ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION
19.78.080 OF THE SAN BERNARDINO MUNICIPAL CODE PERTAINING TO THE
ISSUANCE OF A TEMPORARY USE PERMIT FOR PURPOSES OF ALLOWING AN
OPEN AIR PRODUCE MARKET, AND DECLARING THE URGENCY THEREOF.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION 1. Section 19.78.080 of the San Bernardino
Municipal Code is amended to read:
"19.78.080 Temporary use.
A. Notwithstanding any other provision of law to the
contrary, the Planning Commissio~ may grant immediate permission
with conditions for the temporary use of vacant land, not to
exceed ninety days, for religious purposes and for assembly group
meetings, public gatherings or related purposes in C-l, C-2, C-3,
C-3A, C-4, C-M, M-l and M-2 districts and for City sponsored
events in any zoning district; and may authorize the erection of
tents and portable buildings for such uses.
B. Notwithstanding any other provision of law to the
contrary, the Planning Director, subject to the approval of the
Mayor and Common Council, may grant immediate permission with
conditions for the temporary use of vacant land, not to exceed
sixty days, for the operation of nonprofit open air produce
markets or for related purposes in any zoning district.
SECTION 2. This ordinance is an urgency measure, which

The facts constituting such urgency are that the fruit to be
27 sold at such produce market is presently at the peak of its
28 ripeness and, absent the availability of the market to be

provided by this ordinance, said fruit will spoil, causing great
economic loss to the producers. In addition, the San Bernardino
County Agricultural Commissioner has certified certain small
farmers for participation in this market. In reliance on the
timely establishment of this market, these farmers have forborne
from obtaining other means for the distribution of their produce.
Although the County of San Bernardino has approved and partially
funded this public service program, there were governmental
administrative and procedural problems in implementing this
market and, therefore, implementation is required to take place
on an urgency basis. The opening of such market because of the
condition of the fruit has been scheduled and must take place on
or about July 20, 1984. Moreover, adoption of the ordinance
effective immediately is considered necessary for the immediate
provision of seasonal employment to assist the unemployed and
provide a boost to the local economy which could not otherwise be
provided. The market will serve to increase the nutritional
standards of low and moderate income persons in the San
Bernardino area in that through this market, fresh produce will
be able to be provided at prices which would otherwise not be
available. In addition, the market has made preparations for the
acceptance of food stamps.
I HEREBY CERTIFY that the foregoing ordinance was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at an Adjourned Regular
