ORDINANCE NO.
2 ORDINANCE OF THE CITY OF SAN BERNARDINO REQUIRING A REVIEW
OF PLANS FOR TWO-STORY SINGLE-FAMILY DWELLINGS WITHIN THE
3 FOOTHILL AREA.
4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1. Review of Plans - Two-Story Single-Family
Residence.

A. The Planning Department shall establish and utilize

procedures pursuant to San Bernardino Municipal Code Chapter
19.77 for the review and approval of plans to expedite
processing of applications for development and improvement of
any two-story single-family structure on vacant existing lots
in the foothill area which have been recorded for a period of
three years; the foothill area is described as that area
beginning on the east side of the city Limits at Boulder Avenue
and Highland Avenue; thence northwesterly along the extension
of Piedmont Drive to victoria Avenue; thence northerly up to
the extension of Piedmont Drive westerly to Foothill Drive;
thence along Foothill Drive west to Del Rosa Avenue; thence
north to the extension of Fortieth Street; thence west along
Fortieth Street to Waterman Avenue; thence north to the P.E.
Railroad right-of-way; thence west along the P.E. Railroad
right-of-way to the Northpark Boulevard; thence west along
Northpark Boulevard extending to the Muscupiabe Rancho line;
thence west to the City Limits, more particularly described as
shown on a map labeled Exhibit A on file in the Planning
Department.

9 the denial of the right to a building permit for any legal lot of

B. The purposes of the review of plans are to ensure:
1. The compatibility of such development and
improvements with existing surrounding single-family residences;
2. The preservation of mountain and valley views for
existing and future residences as can reasonably be obtained by
the development; and
C.
3. The protection of the values of such residences..
In no event shall this ordinance be deemed to authorize

14 SECTION 2. Applications - view Criteria.
15 A. All pending applications and applications filed hereafter
16 for foothill area development permits shall be subject to design
17 criteria for the preservation of mountain and valley views in the
18 foothill area. Such design standards shall be promulgated by the
19 Mayor and Common Council. Any projects submitted to the Building
20 and Safety Department prior to the effective date of this
21 ordinance shall be exempt from the provisions of this ordinance.

23 shall not receive final approval until it has been determined that
24 such plans meet said design standards for the preservation of
25 mountain and valley views.
