RESOLUTION OF THE CITY OF SAN BERNARDINO GRANTING AN EASEMENT TO
SOUTHERN CALIFORNIA EDISON COMPANY, A CORPORATION, OVER CITY-OWNED PROPERTY
LOCATED ON THE SOUTH SIDE OF 5TH STREET, EAST OF GARDENA (A PORTION OF NUNEZ
PARK) .
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1.
That the Mayor and Common Council of the City of San
Bernardino hereby execute a Grant of Easement to Southern California
Edison Company, a corporation, for transmission of electrical energy and
appurtenant facilities.
SECTION 2.
That said Grant of Easement referred to herein, a
copy of which is attached hereto, marked Exhibit "A", and is hereby referred
to and made a part hereof as fully as though set out at length herein, is
hereby approved.
SECTION 3.
That the Mayor of the City of San Bernardino is
hereby authorized and directed to execute said Grant of Easement on behalf
of the City of San Bernardino.

CITY OF SAN BERNARDINO, a municipal corporation, (hereinafter referred to as "Grantor"). hereby
grants to SOUTHERN CALIFORNIA EDISON COMPANY, a corporation. its successors and assigns (hereinafter
referred to as "Grantee"), an easement and right of way to construct, use, maintain, operate, aitar, add
to. repair, replace, reconstruct, inspect and remove at any time and from time to time underground
electrical supply systems and communication systems (hereinafter referred to as "systems"), consisting
of wires, underground conduits, cables. vaults, manholes, hand holes, and including above-ground
enclosures, markers and concrete pads and other appurtenant fixtures and equipment necessary or useful
for distributing electrical energy and for transmitting intelligence by electrical means, in, on, over,
under, across and along that certain real property in the County of SAN BERNARDINO, State of California,
described as follows:

A strip of land 8 feet in width, lying within Lot 21ABlock 24, Rancho San Bernardino, as per map
recorded on Book 7, page 2 of Maps, in the Office of the Recorder of said County, the centerline of said
strip being described as follows:
BEGINNING at a point in the Southerly line of 5th Street, 82.5 feet wide as now established, distant
Easterly thereon 455 feet from the Southerly prolongation of the centerline of Gardena Street, 50 feet
wide as now established; thence Southerly, parallel with the Westerly line of said Lot 21, a distance of g
feet; thence southeasterly to a point that is distant Southerly 117 feet from said Southerly line, and
distant Easterly 595 feet from said Southerly prolongation of the centerline of Gardena Street; thence
Westerly, parallel with said Southerly line 10 feet.
The Grantor agrees for itself, its successors and assigns, not to erect, place or maintain, nor to
permit the erection, placement or maintenance of any building, planter boxes, earth fill or other
structures except walls and fences on the above described real property. The Grantee, and its
contractors, agents and employees, shall have the right to trim or cut tree roots as may endanger or
interfere with said systems and shall have free access to said systems and every part thereof, at all
times, for the purpose of exercising the rights herein granted; provided, however, that in making any
excavation on said property of the Grantor, the Grantee shall make the same in such manner as will cause
the least injury to the surface of the ground around such excavation, and shall replace the earth so
removed by it and restore the surface of the ground to as near the same condition as it was prior to such
excavation as is practicable.
