RESOLUTION OF THE CITY OF SAN BERNARDINO AI'JARDING A
CONTRACT TO ELECTRO CONSTRUCTION CORPORATION FOR INSTALLATION OF
BALLFIELD LIGHTING SYSTEMS FOR NUNEZ PARK.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
Electro Construction Corporation is the
lowest responsible bidder for:
Installation of Ballfield
L i ghti ng Systems for Nunez Park, in accordance wi th Pl an No.
8098; for the total amount of $177,700.00, a contract is awarded
to said bidder accordingly, but such award shall be effective
only upon the contract being fully executed by the parties; all
other bi ds therefore are hereby rejected; and the Mayor is
hereby authorized and directed to execute said contract on
behalf of the City; a copy of the contract is attached hereto,
marked Exhibit "A" and incorporated herein by reference as fully
as though set forth at length.
SECTION 2. This contract and any amendment or modifi-
cations thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3.
This resolution is rescinded if the

parties to the contract fail to execute it within sixty (60)
days of the passage of this resolution.

NOTICE INVITING BIDS
NOTICE IS HEREBY GIVEN that the City of San Bernardino will
receive bids or proposals for:
CONSTRUCTION OF LIGHTING IMPROVEMENTS FOR NORTH AND
SOUTH SOFTBALL FIELD AT NUNEZ PARK ON FILE IN THE OFFICE
OF THE CITY ENGINEER, CITY HALL.
Deliver all bids to the City Engineer's Office, 3rd floor, City
Hall, 300 North "0" Street, San Bernardino, California, with
the Specification title and number clearly marked on the
outside of the envelope.
Said bids or proposals will be received up to the hour of 2:00
p.m., on Jul'( 24 , 1990, at which time all of said bids
or proposals wlll be publicly opened, examined and declared in
the City Engineer's Conference Room, third floor, City Hall.
No bid will be received unless it is made on a proposal form
furnished by the City. All bids or proposals shall be signed,
sealed and accompanied by cash, cashier's check, certified
check or bid bond made payable to the City of San Bernardino,
in the amount of ten percent (10%) of the bi d. Such cash,
check or bond shall be given as a guarantee that the bidder
will enter into the contract if awarded to him. In the event
the bidder refuses to execute said contract, the use by the
public of the improvements will be delayed, and the public will
suffer great damage. From the nature of the case, it would be
extremely difficult and impractical to fix said amount of
damages. Therefore, the City and the bidder agree that the
above sum of 10% shall be paid to the City upon the condition
above set forth as liquidated damages and not as a forfeiture.
All bonds furnished pursuant to this notice must be
underwritten by a surety company having a rating in Best's most
recent Insurance Guide of "A" or better.
Pursuant to 1 aw, the Mayor and Common Counci 1 of the Ci ty of
San Bernardino, by Resolution No. 12846 and any and all
amendments thereto which are hereby referred to and made a part
thereof by references as fully as though set forth at length
herein, have ascertained and determined the general prevailing
rate of per diem wages, and of per diem wages for legal
hol idays and overtime work for each craft or type of workman
needed in the execution of contracts under jurisdiction of said
Mayor and Common Council.

Said prevailing rates of wages shall conform to "General
Prevailing Wage Determination made by the Director of
Industrial Relations", filed in the Dffice of the City Clerk,
which are made a part of said Resolution No. 12846 and
amendments thereto.
The Contractor may substitute securities for any monies
withheld by the Agency to ensure performance under the contract
as provided for in Section 5490 of the California Government
Code and Section 10263 of the California Public Contract Code.
It shall be mandatory upon the Contractor to whom the contract
is awarded and upon any sub-contractor under him to pay not
less than said specified rates to all laborers, workmen, and
mechani cs employed by them in the exec uti on of the contract,
and to prevent di scri mi nati on in the employment of persons
because of race, creed, color, or national origin, as set forth
in the provi si ons of Resol uti on No. 7414 of the Mayor and
Common Council of the City of San Bernardino.

