ORDINANCE NO. MC-382
ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER
5.04 OF THE SAN BERNARDINO MUNICIPAL CODE RELATING TO BUSINESS
LICENSES TO REVISE CLASSIFICATIONS, ELIMINATE DUPLICATIONS,
ELIMINATE REFERENCE TO ACTIVITIES NO LONGER CARRIED ON IN THE
CITY, AND TO STANDARDIZE FEES RELATING TO CERTAIN BUSINESS
ACTIVITIES, AND DECLARING THE URGENCY THEREOF.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1. Section 5.04.150 Subsection A of the San

Bernardino Municipal Code is amended to read:

"5.04.150 Vending machine sales and automatic scale
weighing devices.
A. Every person, firm or corporation operating,
maintaining, leasing, letting, managing or carrying on the
business of selling or vending goods, wares or merchandise by
means of vending machine or managing or carrying on the business
of operating or maintaining automatic scale weighing devices, or
coin-in-the-slot weighing machines shall pay a license fee of
fifty dollars per calendar year, or any part thereof; provided,
however, that in the event any person, firm or corporation so
engaged in such business operates, maintains, leases or lets more
than fifty such machines in the City during any calendar year or
any portion thereof, then the person, firm or corporation shall
pay, in addition to the license fee provided for in this section
a yearly license fee for each machine over and above fifty in
number in the following sums:
1. Twenty-five cents as a license fee for each machine
26 operated by a coin of less than five cents in value;

28 by a coin of less than ten cents in value but not less than five

cents in value;
3. One dollar as a license fee for each machine operated by
a coin of ten cents or more in value."
SECTION 2. Section 5.04.210 of the San Bernardino Municipal
Code is amended to read:
"5.04.210 Residential and commercial cleaning.
For every person, firm or corporation conducting, managing,
or carrying on the business of carpet cleaning, swimming pool
cleaning, cleaning buildings, parking areas, rooms or
furnishings, by compressed air, power sweeper, or vacuum cleaner,
by means of any machine drawn, hauled, carried or propelled by
hand power, or any janitorial related services conducted in
residential or commercial structures or parking areas, the
license fee is forty dollars annually."
SECTION 3. Section 5.04.325 Subsections E, F and G of the
San Bernardino Municipal Code are amended to read:
"E. For every person, firm or corporation conducting,
managing or carrying on the business of furnishing linen
supplies, coats, jackets, towels or other similar articles, the
license fee is thirty-five dollars per quarter.
F. For every person, firm or corporation conducting,
managing or carrying on a laundry business other than is
specifically provided for in this section, the license fee is
thirty-five dollars per quarter.
G. Any person, firm or corporation holding a license issued
pursuant to the provisions of Subsections C, D, E, or F of this
section shall have the right as an incident to such business to
collect articles to be laundered, without the payment of any

additional license fee therefor; providing, that no additional

license or fee for collecting articles to be laundered shall be
3
required of any person, firm or corporation holding a license to
4
operate a steam or power-driven laundry plant."

SECTION 4. Section 5.04.340 of the San Bernardino Municipal
6
Code is amended to read:

"5.04.340 Messenger service.
8
For every person, firm or corporation conducting, managing
9
or carrying on the business of furnishing messengers or messenger
service, the license fee is forty dollars per year."
SECTION 5. Section 5.04.375 of the San Bernardino Municipal
12 Code is amended to read:

"5.04.375 Peddler or solicitor - Foodstuffs.
A. For every person, firm or corporation engaged in or
15 carrying on the business of a peddler, or solicitor of orders, or
16 for the sampling, or for the sale of any fish, fruits,
17 vegetables, butter, eggs, buttermilk, milk, ice cream,
18 confection, bread, crackers, cookies, pies, cakes, pastries,
19 doughnuts, or other bakery goods, or any other edibles, intended
20 for use as food for human consumption, by means of foot or
21 vehicle delivery, the license fee is ten dollars per quarter per
22 vehicle if delivery is by vehicle, or per basket, tray or other
23 container if delivery is by foot.

B. For the purpose of this section, a 'peddler' or
25 'solicitor' is defined to be and include every person, firm or
26 corporation who goes from place to place on a fixed route, who
27 solicits orders for the sale of, or who sells or offers for sale
28 any goods, wares, or merchandise, or the sampling of any goods,

wares, or merchandise, as enumerated or contemplated in this

section, which he, she, or it has in his, her, or its possession,
3
or in his, her or its motor truck, automobile, wagon, or other
4
vehicle, cart, basket, tray or other container."

SECTION 6. Section 5.04.525 Subsection F of the San
6
Bernardino Municipal Code is amended to read:

"F. Commercial or industrial rental, hotel, roominghouse,
8 lodginghouse, boardinghouse, motel, mobile home park, mini-
9 storage, etc. Every person, firm or corporation conducting,
10 managing, or carrying on the business of leasing or renting of
11 commercial or industrial buildings or spaces, where the buildings
12 or spaces are to be utilized for any business purpose including
13 retail sales, or leasing or renting office building rooms or
14 suites or other business rentals including mini-storage;
15 operating a hotel, roominghouse, lodginghouse, boardinghouse,
16 apartment house, court motel, mobile home park or structure or
17 any combination of structures which compose four or more units,
18 shall pay a license fee in accordance with the following table
19 based on annual gross receipts:

If annual gross receipts exceed one hundred thousand

dollars, the annual license fee is two hundred ten dollars, plus
5
fifty cents for each one thousand dollars or major fraction
6
thereof of annual gross receipts in excess of one hundred
7
thousand dollars of such gross receipts.

The intent of this section is to require a license for the
9
business of leasing or renting of commercial or industrial
buildings, leasing or renting office building rooms or suites or
other business rentals; leasing or renting of dwelling units, or
of spaces for dwelling units, or storage units where four or more
units exist on the same location, regardless of:
1. The plan of construction or assembly of the units;
2. Whether the units are all located on the same lot or
16 parcel of property, so long as they are on contiguous lots or
17 properties;

3. Whether all of the units are actually rented or leased;
4. Whether one of the units is occupied by the licensee or
21
20 his or her agents as a private residence or office."
SECTION 7. Sections 5.04.115, 5.04.120, 5.04.130, 5.04.170,
22 5.04.215, 5.04.225, 5.04.235, 5.04.250, 5.04.255, 5.04.260
23 5.04.325 Subsection H, 5.04.425, 5.04.430, 5.04.435, 5.04.450,
24 5.04.470, 5.04.475, 5.04.480, 5.04.515, and 5.04.580 of the San
25 Bernardino Municipal Code are hereby repealed.

SECTION 8. This ordinance is an urgency measure, which
27 shall take effect and become operative upon its adoption and
28 approval.

The facts constituting such urgency are that many of the
2
business licenses are renewable on July 1 of each year, and this
3
ordinance must be effective prior to July 1, 1984, to incorporate
4
the appropriate changes for 1984-1985 fiscal year.
