BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Electro Construction Corporation is the lowest responsible bidder for: Installation of Ballfield L i ghti ng Systems for Nunez Park, in accordance wi th Pl an No. 8098; for the total amount of $177,700.00, a contract is awarded to said bidder accordingly, but such award shall be effective only upon the contract being fully executed by the parties; all other bi ds therefore are hereby rejected; and the Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifi- cations thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3. July 24 . 1990 E.Xfl/8/T A" I I I I I I I I I I I I I I I I II I I I Engineer's Estimate $ 170,000.00 NOTICE INVITING BIDS NOTICE IS HEREBY GIVEN that the City of San Bernardino will receive bids or proposals for: CONSTRUCTION OF LIGHTING IMPROVEMENTS FOR NORTH AND SOUTH SOFTBALL FIELD AT NUNEZ PARK ON FILE IN THE OFFICE OF THE CITY ENGINEER, CITY HALL. Deliver all bids to the City Engineer's Office, 3rd floor, City Hall, 300 North "0" Street, San Bernardino, California, with the Specification title and number clearly marked on the outside of the envelope. Said bids or proposals will be received up to the hour of 2:00 p.m., on Jul'( 24 , 1990, at which time all of said bids or proposals wlll be publicly opened, examined and declared in the City Engineer's Conference Room, third floor, City Hall. No bid will be received unless it is made on a proposal form furnished by the City. All bids or proposals shall be signed, sealed and accompanied by cash, cashier's check, certified check or bid bond made payable to the City of San Bernardino, in the amount of ten percent (10%) of the bi d. Such cash, check or bond shall be given as a guarantee that the bidder will enter into the contract if awarded to him. In the event the bidder refuses to execute said contract, the use by the public of the improvements will be delayed, and the public will suffer great damage. From the nature of the case, it would be extremely difficult and impractical to fix said amount of damages. Therefore, the City and the bidder agree that the above sum of 10% shall be paid to the City upon the condition above set forth as liquidated damages and not as a forfeiture. All bonds furnished pursuant to this notice must be underwritten by a surety company having a rating in Best's most recent Insurance Guide of "A" or better. Therefore, the City and the bidder agree that the proposal guarantee of 10% of the bid shall be paid to the City upon the conditions set forth above as liquidated damages and not as a forfei ture. The Engineer shall have the right to interview any craft or workman on the project site in order to verify payment of prevailing wage rates in accordance with Resolution No. 12846. 5-1.04 PAYROLL RECOROS -- The Contractor's attention is directed to the following provisions of Labor Code Section 1776 (Stats. 1978, Ch. 1249). The Contractor shall be responsible for the compliance with these provisions by his subcontractors. (al The Contractor and all subcontractors shall keep an accurate payroll record, showing the name, address, social security number, work classification, straight time, and overtime hours worked each day and week, and the actual per deim wages paid to each journeyman, apprentice, worker, or other employee employed by him or her in connection with the public work. When the compensation payable for the number of units of an item of work performed in excess of 125 percent of the Engineer's Estimate is less than $1,500 at the applicable contract unit pri ce, the Engi neer reserves the ri ght to make no adjustment in said price if he so elects, except that an adjustment will be made if requested in writing by the Contractor. Such Contractor's request shall be accomplished by adequate, detailed data to support costs of the item. Should the total pay quantity of any item of work required under the contract be less than 75% of the Engineer's Estimate, therefore, the Engineer reserves the right to make no adjustment in said price if he so elects, except that an adjustment will be made if requested in writing by the Contractor. Such Contractor's request shall be accompanied by adequate, detailed data to support costs of the item. 6-1.02 SOUND CONTROL REQUIREMENTS -- The Contractor shall comply with Chapter 8.54 of the City of San Bernardino Municipal Code regulating and prohibiting loud, unnecessary and excessive noises. Each internal combustion engine, used for any purpose on the job or related to the job, shall be equipped with a muffler of a type recommended by the manufacturer. No internal combusti on engine shall be operated on the project without said muffler. No equi pment, machi nery, or apparatus that permi ts loud and excessive noise shall be operated during the hours of 10:00 p.m. and 7:00 a.m., unless approval has first been secured from the Mayor and Common Council of the City of San Bernardino. Said noise level requirements shall apply to all equipment on the job or related to the job, including but not limited to trucks, transi t mi xers or transi t equi pment that mayor may not be owned by the Contractor. The use of loud sound signals shall be avoided in favor of light warnings except those required by safety laws for the protection of personnel. 