HomeMy WebLinkAbout1990-446 1 ~ : 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 10/15/90 .- RESOLUTION NO. ___~-~ti~_ RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER THE VACATION OF THAT NORTH/SOUTH ALLEY BETWEEN ALEXANDER AVENUE AND 27TH STREET, WEST OF WATERMAN AVENUE, AND RESERVING EASEMENTS FOR SANITARY SEWER AND APPURTENANT FACILITIES AND EASEMENTS FOR PUBLIC UTILITIES THEREIN, HE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SEcn ON 1. That the Mayor and Common Council 01 the City of San Bernardino hereby declares its intention to order the vacation of that North/South alley between Alexander Avenue and 27th Street, West of Waterman Avenue, described as follows: That certain North/South alley, as per plat recorded in Book 46 of Maps, Page 68, in the office of the County Recorder of the County of San Bernardino, described as follows: Beginning at the Northwest corner of Lot 2, Tract No. 3534, records of said County; thence South along the West line of said Lot 2, a distance of 252.42; thence West along the North line of 27th Street, 45.00 feet in width, a distance of 30.00 feet; thence North and parallel with said West line of said Lot 2, a distance of 252.42 feet; thence East along the South line of Alexander Avenue (Pioneer Way), 60.00 feet in width, a distance of 30.00 feet to the Point of Beginning. SEcn ON 2. That the Mayor and Common Council of the City of San Bernardino, in vacating the above described portion of said streets, elect to proceed under and in accordance with the provisions of the "Public Streets, Highways and Services Vacation Law", being Division 9, Part 3, of the Streets and Highways Code of the State of California. SEcnON 3. For further particulars as to the proposed vacation of the hereinbefore described portion of said streets, reference is made to that map marked "Plan No. 8092" approved April 2, 1990, on tile in the office of the City Clerk of said City. SECTION 4. Nothing in this Resolution shall in any way affect or disturb any existing easements for public utility pur'poses belonging either to the City of San Bernardino or to any public utility, There is hereby specifically reserved, for the City of San Bernardino, an easement in, over, under and across the entire area of the proposed vacation for sanitary sewer and all appurtenant tacilities, and to use, maintain, repair, replace or renew such facilities. There are also specifically reserved, easements for General Telephone, Southern California Edison and Southern California Gas to construct, place, operate, inspect, maintain, repair, replace and remove such aerial and underground telephone, telegraph and communication structures, electrical transmission structures and gas lines respectively, as the companies may from time to time require, consisting of poles, anchors, wires, cables, conduits, manholes, markers, pipelines and necessary fixtures and appurtenances. SECTION 5. That the City Engineer of the City of San Bernardino is hereby directed to cause Notices of Street Vacation to as be posted required by the Public Streets, Highways and Services Vacation Law, SECTION 6.
