conjunction with the processing
14 of the application for administrative review of plans, and
15 compatibility with surrounding residential buildings and
16 structures shall be required in accordance with the following
17 criteria:

A. When adjacent to an existing single-family neighborhood,
19 the minimum unit size shall be not less than eighty percent of the
20 average unit sizes of existing single-family residences within
21 five hundred feet of the project area.

B. Each dwelling unit shall contain a minimum square footage
23 of enclosed habitable floor area in accordance with Section
24 19.08.050.

c. Dwelling units shall comply with the requirements of this
26 chapter, including but not limited to building setbacks and height
27 limitations.

1 neighborhoods shall be exempt from the minimum floor area
2 requirements of Section 19.08.050 provided the enclosed habitable
3 floor area is compatible with the surrounding established single-
4 family residences.
5 E. Existing dwelling units with less than 1,000 square feet
6 of enclosed habitable floor area shall be exempt from the minimum
7 floor area requirements of Section 19.08.050.
8 19.08.040 Building height.
9 Maximum building height shall be thirty-five feet. No
10 accessory structure in the R-1-7,20C and R-l-lO,800 zones shall
11 have a height in excess of fifteen feet. See Section 19.72.010
12 for exceptions for lots on downhill slopes.
13 19.08.045 Maximum lot coverage.
14 Maximum lot coverage by all buildings and structures shall
15 not exceed thirty-five percent of the total lot area.
16 19.08.050 Minimum floor area.
17 Each dwelling unit shall contain a minimum of one thousand
18 square feet of enclosed habitable floor area, exclusive of
19 garages.
20 Within subdivisions of at least five lots, the minimum
21 enclosed habitable floor area may be reduced below one thousand
22 square feet subject to a conditional use permit in accordance with
23 the requirements of Chapter 19.78.
24 19.08.055 Minimum distance between buildings on the same
25 lot.
26 A minimum distance of ten feet between a building used for
27 dwelling purposes and an accessory building and a minimum distance
28 of six feet between accessory buildings shall be provided.

19.08.060 Structural setbacks and yards.
Each lot within any single-family residential zone shall have
front, side, and rear yards of at least the minimum depth and area
as provided below, except as provided in Section 19.72.030 for
large scale housing developments.
A. Front setback. Each front setback shall have a depth of
not less than twenty-five feet. The exceptions for blocks
partially built up in Section 19.54.020 and for key lots in
Section 19.54.030 shall apply.
B. Side setback.
1. A side yard is required on each side of the main
building of not less than ten percent of the width of the lot, or
five feet, whichever is less, but in no event less than three
feet. For restrictions concerning access to garage to the rear of
the main building, see Section 19.56.020.
2. On corner lots, the side yard abutting the street
shall be at least twenty percent of the width of the lot, but no
side yard is required to exceed fifteen feet nor may it be less
than ten feet.
3. On a reversed corner lot, the side yard abutting the
street shall be not less than half of the distance required for
front yards on interior lots on the street upon which the reversed
corner lot sides; provided, however, that this side yard may not
be less than fifteen feet. Private garages located in the side
yard and taking access to a street shall be at least eighteen feet
from the property line.
c. Rear setback.
1. A rear yard of at least twenty percent of the lot

depth, or twenty feet, whichever is less, is required.
2. Accessory buildings may be built to the side and rear
property lines provided that such buildings are not closer than
ten feet to any other structure.
19.08.070 Parking.
For parking regulations, see Chapter 19.56.
19.08.080 Fences.
For regulations regarding fences, see Chapter 19.62.
19.08.090 Signs.
For sign regulations, see Chapter 19.60.
19.08.100 Permitted encroachments.
For permitted encroachments into required setback areas, see
Section 19.72.070 regarding porches and marquees, and Section
19.72.090 regarding roofs.
19.08.110 Temporary trailers.
Temporary trailers for construction purposes are subject to
all conditions and limitations of Section 15.52.040 D.
19.08.120 Animals.
For regulations regarding the keeping of animals, see Title 6
of the San Bernardino Municipal Code.
19.08.130 Vehicular access to non-residentially zoned
parcels.
No land shall be developed to provide vehicular access to any
parcel of land that is not zoned for residential uses."
