WHEREAS, no other financing plan has been established to

2 NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:

SECTION 1:
Resolution No. 79-425, Subsection 2 (B)
is
4 amended as follows:
5 n(b) Prior to building permit approval within Project 3-5
6 (Pepper / Randall) Surcharge Area), the following special fees
7 shall be paid, which shall include the normal storm drainage fee
8 imposed by Resolution No. 79-425.
9 (1) For all construction or land development,
10 including, but not limited to, commercial, industrial and
11 multiple residential, Single Family Residential, and including
12 additions or extensions, paving and other impervious areas, a fee
13 of $7,159 per gross acre of development.

Said special drainage fees shall be adjusted
15 annually each July 15, in the amount of the change in the yearly
16 Construction Cost Index as published in the Engineering News

SECTION 2.
The Project 3-5 (Pepper / Randall) Storm
Drain Surcharge Area is proposed:
As all that area within the Comprehensive Storm Drain
Plan Project Area 3-5, lying within the City limits of
the City of San Bernardino, the easterly boundary being
generally described as the north/south extension of the
Southern Pacific Railway, the east/west prolongation of
the Atchison, Topeka & Santa Fe Railway and the north/
south prolongation of Pepper Avenue and the east/west
extension of 6th Street to the westerly/southerly City
Limits line.
SECTION 3.
Funds collected from the special drainage
fees shall be deposited in a special line item account, for
disbursement to the San Bernardino County Flood Control District
when a project for storm drain improvements in Project 3-5 is
ready to be advertised for bids.
