ORDINANCE OF THE
CHAPTER 19.23 TO THE SAN
REGULATE THE CONSTRUCTION
STORES.
CITY OF SAN BERNARDINO ADDING
BERNARDINO MUNICIPAL CODE TO
AND OPERATION OF CONVENIENCE
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO DO ORDAIN AS FOLLOWS:
SECTION 1. Chapter 19.23 of the San Bernardino
Municipal Code is added as follows:
"Chapter 19.23
CONVENIENCE STORE REGULATION
19.23.010 Applicability and Review
The regulations set forth
in this
Chapter shall
apply to convenience
which are
defined as
stores
establishments which provide for the retail sales of
groceries, staples, sundry items and/or alcoholic beverages
within structures of less than five thousand (5,000) square
feet of gross floor area.
The establishment of new
convenience stores shall be allowed in the CN, CG-1, CG-2,
CG-3, CG-4 and CR-2 Land Use Designations and approval.
19.23.020 Regulations
Convenience stores shall be constructed and operated
in the following manner:
A. The minimum site area shall be ten thousand (10,000)
square feet.
B. The site shall have direct frontage along a major or
secondary street.
The site shall not have direct
access on a local residential street.

frontage.
The design and location of the access
drive(s) shall be subject to the approval of the
Development Review Committee. Additional access drives
may be approved subject to the recommendation of the
city Engineer.
D.
No convenience store shall be located less than one
thousand (1,000) feet from an existing or previously
approved convenience store, or an existing elementary,
junior high school, or high school, as measured from
the nearest distance from one property line to another.
E.
All on site lighting shall be energy
efficient,
stationary and directed away from adjoining properties
F.
and public rights-of-way.
All on-site signage shall comply with the provisions of
Chapter 19.60 of this Code.
G.
All on-site parking and landscaping shall comply with
the provisions of Chapter 19.56 of this Code. A
parking plan shall be developed as part of the permit
review process.
All installed landscaping shall be
permanently maintained.
H.
The premises shall be kept in a neat and orderly
condition at all times.

1.
Every parcel with a structure shall have a trash
receptacle on the premises. The trash receptacle shall
comply with adopted Public Works Department standards
and be of sufficient size to accommodate the trash
generated. The receptacles(s) shall be screened from
public view on at least three (3) sides by a solid wall
six (6) feet in height and on the fourth side by a
solid gate not less than five (5) feet in height. The
gate shall be maintained in working order and shall
remain closed except when in use. The wall and gate
shall

J.
The cashier location shall provide direct visual access
to the pump islands and the vehicles parked adjacent to
the islands.
K.
A bicycle rack design to accommodate a minimum of six
(6) bicycles
shall be installed in a convenient
location visible from the inside of the store.
L.
Each convenience store shall provide two (2) public
restrooms located within the store; one (1) for men and
one (1) for women.
M.
Public pay telephones provided on-site shall not be set
up for incoming calls.
Public telephones shall be
featured with callout service only.

2 N. On-site video games may not be installed or operated on
3 the premises.
4 O. A convenience store adjacent to any residentially
5 designated district shall have a six (6) foot high
6 decorative masonry wall along property lines adjacent
7 to such districts.
8 P. All parking, loading, circulation aisles, and pump
9 island bay areas shall be constructed with (PCC)
10 concrete."
