ORDINANCE NO. MC-654
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO ADDING SECTION 2.56.142 AND 2.56.143 TO THE SAN
BERNARDINO MUNICIPAL CODE RELATING TO ABSENT VOTER BALLOT
APPLICATIONS, AND DECLARING THE URGENCY THEREOF.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION 1.
Section 2.56.142 is hereby added to the San
7 Bernardino Municipal Code to read as follows:
8 "2.56.142 Retention of Absent Voter Ballot Application
9 Beyond Time Limits;
10 Any person, other than the voter, who willfully (a) retains
11 a completed absent voter ballot application, with or without the
12 voter's authorization, for more than three days, excluding
13 weekends and state holidays, or by the deadline for return of
14 absent voters' ballot applications, whichever is earlier, or (b)
15 denies an applicant the right to return his or her own completed
16 absent voter ballot application to the local elections official
17 having jurisdiction over the election, or dissuades or attempts

to dissuade such applicant to not so return his or her completed
absent voter ballot application, is guilty of a misdemeanor."
SECTION 2.
Section 2.56.143 is hereby added to the San
Bernardino Municipal Code to read as follows:
"2.56.143 Return of Absent Voter Ballot Application.
After completing the absent voter ballot application the
absent voter shall return the application by mail or in
person to the official from whom it came.
It is a
misdemeanor for any person, except the absent voter,
to
return the application to the local election official."

SECTION 3. This is an urgency ordinance for the immediate
preservation of the public peace, health or safety in that it has
come to the attention of the Mayor and Common Council that in the
upcoming election there may be plans to improperly use the absent
voter procedure to subvert the electoral process and due to the
imminent date of the election and the dates for applications for
absent voter ballots it is necessary that this ordinance take
immediate effect in order to protect the unfettered right of
suffrage of the citizens of the City of San Bernardino.
I HEREBY CERTIFY that the foregoing ordinance was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a

meeting thereof, held on the 3rd