6-1.03 PERMITS AND LICENSE -- The Contractor shall obtain a City Business License, prior to execution of the contract. SP-6 ....., I I I I I I I I I I I I I I I I I I I 6-1.04 EXTRA WORK -- Any extra work done shall conform to the provisions in Section 3-3, "Extra Work", of the Standard Specifications. However, equipment rental rates shall conform to State of California Business and Transportation Agency, Department of Transportation, Division of Construction, "LABOR SURCHARGE AND EQUIPMENT RENTAL RATES", latest edition, unless the extra work is done for a negotiated price. 6-1.05 HOURS OF LABOR -- In the event that the Engineer is required by the Contractor's operations to work more than eight (8) hours in any given day, or more than forty (40) hours in any given week, or on any Saturday, Sunday or Holiday, in the setting of Lines and Grades or performi ng i nspecti ons, the Contractor shall pay an amount to the City equal to one and a half (It) ti mes the Engi neer' s normal wages and fri nge benefi ts. Such amount shall be deducted from the next following progress payments. 6-1.06 PAYMENTS -- Attention is directed to Section 9-3, "Payments", and 9-3.2, "Partial and Final Payment", of the Standard Specifications and these Special Provisions. No parti a 1 payment wi 11 be made for any materi a 1 s on hand which are furnished but not incorporated in the work. 6-1.07 PROJECT APPEARANCE -- The Contractor shall maintain a neat appearance to the work. In any area visible to the public, the following shall apply: When practicable, broken concrete and debris developed during clearing and grubbing shall be disposed of concurrently with its removal. If stockpiling is necessary, the material shall be removed or disposed of weekly. Full compensation for conforming to the requirements of Section 6 shall be considered as included in the prices paid for the vari ous contract i terns of work i nvol ved and no addi ti ona 1 compensation will be allowed therefor. The structural coating shall be hot- dipped galvanized ASTM A-123. 9-1.03 ITEMS TO BE SUBMITTED FOR CONSIDERATION OF AN ALTERNATE LUMINAIRE ASSEMBLY AND LIGHTING LAYOUT -- Failure to provide any of the following information with the alternate submittal will be grounds for rejection of the alternate. Each item listed below shall be provided in the form of clear and concise statements and/or plans and drawings which can be easily read and clearly interpreted. Each item shall also be clearly lettered to correspond with the following list. All items shall be assembl ed in the order i ndi cated and secured or bound in a neat and orderly fashion for easy use and reference. Bidders requesting to use equipment other than that specified shall submit ten (10) days prior to bid opening the following: 1. Layout Drawi ng -- Overall 1 i ghti ng 1 ayout desi gn showing luminaire mounting heights. 2. Aiming Drawing -- Light aiming point plan showing focus points and reflector types. 3. Luminaire Assembly Drawing A drawing of the luminaire assembly and its interface to the required poles. The drawing shall show size, strength, type of materi al, coati ng of all components, and hardware shall meet the following specifications: A. Structural Strength The luminaire assembly as shown in the manufacturer's submittal shall be capable of withstanding forces equal to 125 mph wind levels with a 1.3 gust factor without structural damage or misalignment of the luminaires on the assembly. B. Coati ngs All component surfaces of the completed assembly, except for the reflector, hardware and fasteners, shall be coated with hot-dipped galvanized ASTM A-123. SP-20 I I I I I I I I I I I I I I I I I I I Reflector The reflector shall be of spun aluminum with a1zak finish. Hardware and Fasteners All hardware and fasteners shall be of an approved corrosion resistant material or coating. C. Reflector and Lamp supports The ref1 ector shall be fastened to the 1 amp cone with a reinforcing retaining ring containing an acrylic compressed fiber ring which centers and stabilizes the lamp in the reflector and provides a heat shi e1 d to protect the 1 amp socket from heat. D. Lens A removable lens with silicone gasket shall be attached to the reflector and shall be impact and thermal resistant glass. The lens rim shall be stainless steel or equal and shall be attached to the reflector with hinged cable or chain. E. Aiming The manufacturer shall provide a mechanical positioning device for each 1uminaire on the assembly which device shall be set at the factory by the manufacturer based upon computer calculated aiming information such that each assembly is delivered to the jOb site as one composite light source. The device shall provide positions for the initial installation and provide for repositioning of the aiming after re1amping. The manufacturer shall also supply drawings showing the aiming point locations of each 1uminaire. 