HomeMy WebLinkAbout1990-388 1 2 3 4 5 6 7 8 RESOLUTION NO. )0..J? 1 RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND AMONG THE CITY OF SAN BERNARDINO AND THE COUNTY OF SAN BERNARDINO, RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFCO 2620, FOR THE AREA GENERALLY LOCATED NORTH OF BASELINE, EAST OF CEDAR STREET. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals. The Mayor and Common Council of the City of San Bernardino hereby find and determine that: 9 A. Pursuant to Section 99 of the Revenue and Taxation Code, prior 10 to the issuance of a certificate of filing by the Local Agency Formation 11 Executive Officer, the governing bodies of all local agencies whose service 12 area service responsibilities will be altered a proposed by or 13 jurisdictional change will negotiate and determine by resolution the amount 14 of property tax revenues to be exchanged between and among such local 15 agencies. 16 B. Except as provided in Section 99.1 of the Revenue and Taxation 17 Code, in the event that a jurisdictional change would affect the service 18 area or service responsibility of one or more special districts, the Board 19 of Supervisors of the County of San Bernardino shall, on behalf of the 20 district or districts, negotiate any exchange of property tax revenues. 21 C. The Mayor and Common Council of the City of San Bernardino and 22 the Board of Supervisors of the County of San Bernardino have determined the 23 amount of property tax revenues to be exchanged as a result of 24 jurisdictional change described by LAFCO 2620, for the territory generally 25 26 27 28 located North of Baseline, South of Gilbert Street, East of Cedar Street and West of the Flood Control Channel. SECTION 2. Implementation. A. The negotiated exchange of property tax revenues between the 08-27-90 PROPERTY TAX REVENl~ EXCHANGE BETWEEN THE CITY AND COUNTY OF SAN BERNARDINO , RESULTING FROM JURISDICTIONAL CR~NGE DESCRIBED BY LAFCO 2620 FOR THE TERRITORY GENERALLY LOCATED NORTH OF BASELINE, EAST OF CEDAR STREET. 1 City of San Bernardino and the County of San Bernardino attached hereto as 2 Exhibit "A" and incorporated herein by reference, resulting from the above 3 described jurisdictional change, is hereby approved and accepted, The column 4 entitled "Estimated Current Tax Revenue" shall represent the amount of 5 property tax revenues for the current year to be paid to the County of San 6 Bernardino and its affected agencies. 7 B. The annual tax increment generated in the area subject to the 8 jurisdictional change and attributable to the Local Agencies whose service 9 area or service responsibilities will be altered by the proposed 10 jurisdictional change shall be allocated in the future years pursuant to the 11 provisions of Section 98 of the Revenue and Taxation Code. 12 SECTION 3.