SECTION 2
2-1 PROPOSAL REQUIREMENTS AND CONDITIONS
2-1.01 GENERAL -- Bids must be submitted on the proposal
form contained herein. All bids or proposals shall be signed,
sealed and accompanied by cash, cashier's check or bid bond made
payable to the City of San Bernardino, in the amount of ten
percent (10%) of the bid. Such cash, check or bond shall be
given as a guarantee that the bidder will enter into the
contract, if awarded to him. In the event the bidder, to whom
the contract is awarded, refuses to execute said contract, the
use by the public of the improvements will be delayed and the
public will suffer great damage. From the nature of the case, it
would be extremely difficult and impractical to fix said amount
of damage. Therefore, the City and the bidder agree that the
proposal guarantee of 10% of the bid shall be paid to the City
upon the conditions set forth above as liquidated damages and not
as a forfei ture. Bi d bonds shall be underwri tten by a surety
company having a rating in Best's most recent Insurance Guide of
"A" or better.
SECTION 3
3-1 AWARD AND EXECUTION OF CONTRACT
3-1.01 GENERAL -- Award of the contract wi 11 normally be
made by the Mayor and Common Counci 1 at the subsequent Counci 1
Meeting after opening of the bids. The bidder, to whom the
contract is awarded, shall file with the Engineer all required
bonds and insurance policies, and execute the contract, within 10
calendar days after receiving notification of the award. Failure
to file the stipulated documents and execute the contract within
the prescribed time shall constitute good and sufficient grounds
for recession of the award and payment of 10% of the bid to the
City as liquidated damages.

SECTION 5
5-1 LEGAL REQUIREMENTS
5-1.01 LIABILITY INSURANCE The Contractor's attention
is directed to Section 7-3, "Liability Insurance", of the
Standard Specifications, providing that the Contractor shall
furnish the City with a policy or certificate of liability
insurance as prescribed therein, prior to execution of the
contract.
5-1.02 WORKMEN'S COMPENSATION INSURANCE -- The Contractor's
attention is directed to Section 7-4, "Workmen's Compensation
insurance", of the Standard Specifications, providing that the
Contractor shall file a signed certification Certificate of
Workmen's Compensation Insurance before execution of the
contract.
5-1.03 PAYMENT OF PREVAILING WAGE RATE -- The Contractor
and all subcontractors shall pay each craft or workman employed
on this project not less than the prevailing wage rates specified
in Resol uti on No. 12846 of the Mayor and Common Counci 1 of the
City of San Bernardino. The Engineer shall have the right to
interview any craft or workman on the project site in order to
verify payment of prevailing wage rates in accordance with
Resolution No. 12846.
5-1.04 PAYROLL RECOROS -- The Contractor's attention is
directed to the following provisions of Labor Code Section 1776
(Stats. 1978, Ch. 1249). The Contractor shall be responsible for
the compliance with these provisions by his subcontractors.
(al The Contractor and all subcontractors shall keep an
accurate payroll record, showing the name, address, social
security number, work classification, straight time, and overtime
hours worked each day and week, and the actual per deim wages
paid to each journeyman, apprentice, worker, or other employee
employed by him or her in connection with the public work.
(bl The payroll records enumerated under subdivision (al
shall be certified and shall be available for inspection at all
reasonable hours at the principal office of the Contractor on the
following basis:

SECTION 6
6-1 GENERAL
6-1.01 INCREASED OR DECREASED QUANTITIES -- If the total
pay quanti ty of any i tern of work, sUbject to the provi si ons in
Section 3-2.2.1, "Increased or Decreased Quantities", of the
Standard Specifications varies by more than 25 percent,
compensati on payabl e to the Contractor wi 11 be determi ned in
accordance with said Section 3-2.2.1 and these Special
Provisions.
When the compensation payable for the number of units of an
item of work performed in excess of 125 percent of the Engineer's
Estimate is less than $1,500 at the applicable contract unit
pri ce, the Engi neer reserves the ri ght to make no adjustment in
said price if he so elects, except that an adjustment will be
made if requested in writing by the Contractor. Such
Contractor's request shall be accomplished by adequate, detailed
data to support costs of the item.
Should the total pay quantity of any item of work required
under the contract be less than 75% of the Engineer's Estimate,
therefore, the Engineer reserves the right to make no adjustment
in said price if he so elects, except that an adjustment will be
made if requested in writing by the Contractor. Such
Contractor's request shall be accompanied by adequate, detailed
data to support costs of the item.
6-1.02 SOUND CONTROL REQUIREMENTS -- The Contractor shall
comply with Chapter 8.54 of the City of San Bernardino Municipal
Code regulating and prohibiting loud, unnecessary and excessive
noises.
Each internal combustion engine, used for any purpose on the
job or related to the job, shall be equipped with a muffler of a
type recommended by the manufacturer. No internal combusti on
engine shall be operated on the project without said muffler.
No equi pment, machi nery, or apparatus that permi ts loud and
excessive noise shall be operated during the hours of 10:00 p.m.
and 7:00 a.m., unless approval has first been secured from the
Mayor and Common Council of the City of San Bernardino.
Said noise level requirements shall apply to all equipment
on the job or related to the job, including but not limited to
trucks, transi t mi xers or transi t equi pment that mayor may not
be owned by the Contractor. The use of loud sound signals shall
be avoided in favor of light warnings except those required by
safety laws for the protection of personnel.
6-1.03 PERMITS AND LICENSE -- The Contractor shall obtain a
City Business License, prior to execution of the contract.

