Me-1009 2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTIONS 15.04.020, 15.04.070, 15.04.075, 15.04.077, 15.04.080, 15.04.100, 3 15.04.114, 15.04.120, 15.04.125, 15.04.130, 15.04.133, 15.04.163, 15.04.165, 15.04.167, 15.04.175, 15.04.177, 15.04.179, 15.04.220, 4 15.04.221, 15.04.222, 15.04.223, REPEALING SECTIONS 15.04.076, 15.04.112, AND ADDING SECTIONS 15.04.065, 15.04.084, 15.04.105, 5 15.04.116, 15.04.117, 15.04.118, 15.04.119 OF THE SAN BERNARDINO MUNICIPAL CODE AND ADOPTING THE UNIFORM BUILDING CODE, 1994 6 EDITION, THE UNIFORM BUILDING CODE STANDARDS, 1994 EDITION, THE UNIFORM HOUSING CODE, 1994 EDITION, THE UNIFORM ADMINISTRATIVE 7 CODE, 1991 EDITION, THE UNIFORM BUILDING SECURITY CODE, 1994 EDITION, THE UNIFORM MECHANICAL CODE, 1994 EDITION, THE UNIFORM 8 PLUMBING CODE, 1994 EDITION, THE UNIFORM SWIMMING POOL SPA AND HOT TUB CODE, 1994 EDITION, THE NATIONAL ELECTRICAL CODE, 1993 EDITION, 9 THE UNIFORM CODE FOR SOLAR ENERGY INSTALLATIONS, 1994 EDITION, THE UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS, 1994 10 EDITION, NFPA 99C STANDARD ON GAS AND VACUUM SYSTEMS, 1996 EDITION, AND AMENDMENTS THEREON. 11 12 WHEREAS, pursuant to California Health and Safety Code Section l7958, local governing bodies are required to adopt regulations 13 imposed by Section 17922 of the California Health and Safety Code; 14 and 15 16 WHEREAS, pursuant to Section 17958 of the California Health and Safety Code, a City may make changes in the provisions adopted 17 pursuant to Section l7922 of the California Health and Safety Code; 18 19 20 and WHEREAS, it is necessary to update codes incorporated into the San Bernardino Municipal Code. 21 22 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 23 24 25 26 27 28 SECTION 1. Section 15.04.020 of the San Bernardino Municipal Code is hereby amended as follows: "15.04.020 Adoption of Codes by Reference. Those certain rules and regulations, as set forth in the following codes, appendices and new standards are hereby 1 Me-l009 1 2 adopted by reference as the regulations governing the 3 erection, construction, alteration, repair, removal and 4 maintenance of all buildings and other structures in the City: 5 (l) Uniform Building Code, including Appendix Chapters 6 3 Division I and II, 4, 15, 16 Division II and III, 18, 7 31, 33, 34 of the International Conference of Building 8 Officials, 1994 Edition; 9 (2) Uniform Building Code Standards of the International 10 Conference of Building Officials, 1994 Edition; 11 (3) Uniform Housing Code of the International Conference of 12 Building Officials, 1994 Edition; 13 (4) Uniform Administrative Code of the International 14 Conference of Building Officials, 1991 Edition; 15 (5) Uniform Building Security Code of the International 16 Conference of Building Officials, 1994 Edition; 17 (6) Uniform Mechanical Code, including Appendices A, B, C and 18 D of the International Conference of Building Officials; 19 (7) Uniform Plumbing Code, including Appendix, Chapters A, B, 20 c, D, G, H, I, J and IAPMO Installation Standards of the 21 International Association of Plumbing and Mechanical 22 Officials, 1994 Edition; 23 (8) Uniform Swimming Pool Spa and Hot Tub Code of the 24 International Association of Plumbing and Mechanical 25 Officials, 1994 Edition; 26 (9) National Electrical Code of the National Fire Protection 27 Association, 1993 Edition; 28 (10) Uniform Code for Solar Energy Installations of the International Association of Plumbing and Mechanical 2 Me-1009 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Officials, 1994 Edition; (ll) Uniform Code For The Abatement of Dangerous Buildings of the International Conference of Building Officials, 1994 Edition; (12) NFPA 99C Standard on Gas and Vacuum Systems, of the National Fire Protection Association, 1996 Edition. It shall be unlawful to erect, construct, alter, repair, remove or maintain any building or structure in the City in violation of, or without complying with the appropriate provisions of the above codes. Copies of each code shall be kept on file in the city Clerk's Office for inspection and reference and copies of each code shall be furnished to the Director of Planning