ORDINANCE NO. MC-656
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO ADDING SECTION 2.56.146 TO THE SAN BERNARDINO
MUNICIPAL CODE RELATING TO THE RETURN AND COUNTING OF ABSENTEE
BALLOTS AND DECLARING THE URGENCY THEREOF.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION 1.
Section 2.56.146 is hereby added to the San
Bernardino Municipal Code to read as follows:
"2.56.146 Return and Counting of Absentee Ballots.
All absentee ballots shall be voted on or before the day of
the election.
After marking the ballot, the absent voter
shall either: (1) return the ballot by mail or in person to
the official from whom it came or (2) return the ballot in
person to any member of a precinct board at any polling
place within the jurisdiction.
The ballot must, however,
be received by either the official from whom it came or the
precinct board before the close of the polls on election
day.
"The City Clerk shall establish procedures to insure the
secrecy of any ballot returned to a precinct polling
place.
"The provisions of this section are mandatory, not
directory, and no absent voter ballot shall be counted if
it is not delivered in compliance with this section."
SECTION 2. This is an urgency ordinance for the immediate
preservation of the public peace, health or safety in that it has
come to the attention of the Mayor and Common Council that in the
upcoming election there may be plans to improperly use the absent

voter procedure to subvert the electoral process and due to the
imminent date of the election and the dates for applications for
absent voter ballots it is necessary that this ordinance take
immediate effect in order to protect the unfettered right of
suffrage of the citizens of the City of San Bernardino.