6-1.04 EXTRA WORK -- Any extra work done shall conform to
the provisions in Section 3-3, "Extra Work", of the Standard
Specifications. However, equipment rental rates shall conform to
State of California Business and Transportation Agency,
Department of Transportation, Division of Construction, "LABOR
SURCHARGE AND EQUIPMENT RENTAL RATES", latest edition, unless the
extra work is done for a negotiated price.
6-1.05 HOURS OF LABOR -- In the event that the Engineer is
required by the Contractor's operations to work more than eight
(8) hours in any given day, or more than forty (40) hours in any
given week, or on any Saturday, Sunday or Holiday, in the setting
of Lines and Grades or performi ng i nspecti ons, the Contractor
shall pay an amount to the City equal to one and a half (It)
ti mes the Engi neer' s normal wages and fri nge benefi ts. Such
amount shall be deducted from the next following progress
payments.
6-1.06 PAYMENTS -- Attention is directed to Section 9-3,
"Payments", and 9-3.2, "Partial and Final Payment", of the
Standard Specifications and these Special Provisions.

6-1.07 PROJECT APPEARANCE -- The Contractor shall maintain
a neat appearance to the work.
In any area visible to the public, the following shall

When practicable, broken concrete and debris developed
during clearing and grubbing shall be disposed of
concurrently with its removal. If stockpiling is necessary,
the material shall be removed or disposed of weekly.
Full compensation for conforming to the requirements of
Section 6 shall be considered as included in the prices paid for

compensation will be allowed therefor.

8-1 TECHNICAL SPECIFICATIONS
8-1. 01

COOPERATION AND COLLATERAL WORK -- Attention is
Section 7.7, "Cooperation and Collateral Work", of
Specifications, and these Special Provisions.
Certain companies, governmental agencies, or their
Contractors may be working within the construction area. Certain
utility facilities of various locations within project limits may
be removed, relocated, abandoned, or installed by companies' or
agencies' Contractors.
It is anticipated that these existing utilities will not
interfere with the Contractor's construction operations.
However, the Contractor shall exercise due care to insure that
these utility facilities are not damaged during his operation.
The utility locations shown on the Plans are correct to the
best of our knowledge. When in doubt, the Contractor
shall contact the utility concerned before proceeding further.
The compensation for conforming to the requirements of this
section, not otherwise provided for, shall be considered as
included in the prices paid for the various contract items of
work involved and no additional compensation will be allowed
therefor.
8-1.02 CLEANUP AND DUST CONTROL Cleanup and dust control
shall conform to the provisions in Section 7-8.1, "Cleanup and
Dust Control", of the Standard Specifications.

GROUNDING

3. The desired resistance to ground shall
not exceed twenty-five ohms, and the
necessary number of ground rods shall be
driven to accomplish this maximum resistance.
Minimum separation between the above
individual rods shall not be less than that
required by applicable codes and regulations.
Each ground rod shall be installed in
concrete yard box as indicated.
4. Grounding electrode conductors, if used,
shall be bare copper, or green insulated, and
shall be sized as according to the NEC Table
250-94.
5. If non-metallic conduit is used for
branch circuit wiring, provide a green
insulated, copper ground Wlre, sized in
accordance with the NEC Table 250-95.
6. Ground conductors #10 or smaller for
branch circuit wiring shall be attached at
each outlet to the back of the box using
drilled and tapped holes and washer head
screw, 6/32" or larger. Use compressive lugs
for larger size conductors.
7. Each panel board, swi tchboard, pull box,
or any other enclosure in which several
ground wires are terminated shall be equipped
with a ground bus secured to the interior of
the enclosure. The bus shall be equal to the
panel board neutral bus and shall have a
separate 1 ug for each ground conductor. No
more than one conductor shall be installed
per lug.
8. Ground yard box for ground rod shall be
9-1/2" Sq. x 16" deep, pre-cast concrete,
complete with locking cast iron cover and
marking "ground". Unit shall be Quikset WWT
or approved equal. Ground rod shall be 3/4"
diameter by 10'-0" long copper coated steel.