and Building Services. In the event of any inconsistency or conflict between the above codes and the requirements of other City ordinances or State statutes, the state statutes and city ordinances shall apply." SECTION 2. section 15.04.065 of the San Bernardino Municipal Code is hereby added to read as follows: "15.04.065 UBC section 106.4.4.1 is added - Prima Facie Evidence of abandoned work. section 106.4.4.1 Prima Facie Evidence of abandoned work. Failure on the part of the permittee to obtain an inspection and to demonstrate substantial progress to the satisfaction of the Building Official within any 180 day period shall be Prima Facie evidence that the work has been abandoned and the permit shall have expired." 3 Me-l009 1 2 SECTION 3. section 15.04.070 of the San Bernardino 3 Municipal Code is hereby amended to read as follows: 4 "section 15.04.070 UBC Section 105.3 is added - Board of 5 Appeals Designated. 6 section 105.3 Board of Appeals Designated. 7 1. The Board of Building commissioners of the City of 8 San Bernardino shall serve as the Board of Appeals. The 9 Building Official or his designee shall be Clerk of the Board. 10 The Board shall have such duties as are delegated to it by the 11 Uniform Building Code as adopted by the city, and other duties 12 as may be delegated by other provisions of the San Bernardino 13 Municipal Code. 14 2. All requests for appeal of administrative decisions 15 of the Building Official to the Board of Building 16 commissioners shall include a non-refundable appeals fee of 17 Seventy-Five Dollars ($75.00) paid to the Building Official." 18 SECTION 4. section 15.04.075 of the San Bernardino 19 Municipal Code is hereby amended to read as follows: 20 "15.04.075 UBC Section 106.2, Item 2 is amended - Fences Not 21 Requiring Permit. 22 2. Fences not over six (6) feet high, 23 except concrete and masonry fences greater than three (3) feet 24 above grade. Masonry fences shall be constructed in 25 accordance with the standard design specifications approved by 26 the Building Official, unless an alternate engineered design 27 is submitted and approved. Exemption from the permit 28 requirements shall not be deemed as a waiver of the design requirements contained in the San Bernardino Development Code 4 Me-l009 1 2 as it relates to the use of materials or the configuration 3 thereof, or to the height of fences in front or side yards." 4 SECTION 5. section 15.04.077 of the San Bernardino 5 Municipal Code is hereby amended to read as follows: 6 "15.04.077 UBC Appendix section 3406.2 is amended - 7 Enforcement. 8 section 3406.2 Enforcement. The procedures for the 9 enforcement of this chapter shall be as set forth in section 10 15.28 of the San Bernardino Municipal Code." 11 SECTION 6. section 15.04.080 of the San Bernardino 12 Municipal Code is hereby amended as follows: 13 "15.04.080 Applicable Fees and Fee Exemptions. 14 A. Applicable Fees: 15 Notwithstanding the provisions contained in UBC section 16 l07.2, UMC section ll5.2, and UPC section 103.4.1, the 17 fees for building, electrical, mechanical, and 18 plumbing permits shall be as set forth in the latest 19 adopted edition of the Uniform Administrative Code, 20 subject to such amendments thereto as are adopted in this 21 chapter. Fees for other types of permits or items not 22 specified by the Uniform Administrative Code shall be as 23 set forth in the appropriate adopted code. 24 B. Fees shall be waived for the following: 25 1. Historic Preservation - No fees shall be charged for 26 permits issued for repairs, alterations or additions 27 for the preservation, restoration or rehabilitation 28 of a building or structure which is a qualified historical building or structure pursuant to Health 5 Me-1009 1 2 and Safety Code section 18955, a qualified 3 historical property pursuant to Public Resources 4 Code section 5031, a registered historical landmark 5 pursuant to public Resources Code section 5021, or 6 a point of historical interest pursuant to Public 7 Resources Code section 5022.5. 