ORDINANCE NO. MC-390
ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SECTION
2.58.100 TO THE SAN BERNARDINO MUNICIPAL CODE TO MAKE THE
PROHIBITION AGAINST DISORDERLY OR CONTEMPTUOUS CONDUCT AT COUNCIL
MEETINGS APPLICABLE TO THE MAYOR; PROHIBIT SLANDER BY THE MAYOR
OR ANY MEMBER OF THE CITY COUNCIL WHEN IT IS NOT CONNECTED TO THE
OBJECTIVE OF THE MEETING; AND PROVIDE FOR NOTICE AND HEARING
REQUIREMENTS.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION 1. Section 2.58.100 is added to the San Bernardino
Municipal Code to read:
"2.58.100 Prohibiting contemptuous conduct at meetings.
The Mayor or any member of the Common Council shall not
engage in disorderly or contemptuous behavior in the presence of
the Common Council at public meetings. Contemptuous behavior
shall include within its meaning "slander" as defined in Civil
Code Section 46 which is not connected or logically related
to the objective of the meeting. The Common Council shall have
power to punish the Mayor or any of its members for disorderly or
contemptuous behavior in its presence after first providing
notice of the prohibited behavior and an opportunity to be heard.
The fine shall not exceed the sum of fifty dollars."
I HEREBY CERTIFY that the foregoing ordinance was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at an Adjourned Regular
meeting thereof, held on
