ORDINANCE NO. MC-948
2 AN URGENCY ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING
CHAPTER 19.22, SECTIONS 19.22.110(1), (2) AND (4) OF THE SAN
3 BERNARDINO MUNICIPAL CODE (DEVELOPMENT CODE) PERTAINING TO NON-
CONFORMING SIGNS AND DECLARING THE URGENCY THEREOF.

5 ORDAIN AS FOLLOWS:

SECTION 1.
sections 19.22.110(1), (2) and (4) of the
7 Municipal Code (Development Code) are amended to delete certain
8 restrictions for the reuse of non-conforming signs and to add the

requirement that such signs be removed when the building being
advertised is demolished; all other provisions of section 19.22.110
remain unchanged (see Attachment "A", Development Code Page 111-29,
a copy of which is attached hereto and incorporated herein by
reference).
(a) The first provision of section 19.22.110 of the
Development Code is hereby amended to read as follows:
" 1. Notwithstanding the requirements in Chapter 19.62, a
legally established sign which fails to conform to this
Chapter shall be allowed continued use, except that the
sign shall not be:
A. structurally altered so as to extend its useful
life.
B. Expanded, moved, or relocated. MC 888 1/6/94."
(b) The second provision of section 19.22.110 of the

1 SECTION 2. Uraencv. The Mayor and Common Council do hereby
2 find that the present regulations in the Development Code unduly
3 restrict the reuse of legal non-conforming signs. In order to
4 protect the public health, safety and welfare, it is necessary that
5 this ordinance take effect immediately to prevent further economic
6 decline and loss of jobs and to encourage the establishment of an
improved business climate by facilitating the reuse of existing
commercial structures and signs.

19.22.110
NON-CONFORMING SIGNS
1. Notwithstanding the requirements in Chapter 19.62, a legally established sign which fails
to conform to this Chapter shall be allowed continued use, except that the sign shall not
be:
A. Structurally altered so as to extend its useful life.
B. Expanded, moved, or relocated.

2. All nonconforming signs shall be demolished when the building which they advertise is
demolished.
3. Legal non-conforming wall signs shall not prevent the installation of conforming
freestanding signs, nor shall legal non-conforming free-standing signs prevent the
installation of conforming wall signs.
19.22.120
REMOVAL OF ILLEGAL SIGNS
1. The Director shall remove or cause the removal of any fixed, permanent sign
constructed, placed or maintained in violation of this Chapter, after 30 days following
the date of mailing of registered or certified written notice to the owner of the sign, if
known, at the last known address or to the owner of the property as shown on the latest
assessment roll, or to the occupant of the property at the property address. The notice
shall describe the sign and specify the violation involved, and indicate that the sign will
be removed if the violation is not corrected within 30 days. If the owner disagrees with
the opinion of the Director, the owner may, within the said 30 day period request a
hearing before the Commission to determine the existence of a violation.
2. Signs removed by the Director pursuant to this Chapter shall be stored for a period of
30 days, during which time they may be recovered by the owner upon payment to the
City for costs of removal and storage. If not recovered prior to expiration of the 30 day
period, the sign and supporting structures shall be declared abandoned and title thereto
shall vest to the City, and the cost of removal shall be billed to the owner.