8 2. Natural Disaster Damage - No fees shall be charged 9 for permits issued to owners for demolition or first 10 rebuilding of damaged or destroyed structures 11 located in an area designated as a disaster area by 12 resolution of the Mayor and Common Council. This 13 exemption shall apply only to property owners of 14 record at the time of the disaster, and not to 15 persons subsequently acquiring the property. 16 3. Charitable organizations - Fees shall be waived or 17 refunded in accordance with Chapter 3.l3 of the San 18 Bernardino Municipal Code." 19 SECTION 7. section 15.04.084 of the San Bernardino 20 Municipal code is hereby added to read as follows: 21 "15.04.084 UBC Appendix section 3414 is amended - 22 Enforcement. 23 section 3414 Enforcement. The procedures for the 24 enforcement of this chapter shall be as set forth in section 25 l5.28 of the San Bernardino Municipal Code." 26 SECTION 8. section 15.04.l00 of the San Bernardino 27 Municipal Code is hereby amended to read as follows: 28 "15.04.100 UBC section 2209.1 is added - Welding Work. section 2209.1 Welding Work. Notwithstanding the 6 Me-l009 1 2 provisions of section 2209, the following subsections shall 3 govern all welding work: 4 1. All welding shall be done by qualified operators 5 approved by the Building Official. The Building Official 6 shall prescribe rules and regulations for the tests for 7 welders, and no operator shall be approved by the Building 8 Official unless and until he has first successfully completed 9 such tests as may be given by the Department of Adult- 10 Vocational Education, San Bernardino City Schools, San 11 Bernardino Valley College, or has obtained such approval 12 because he holds a current welding certificate based upon the 13 requirements of the California Department of Adult-Vocational 14 Education, provided it has the same or similar standards and 15 criteria as said Department of the San Bernardino City Schools 16 of San Bernardino Valley College. A certificate shall be 17 issued to operators by the Building Official upon successful 18 completion of the required test or tests andlor approval as 19 aforesaid being obtained. Requests for the certificate shall 20 be made by the operator within thirty (30) days after 21 completion of the test. The certificate shall remain in force 22 for two years. Subsequent certificates may be obtained by 23 successful completion of required tests, or when the approved 24 operator submits sufficient evidence to the department of 25 Adult-Vocational Education, San Bernardino City School, or San 26 Bernardino Valley College that he has regularly engaged in 27 such work and that such work has been satisfactorily performed 28 during the past year. 2. Every welder employed for welding of steel plate of 7 Me-l009 1 2 No. 8 gauge thickness or less shall be qualified for light 3 gauge welding. Every welder employed for field welding shall 4 be qualified to weld in the flat, vertical and overhead 5 positions. Welders, including light gauge welders who are 6 employed for shop welding, shall be qualified in the flat, 7 vertical and horizontal positions. 8 3. structural steel welding operators shall be 9 qualified as prescribed by the latest edition of the 10 structural Welding Code of the American Welding Society. 11 4. After a welder has passed the above tests, he must 12 be capable of doing neat and consistently good work in actual 13 operation. Carelessness, inability to maintain a uniform arc 14 and poor workmanship will be deemed sufficient cause for 15 revocation of the welder's certificate. 16 5. A fee of forty dollars ($40.00) will be charged by 17 the City of San Bernardino for each original or renewed 18 certificate which shall be valid for two years. 19 6. At the time application is made, a certificate may 20 be issued without examination upon presentation of proper 21 evidence that the welder is currently approved for the 22 position either by the Department of Adult-Vocational 23 Education or the Division of Architecture, state of 24 California, or other acceptable proof of qualification. 25 7. Testing shall be done under the supervision of the 26 San Bernardino City Schools, Department of Adult-vocational 27 Education of San Bernardino Valley College." 