SECTION 1. Section 18.44.070 Subsec'cion N of the San

IIN. Existing overhead utility lines, including, but not
9 limited to electrical, telephone, cable television, and street
10 light service, shall be placed under~round. This require~ent
11 shall apply to all such lines traversing the development, or
12 along either side of streets adjoinin0 the subdivision, except
13 for electrical transmission lines of 33 KVA and above.
14 Distribution lines of 33 KVA and below shall be undergroundeo.
15 ,There one line is exe~.pt, all lines on .that pole shall be
16 exempt. Arran0e::1ents, including pa,!~ent of costs, shall be
17 made by the subdivider with the serving utility company(s).
18 Undergrounding of utility structures may be done by the
19 subdivider, with permission from the serving utility.
For subdivisions with frontages of less than three hundred

feet, the Director of Public ~orks/City Engineer
22
may accept a cash payment fror. tl'e ~;uhd i vider, in lieu of
23
undergrounding the lines. Payments will be based upon a written
24
estimate of the short form unit u.st from the serving utility
25
company(s), and will reflect the cubdivision's proportionate
26
share of the estirated cost fur undergrounclino the lines over
27
the entire section.

1 street is vacant, and intended to be served by the service line
2 across the street, the subdivision shall pay fifty percent of
3 the estimated cost of undergrounding. When the vacant property
4 is developed, developer shall pay the remaining fifty percent
5 of the cost of undergrounding. The cost of undergrounding shall
6 be calculated to exclude the cost of street crossings; the
7 entire cost to underground street crossing lines shall be borne
8 by the property served by the crossing lines. The developer
9 nay choose to perform the undergrounding instead of paying fifty
]0 percent of the cost. ~oweve~, if he chooses this option, he
11 shall pay one hundred percent of conversion.
]2 All payments shall be deposited into a line item account
for undergrounding utilities within the area. In no event

shall the total of payments received exceed the estimated cost
for undergrounding utilities along that section of street.
For the purpose of this subsection, surface mounted
transformers, pedestal rwunted terrainal boxes and meter
cabinets, and other associated equip~ent for an underground
system may be placed above ground.
An appeal may be submitted to the !-~.ayor and COITU110n
Council for a waiver of the requirements of this subsection,
due to topographic conditions, soil or other factors
23 that render undergrounding unreasot,able or impractical. All
24 appeals shall be in writing, and shall state the reason why

undergrounding is unreasonablc or impractical. Appeals shall
include a preliminary estimate of cost, in writing, from the
serving utility company(s);"

1 Municipal Code is amended by adding Subsection E to read as
2 follows:

"E. Relocate or provide for the relocation of any
4 underground or overhead utility, including irrigation lines,
5 the relocation of which is necessitated by development of the
6 subdivision. Relocation may entail undergrounding of existing
7 overhead utility lines, as required by Section 18.44.070
8 Subsection N of the Code."
