MC-528 2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER 6.24 OF THE SAN BERNARDINO MUNICIPAL CODE TO INCREASE FEES 3 RELATING TO ANIMALS; AND DECLARING THE URGENCY THEREOF. 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO NO ORDAIN AS FOLLOWS: 5 6 SECTION 1. Section 6.24.030, Subsection A of the San 7 Bernardino Municipal Code is amended to read as follows: 8 "A. Each person owning, harboring or having custody or 9 control of a dog of the age of four months or more, within the 10 City, shall obtain annually a license and tag for the dog on or 1] before the first day of July of each year. The license and tag ]2 fee for each fiscal year shall be six dollars and fifty cents for ]3 a neutered dog and sixteen dollars for a dog which has not been 14 neutered. License and tag fees are payable in advance. If the 15 appropriate fee is not paid prior to August first, a delinquency ]6 penalty of ten dollars shall be added to the fee. A fee of one ]7 dollar shall be charged for any additional tag issued to replace ]8 a lost, stolen misplaced or damaged tag. A fee of one dollar 19 shall be charged for the transfer of ownership of a licensed dog 20 to a new owner in lieu of a fee for a new license for the 2] remainder of the year in which the transfer occurs." 22 SECTION 2. Section 6.24.120 of the San Bernardino Municipal 23 Code is amended to read as follows: 24 "6.24.120 Vicious or dangerous animal - Running at large - 25 Impoundment - Fees. 26 Each vicious or dangerous animal found running at large or 27 unrestrained shall be impounded by authorized employees of the 28 City for a period of seventy-two hours. The reclaiming fee for M(;-528 1 2 3 4 5 6 third and subsequent 7 offenses sixty dollars times the total number 8 of offenses which have occurred plus 9 five dollars per day pound fee. 10 If the owner or possessor of the animal does not claim the 11 animal and pay any sums due or owing during the seventy-two 12 hours, the animal shall be disposed of by authorized employees of 13 the Ci ty. " 14 SECTION 3. Section 6.24.140 of the San Bernardino Municipal 15 Code is amended to read as follows: 16 "Sec tion 6.24.140 Running at large - Impoundment. 17 Any dog found running at large or unrestrained in the City 18 shall be impounded by the Animal Control Officer for a period of 19 seventy-two hours. The reclaiming fee for such impounded dog 20 shall be as follows: 21 22 23 24 25 26 27 28 such impounded animal shall be as follows: first offense twenty dollars, plus five dollars per day pound fee forty dollars, plus five dollars per day pound fee second offense first offense twenty dollars, plus five dollars per day pound fee forty dollars, plus five dollars per day pound fee second offense third and subsequent offenses sixty dollars times the total number of offenses which have occurred, plus five dollars per day pound fee 2 MC-528 I If the owner or possessor of the dog does not claim the dog 2 and pay any sums due or owing during the seventy-two hours, the 3 dog shall be disposed of by authorized emp loyees of the Ci ty. " 4 SECTION 4. Section 6.24.150, Subsection C of the San 5 Bernardino Municipal Code is amended to read as follows: 6 "C. Veterinarian pick-up service charge: 7 seven dollars for one animal 8 two dollars for each additional animal 9 Veterinary pick-up service will terminate after August 1, 10 1986." II SECTION 5. Section 6.24.150, Subsection D of the San 12 Bernardino Municipal Code is amended to read as follows: 13 "D. Adoption fees (to new owners): 14 twenty dollars for each dog or puppy 15 fifteen dollars for each cat or kitten" 16 SECTION 6. Section 6.24.150, Subsection E of the San 17 Bernardino Municipal Code is amended to read as follows: 18 "E. Research animal sales: 19 one hundred dollars for each dog or puppy 20 sixty dollars for each cat or kitten" 21 SECTION 7. Section 6.24.150, Subsection G of the San 22 Bernardino Municipal Code is amended to read as follows: 23 "G. Vaccination fee: 24 six do lIars for each dog or cat reclaimed by its owner 25 six do lIars for each dog or cat adopted to a new home 26 six do lIars for each dog or cat sold for research 27 purposes" 28 SECTION 8. This ordinance is an urgency measure, which 3 JIIC-528 ) . 0' " 1 shall take effect and become operative upon its adoption and 2 approval. 3 The facts constituting such urgency are that adequate 4 revenue is necessary in order to continue the appropriate level 5 of services by animal control and these amendments are necessary 6 in order to provide funds for this fiscal year. 7 I HEREBY CERTIFY that the foregoing ordinance was duly 8 adopted by the Mayor and Common Council of the City of San 9 Bernardino at a regular meeting thereof, 10 held on the 7th day of July , 1986, by 11 the following vote, to wit: 12 13 14 15 16 17 18 19 of 20 21 AYES: Council Members Reilly, Marks, Quiel, Frazier, Strickler NAYS: ABSENT: None council Members Estrada, Hernandez ,#da';~~fh'/ .