28 SECTION 9. Section 15.04.105 of the San Bernardino 8 Me-l009 1 2 Municipal Code is hereby added to read as follows: 3 "15.04.105 UBC Chapter 4, section 410 is amended - MEDICAL 4 GAS AND VACUUM SYSTEMS IN GROUPS B AND I OCCUPANCIES. 5 Section 410 Medical gas and vacuum systems in Groups B 6 and I Occupancies shall be installed and maintained in 7 accordance with this section, NFPA 99C and the Fire Code. 8 When nonflammable gas cylinders for such systems are located 9 inside buildings, they shall be in a separate room or 10 enclosure separated from the rest of the building by not less 11 than one-hour fire-resistive construction. Doors to the room 12 or enclosure shall be self-closing smoke-and-draft-control 13 assemblies having a fire-protection rating of not less than 14 one hour. Rooms shall have at least one exterior wall in 15 which there are not less than two vents of not less than 36 16 square inches (0.023 sq. m) in area per vent. One vent shall 17 be within 6 inches (152 mm) of the floor and one shall be 18 within 6 inches (l52 mm) of the ceiling. 19 EXCEPTION: When an exterior wall cannot be provided for 20 the room, automatic sprinklers shall be installed within 21 the room and the room shall be vented to the exterior 22 through ducting contained within a one-hour-rated shaft 23 enclosure. Approved mechanical ventilation shall provide 24 six air changes per hour for the room." 25 SECTION 10. Sections 15.04.076 and 15.04.112 of the San 26 Bernardino Municipal Code are hereby repealed. 27 SECTION 11. Section 15.04.114 of the San Bernardino 28 Municipal Code is hereby amended to read as follows: "15.04.114 UBC Appendix Chapter 4, Division I, Section 419 is 9 Me-l009 1 3 2 amended - scope. section 419 Scope. The provisions of this section apply 4 to the design and construction of barriers for swimming pools, 5 spas, and hot tubs located on the premises of Group R, 6 Division 3 occupancies. Swimming pools, spas, and hot tubs 7 for which an application for a permit was submitted prior to 8 July 23, 1993 shall comply with the requirements contained in 9 section 15.48 of the San Bernardino Municipal Code." 10 SECTION 12. section 15.04.1l6 of the San Bernardino 11 Municipal Code is hereby added to read as follows: 12 "15.04.116 UBC Appendix section 420 is amended - DEFINITIONS. 13 section 420 Definitions. For the purpose of this 14 section, certain terms, words and phrases are defined as 15 16 17 18 19 20 21 22 23 24 25 26 27 28 follows: ABOVEGROUND/ON-GROUND POOL. See definition of swimming pool. BARRIER is a fence, wall, building wall, safety cover complying with American Society for Testing Materials (ASTM) Standard F l346-91 or a combination thereof, which completely surrounds the swimming pool, spa or hot tub and obstructs access to the swimming pool, spa or hot tub. When approved by the Building Official, barriers may also incorporate natural ormanmade features, such as topography, waterways, restricted areas and similar features including geographically isolated areas which provide an effective access barrier to the pool area. GRADE is the underlying surface, such as earth or a walking surface. HOT TUB. See definition of spa. IN-GROUND POOL. See definition of swimming pool. SEPARATION FENCE is a barrier which separates all doors of a dwelling unit or building accessary thereto with direct access to a swimming pool, spa, or hot tub from that swimming pool, spa or hot tub. SPA is a structure intended for recreational bathing, designed to contain water over 18 inches (457 mm) deep and outside 10 Me-1009 1 2 dimensions not exceeding 160 square feet (14.72 sq. meters). 3 SWIMMING POOL is any structure intended for swimming or recreational bathing that is designed to contain water over 18 4 inches (457 mm) deep. This includes in-ground, above-ground, and on-ground swimming pools and fixed-in-place wading pools, 5 and excludes spas. 6 SWIMMING POOL, OUTDOOR is any swimming pool which is totally outside the residential structure." 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 13. section 15.04.117 of the San Bernardino Municipal Code is hereby added to read as follows: "15.04.117 UBC Appendix section 421.1, Item 6 is amended. 