4 . Computer Models - Field Light Values A. Manufacturer shall submi t a computer deri ved light scan, with spill/glare control showing pOint by point horizontal footcand1e levels on the playing surface, maximum to minimum ratio, number of luminaires and inita1 lamp lumens. Starti ng at the lower left hand corner of the field, the point by poi nt footcandl e readi ng shall be shown every 30 ft. on the line and the maximum reading to be found anywhere on the line shall be shown. Also, the average footcandles on the line shall be shown. These scans shall refl ect the spi 11 1 i ght readings as defined in the spill light performance section. 6. Equipment Model Numbers Written statement of model number and manufacturer for all equipment bid. Submit a packet of descriptive literature on all equipment bid, as well as drawings and specifications of the luminaire assembly. 7. Luminaire Assembly Warranty Written warranty from the manufacturer covering luminaire assembly and equipment replacement policy. Aiming Alignment Warranty Written. warranty from headquarters covering the luminaire assembly. Include the project name, contact person and telephone numbers to reference such work. 12. Manufacturer's Guarantee The manufacturer shall submit in writing a letter guaranteeing compliance as to the above Specifications. Written explanation shall be provided prior to bidding as to specifi ed cri teri a for whi ch non-compl i ance is anticipated and an explanation as to why the criteria should be waived. B. Lamps Lamps shall be 1000 watt Metal Halide and shall meet ANSI designation M47PA-1000 BU and be Westinghouse #MH1000 U, or an approved equal. C. Ball ast Standard There shall be an individual ballast for each luminaire. The ballast shall be a lead peak auto-regulating ballast and be available for use with 240 volt supply. The ballast shall be located remote from the lamps on the same pole in metal enclosures with the capacitors and the capicators shall operate in ambient air not to exceed 70 degrees C as established by U. L. Test Standards. The assembly design shall be adaptable to various standard ballast and must retain U.L. listing. Wiring and Overcurrent Protection All wlrlng on the luminaire assembly shall meet National Electrical Code and shall pass from each luminaire on the assembly through protecti ve enclosures to joi n in a common enclosure. Each luminaire shall have individual supplemental fuse protection located in ballast boxes or in adjacent metal enclosures. Fusing must be U.L. listed. In-line fusing will NOT be accepted. SP-23 I I I I I I I I I I I I I I I I I I I 9-1.04 A . E. Special Conditions 1. Codes Luminaire assembly shall be U.L. listed and meet National Electrical Code and NEMA Publ i cati on FA-I. Pol e cl amps are not U. L. listed. 2. Manufacturer's Warranty Luminaire assembly shall be warranted in writing by the manufacturer for a period of two years and shall be submi tted wi th the bid. Any parts that shall be found defective shall be replaced free of and material or labor charges to the customer. Lamps are warranted not to fa i 1 for one year from installation date. Lamps which fail during this warranty period will be replaced and installed at no cost to the owner. Lamps which fail during the second 12 months will be replaced, but not installed by the manufacturer. 3. Aiming Alignment Warranty The alignment of the luminaires shall be warranted by the manufacturer against movement on the luminaire assembly for a period of five years from the date of installation. Labor charges for re-aiming during the warranty period shall be the responsibility of the manufacturer. 