MC-521 2 ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING CHAPTER 18.64 TO THE SAN BERNARDINO MUNICIPAL CODE RELATING TO PROVISIONS FOR 3 LOT LINE ADJUSTMENTS. 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 5 6 SECTION 1. Chapter 18.64 is hereby added to the San 7 Bernardino Municipal Code to read as follows: 8 9 "Chapter 18.64 LOT LINE ADJUSTMENT 10 18.64.010 Necessity for lot line adjustment. 11 Following the recordation of a final map or a parcel map, it 12 may become necessary to adjust the alignment of existing parcel 13 lines between parcels or to eliminate existing parcel lines to 14 provide for more flexible siting of proposed projects. 15 18.64.020 Application. 16 To apply for a lot line adjustment, an applicant shall 17 obtain the required application form(s) from the Planning 18 Department. The applicant shall complete the application form(s) 19 and shall submit any and all other required documentation and 20 forms which may be required as established on the application as 21 acceptable. 22 18.64.030 Application - Filing fees. 23 The application shall be accompanied by a fee in the amount 24 established by resolution of the Mayor and Common Council. 25 18.64.040 Hearing on petition. 26 The application shall be handled through the normal 27 procedures established for and by the Development Review 28 1 ." 1 Committee. Application deadline for a lot line adjustment will 2 be the same as that established for public hearing items. The 3 lot line adjustment application and maps will be reviewed at the 4 scheduled Development Review Committee of the following week of 5 the acceptance of the application. 6 18.64.050 Decision by the Development Review Committee. 7 A letter of decision shall be mailed to the applicant within 8 ten working days following the decision of the last meeting of 9 the committee. 10 18.64.060 Compliance with requirements. 11 A lot line adjustment shall not be processed and shall be 12 returned forthwith to the applicant unless it complies with 13 Sections 18.64.020 and 18.64.030. No lot line adjustment shall 14 be filed without the property owner's written consent. 15 18.64.070 Required findings. 16 The Development Review Committee shall deny the application 17 for lot line adjustment unless it finds that: 18 A. The proposed configuration complies with all pertinent 19 criteria set forth in Titles 18 and 19 of this Code; 20 B. The proposed configuration is consistent with the 21 General Plan. 22 18.64.080 Form and content of applications. 23 The Planning Director shall have the authority to prescribe 24 the form and content of applications for lot line adjustment. 25 18.64.090 Recordation. 26 The applicant shall file a certificate of compliance with 27 the City Engineer within twenty-four months, and shall then 28 2 ~ .Ke-521 1 record the certificate of compliance with the County Recorder. 2 18.64.100 Appeal of decision of Development Review 3 Committee. 4 Any person adversely affected by the decision of the 5 Development Review Committee with reference to the denial of an 6 application may appeal to the Common Council in accordance with 7 the provisions of Chapter 2.64." 8 I HEREBY CERTIFY that the foregoing ordinance was duly 9 adopted by the Mayor and Common Council of the City of San 10 Bernardino at a regular meeting thereof, held on 11 the 19th day of , 1986, by the May 12 following vote, to wit: 13 14 15 16 17 18 19 AYES: Council Members Estrada.