6. Where an aboveground pool structure is used as a barrier or where the barrier is mounted on top of the pool structure, and the means of access is a ladder or steps, then the ladder or steps shall be surrounded by a barrier which meets the requirements of Items 1 through 5." SECTION 14. section 15.04.1l8 of the San Bernardino Municipal Code is hereby added to read as follows: "15.04.118 UBC Appendix section 421.1, Item 7 is added. 7. Outdoor swimming pools with electrically operated, tracking safety covers that comply with the ASTM Standard F 1346-9l shall not be required to provide other barriers. The control for the pool cover shall be mounted at least 54 inches above grade." SECTION 15. section 15.04.119 of the San Bernardino Municipal Code is hereby added to read as follows: "15.04.119 UBC Appendix section 421.3 is added - Spas and Hot Tubs. section 421. 3 spas and Hot Tubs. A spa or hot tub with 11 Me-l009 1 2 a locking safety cover which complies with the ASTM Standard 3 F 1346-91 shall not be required to provide other barriers. 4 Where a locking safety cover is not provided, the spa or hot 5 tub shall comply with the requirements of section 421.1." 6 SECTION 16. section l5.04.120 of the San Bernardino 7 Municipal Code is hereby amended to read as follows: 8 "15.04.120 UBC Appendix section 3305.2 is added - Alquist- 9 Priolo Special Studies Zones. 10 section 3305.2 Alquist-priolo Special Studies Zones. 11 This chapter shall also include those requirements set forth 12 in the "Alquist-Priolo Special Studies Zones Act" (Chapter 13 7.5, Division 2, Public Resources Code, State of California 14 and adopted by "State Mining and Geology Board," November 2l, 15 1973). This Act is intended to represent minimum criteria 16 only for all structures that fall within the boundaries as 17 shown on the "Special studies Zone Maps" as prepared by the 18 State of California Division of Mines and Geology." 19 SECTION 17. section l5.04.125 of the San Bernardino 20 Municipal Code is hereby amended to read as follows: 21 "15.04.125 UBC Appendix section 3305.2 is added - Enforcement 22 Authori ty. 23 section 3305.2 Enforcement Authority. The City Engineer 24 of the City of San Bernardino shall have the authority for the 25 enforcement of UBC Appendix Chapter 33 and any amendments 26 thereto. The words "Building Official" as hereinafter used 27 shall mean the City Engineer." 28 SECTION 18. Section 15.04.130 of the San Bernardino Municipal Code is hereby amended to read as follows: 12 Me-1009 1 2 "15.04.130 UBC Appendix section 3306.3 is added - On-site 3 Improvement Permit. 4 section 3306.3 On-site Improvement Permit. No person 5 shall construct anyon-site improvement for motor vehicle 6 storage, parking or vehicle circulation, the disposal 7 of waste through a private sewer main, or landscaping and 8 irrigation systems, without first obtaining a permit from the 9 City Engineer. The provisions of this section shall not 10 apply to a residential driveway to be used in connection with 11 the occupancy of a single-family residence or a multi-family 12 residential development of four or less units. A permit 13 issued by the city Engineer for the purpose of construction 14 of the improvements set forth herein shall hereafter be known 15 as an on-site improvement permit". 16 SECTION 19. section 15.04.133 of the San Bernardino 17 Municipal Code is hereby amended to read as follows: 18 "15.04.133 UBC Appendix section 3308.1 is added- 19 Engineering Geologist. 20 section 3308.1 Engineering Geologist. The term 21 "Engineering Geologist" as hereinafter used shall mean a State 22 of California Registered Engineering Geologist." 23 SECTION 20. section 15.04.l63 of the San Bernardino 24 Municipal Code is hereby amended to read as follows: 25 "15.04.163 UBC Appendix section 3309.8.1 is added - Regular 26 Grading Plans. 27 section 3309.8.1 Regular Grading Plans. When required 28 by the Building Official, plans for regular grading shall be prepared by a registered civil engineer." 