2 URGENCY ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING
CHAPTER 8.80 TO THE SAN BERNARDINO MUNICIPAL CODE RESTRICTING
3 DISCHARGES TO THE STORM DRAIN SYSTEMS.
4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1.
Chapter 8.80 is hereby added to the San

Bernardino Municipal Code to read as follows:

"8.80.010 Discharge Prohibitions. Except as expressly
allowed in an Industrial Wastewater Permit, no person shall
9
di scharge, permi t the di scharge, cause the discharge or
contribute to the discharge of the following to the storm
drain systems or Waters of the State.
(a) Gasoline, mercury, total identifiable chlorinated
hydrocarbons, kerosene, naphtha, benzene, toluene, xylene,
ethers, alcoh()J~s, k8ton(~S, aldehydes, peroxides, chlorates,
perchloratE~;::;, b:COJ'lc:tcr:
carbides, hydridos, solvents,
pesticides or jet fuel.
(b) Any liquids, solids or gases which by reason of their
nature or quan-tity (lre flammable, reactive, explosive,
corrosive, or radioactive, or by interaction with other
materials could J:esul"t if} fire, explosion or injury.
(c) Any solid or viscous materials which could cause
obstruction to the flow or operation of the storm drain
system.
(d) Any toxic pollutants in sufficient quantity injure or
interfere with any wastewater treatment process, including
privat:c-:: pretrcc1t:nont .~)YSt>2LllS, to constitute a hazard or
cause injury to hlHIl,Jr~1 cH1imal, pl(;")!l.t or fish life, or to

exceed any limitation set forth in this section."

SECTION 2.
This is an urgency ordinance which will take
3
effect immediately upon its adoption.
The reasons for the
4 urgency are the enormous increase in toxic materials used in our
5 homes and businesses will have a deleterious effect on the storm
6
drain system if allowed to be introduced into that system.
Our
7 complex society finds those materials all around us and even a
8 short delay in the implementation of this ordinance restriction
9 could result in an unacceptable level of these materials in the
10 storm drain system which could result in not only serious health
12
11 risks to citizens and employees but in County, State and Federal
penalties.
This ordinance is necessary in order to protect the
14
13 public health, safety and welfare.