4. Replacement Parts The Contractor shall owner of the athletic field and four-six extra fuses for furnish to the two extra 1 amps future use. 5. The Contractor shall provide all instru- mentation and tests on the electrical system and equipment as hereinafter described and as further directed by the Engineer. All insturmentation required for testing shall the Contractor. and personnel be furni shed by B. Site Inspections 1. The Contractor shall carefully exami ne the site and existing buildings, shall compare the drawings with the existing electrical installations, and shall throughly familiarize himself with all existing conditions within the scope of this work. By the act of submi tti ng a Bi d, the Contractor will be deemed to have made such examination and to have accepted such conditions, and to have made allowance therefor in preparing his figure. C. Cutting and patching 1. The Contractor shall do all cutting and patching of the construction work, and of existing walks, pavements, and buildings whi ch may be requi red for the proper installation of the electrical work. All patching shall be of the same materials, workmanship and finish as, and shall accurately match all surrounding work. All work shall be done under the Engineer's i nstructi ons, and when so requi red, by the trade which did the original work. All supports required, in the Engineer's opinion, by reason of any cutting, shall be provided and installed by the Contractor as directed by the Engineer. SP-25 I I I I I I I I I I I I I I I I I I I D. Protection of Work and Equipment 1. The Contractor shall protect all work, materials and equipment from damage, from any cause whatever, and shall provide adequate and proper storage facilities during the progress of the work. He shall provide for the safety and good conditions of all work until final acceptance of the work by the Owner, and replace all damaged or defective work, materials and equipment before requesting final acceptance. 2. The Contractor shall be held responsible for the protection and correction of the work of all trades from smears, splashes, stains or damages that mught occur in the process of the work. E. Cleaning of Equipment and Materials 1. All parts of the equipment shall be thoroughly cleaned of dirt, cement, plaster, etc., and all cracks and corners scraped out clean. Surfaces to be painted shall be carefully cleaned of grease and oil spots and left smooth, clean and in proper condition to receive paint finish. F . Record Drawings 1. The Contractor shall provide and keep up-to-date a complete "As Built" record set of blue prints, which shall be corrected daily and show every change from the original Drawings and Specifications and the exact "As Built" locations, sizes, and kinds of equipment. This set of prints shall show all changes in conduit runs, circuits, and size and number of conductors. Pri nts for thi s purpose may be obtained from the Engineer. Thi s set of Drawi ngs shall be kept on the work site and shall be used ~ as a record set. 2. The Contractor pri nts up-to-date performed. 4. Within ten (10) days after the award of the contract, the Contractor shall submit a complete list of all materials he intends to use on the job. In the event changes in the indicated 1 ocati ons or arrangements are necessary due to developed condi ti ons in the constructi on or rearrangement of furnishings or equipment, such changes shall be made by the Contractor wi thout extra cost provi di ng the change is ordered before the conduit runs, etc., and/or work directly connected to same is installed, and no extra materials are required. J. Excavations 1. Do all excavating necessary for the proper installation of the electrical work whether or not indicated on the Drawings or Specifications. Underground secondary feeders shall be buried not less than 24" below finished grade; and other conduit runs containing circuits of 600 volts or less shall be not 1 ess than 18" below fi ni shed grade. 2. After the installation of work requiring excavations has been inspected and approved, all excavations shall be filled with clean earth and tamped to 80% compaction (turf areas), 90% compaction (paved areas), so that no settlement will occur, and the ground left firm as natural grade. All excavated earth which is not used for backfill shall be removed from the premi ses or otherwi se disposed of as directed. 3. All sidewalks, driveways or other cement or asphalt surfaces which are damaged during excavations shall be repaired to match the adjacent work in material and finish. K. Safety 1. Contractor shall be solely and completely responsible for the condition of the premi ses on whi ch the work is performed and for safety of all persons and property on the site during performance of the contract. Final acceptance of the work will be made by the owner after recei pt of approval and recommendation of acceptance from each representative. Payment The contract Lump Sum pri ce paid for "Installation of Softball Field Lighting and Security Lighting" shall include full compensation for doing all work involved in installing softball field lighting and security lighting, complete in place, and no additional compensation shall be allowed therefor.