13 Me-1009 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 21. section 15.04.165 of the San Bernardino Municipal Code is hereby amended to read as follows: "15.04.165 UBC Appendix section 3309.10 is added - On-site Improvement Plans and specifications. section 3309.10 On-site Improvement Plans and Specifications. When required by the City Engineer, each application for an on-site improvement permit shall be accompanied by two sets of plans and specifications. Plans and specifications required by the city Engineer shall be prepared and signed by a registered civil engineer. Specifications may be incorporated into the plans as general notes in lieu of a separate document." SECTION 22. section 15.04.167 of the San Bernardino Municipal Code is hereby amended to read as follows: "15.04.167 UBC Appendix section 3309.10.1 is added - Information on On-site Improvement Plans. Section 3309.10.1 Information on On-site Improvement Plans. On-site improvement plans shall contain all information set forth in Section 3309.4 of the UBC and shall include the following additional information: l. Elevations of top of curb, back of sidewalk, and finish surface of pavement. 2. Flow line elevations, and rates of grade of curb and gutter, ribbon gutters, drainage facilities, and private sewer mains. 3. Detailed plans of planter curbs, curb and gutter, ribbon gutters and drainage facilities. l4 Me-l009 1 2 3 4 5 6 7 8 SECTION 23. section 15.04.175 of the San Bernardino 9 Municipal Code is hereby amended to read as follows: 10 "15.04.175 UBC Appendix section 3310.4 is added - On-site 11 Improvement Plan Review Fees. 12 section 3310.4 On-site Improvement Plan Review Fees. 13 When an on-site improvement plan is required to be submitted, 14 a plan review fee shall be paid at the time of submittal of 15 plans and specifications for review. Said review fee shall be 16 in an amount established by resolution of the Mayor and Common 17 Council. 18 Items to be reviewed are improvements including, but not 19 limited to, paving, curbs, sidewalks, private sewer mains, 20 drainage facilities, landscaping, and irrigation systems." 21 SECTION 24. section 15.04.177 of the San Bernardino 22 Municipal Code is hereby amended to read as follows: 23 "15.04.177 UBC Appendix section 3310.5 is added - On-site 24 Improvement Permit Fees. 25 section 3310.5 On-site Improvement Permit Fees. A fee 26 for each on-site improvement permit shall be paid to the city 27 Engineer. Said fee shall be in an amount established by 28 resolution of the Mayor and Common Council." SECTION 25. section 15.04.179 of the San Bernardino 15 4. Detailed specifications of materials including portland cement concrete, asphalt concrete, aggregate base, sewer pipe and pipe bedding. 5. Size and number of parking spaces, directional signs and striping. 6. Details of landscaping and irrigation systems." Ke-l009 1 2 Municipal Code is hereby amended to read as follows: 3 "15.04.179 UBC Appendix section 3317.9 is added - On-site 4 Improvement Inspection. 5 section 3317.9 On-site Improvement Inspection. All on- 6 site improvements for which a permit is required shall be 7 subject to inspection by the City Engineer through his 8 designated representative." 9 SECTION 26. section 15.04.220 of the San Bernardino 10 Municipal Code is hereby amended to read as follows: 11 "15.04.220 UBC Appendix section 3318.3 is added - Final 12 Reports. 13 section 3318.3 Final Reports. A statement from the 14 Landscape Architect, if any, that the planting and irrigation 15 system(s) have been installed in accordance with his 16 recommendations." 17 SECTION 27. section 15.04.221 of the San Bernardino 18 Municipal Code is hereby amended to read as follows: 19 "15.04.221 UBC Appendix section 3319.1 is added - Retaining 20 walls. 21 Section 3319.1 Retaining Walls. Retaining walls in 22 excess of 2.5 feet in height shall be provided with a 23 protective fence or guardrail of a minimum height of 42 inches 24 (1067 mm) as per UBC section 509." 25 SECTION 28. section 15.04.222 of the San Bernardino 26 Municipal Code is hereby amended to read as follows: 27 "15.04.222 UBC Appendix section 3319.2 is added - Driveways. 28 section 3319.2 Driveways. Driveways less than 30 feet in length shall have a maximum grade of 8% for a minimum distance of 20 feet from the garage. No portion of a driveway shall exceed a grade of 20%.
