ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SECTION
3.44.022 TO THE SAN BERNARDINO MUNICIPAL CODE TO ESTABLISH THE
EFFECTIVE DATE OF CHAPTER 3.44 AS TO ANNEXED AREAS, AND DECLARING
THE URGENCY THEREOF.
I THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:
SECTION 1. Section 3.44.022 is added to the San Bernardino
Municipal Code to read:

annexation.
I Notwithstanding the provisions of Section 3.44.144 Subsection
IB to the contrary, any individual within any area annexed to the
City of San Bernardino may file an application for exemption from
taxes in accordance with Section 3.44.144 during a ninety day
period commencing on the effective date of the annexation.
SECTION 2. Urgency. This ordinance is adopted as an urgency
measure, which shall take effect and become operative upon its
adoption and approval.
The facts constituting such urgency are that it relates to a
tax levy for the usual and current expenses of the City and
clarifies when such levy shall be applicable to persons within
areas where electors will vote on November 6, 1984, for or against
I annexation. The ordinance further clarifies when eligible
II individuals within annexed areas may file for exemption. The
I! utility companies require at least sixty days to implement the

1 collection and exemption procedures. Without urgent adoption, the e
2 clarifying provisions would not be effective prior to the
3 election.