9-1.02 LIGHTING--
A. LIGHTING PERFORMANCE - SOFTBALL
The manufacturer shall supply lighting equipment
to meet or exceed the following performance criteria:

D. LUMINAIRE ASSEMBLY
1. General Description
The luminaire assembly shall consist of
lamp, lamp socket, reflector, lens, lamp
cone, reinforcing retaining ring, adjustable
aiming mounting device, ballast, steel
crossarms, integral wiring enclosed in rigid
raceway, pole clamps and shall be
Sportscluster luminaires catalog #SC-2-1DOO
as manufactured by Musco Sports-Lighting,
Inc. or an approved equal.
The structural coating shall be hot-
dipped galvanized ASTM A-123.
9-1.03 ITEMS TO BE SUBMITTED FOR CONSIDERATION OF AN
ALTERNATE LUMINAIRE ASSEMBLY AND LIGHTING LAYOUT --
Failure to provide any of the following information with the
alternate submittal will be grounds for rejection of the
alternate. Each item listed below shall be provided in the form
of clear and concise statements and/or plans and drawings which
can be easily read and clearly interpreted. Each item shall also
be clearly lettered to correspond with the following list. All
items shall be assembl ed in the order i ndi cated and secured or
bound in a neat and orderly fashion for easy use and reference.
Bidders requesting to use equipment other than that specified
shall submit ten (10) days prior to bid opening the following:
1. Layout Drawi ng -- Overall 1 i ghti ng 1 ayout desi gn
showing luminaire mounting heights.
2. Aiming Drawing -- Light aiming point plan showing
focus points and reflector types.
3. Luminaire Assembly Drawing A drawing of the
luminaire assembly and its interface to the required
poles. The drawing shall show size, strength, type of
materi al, coati ng of all components, and hardware shall
meet the following specifications:
A. Structural Strength
The luminaire assembly as shown in the
manufacturer's submittal shall be capable of
withstanding forces equal to 125 mph wind levels
with a 1.3 gust factor without structural damage
or misalignment of the luminaires on the assembly.
B. Coati ngs
All component surfaces of the completed
assembly, except for the reflector, hardware and
fasteners, shall be coated with hot-dipped
galvanized ASTM A-123.

Reflector
The reflector shall be of spun aluminum with
a1zak finish.
Hardware and Fasteners
All hardware and fasteners shall be of an
approved corrosion resistant material or coating.
C. Reflector and Lamp supports
The ref1 ector shall be fastened to the 1 amp
cone with a reinforcing retaining ring containing
an acrylic compressed fiber ring which centers and
stabilizes the lamp in the reflector and provides
a heat shi e1 d to protect the 1 amp socket from
heat.
D. Lens
A removable lens with silicone gasket shall
be attached to the reflector and shall be impact
and thermal resistant glass. The lens rim shall
be stainless steel or equal and shall be attached
to the reflector with hinged cable or chain.
E. Aiming
The manufacturer shall provide a mechanical
positioning device for each 1uminaire on the
assembly which device shall be set at the factory
by the manufacturer based upon computer calculated
aiming information such that each assembly is
delivered to the jOb site as one composite light
source. The device shall provide positions for
the initial installation and provide for
repositioning of the aiming after re1amping. The
manufacturer shall also supply drawings showing
the aiming point locations of each 1uminaire.

A. Manufacturer shall submit a computer derived
lighting scan with spill/glare control showing the

Lamps
Lamps shall be 1000 watt Metal Halide and shall meet
ANSI designation M47PA-1000 BU and be Westinghouse #MH1000
U, or an approved equal.
C.
Ball ast
Standard
There shall be an individual ballast for each
luminaire. The ballast shall be a lead peak auto-regulating
ballast and be available for use with 240 volt supply. The
ballast shall be located remote from the lamps on the same
pole in metal enclosures with the capacitors and the
capicators shall operate in ambient air not to exceed 70
degrees C as established by U. L. Test Standards. The
assembly design shall be adaptable to various standard
ballast and must retain U.L. listing.
Wiring and Overcurrent Protection
All wlrlng on the luminaire assembly shall meet
National Electrical Code and shall pass from each luminaire
on the assembly through protecti ve enclosures to joi n in a
common enclosure. Each luminaire shall have individual
supplemental fuse protection located in ballast boxes or in
adjacent metal enclosures. Fusing must be U.L. listed.
In-line fusing will NOT be accepted.

1. Codes

and meet National Electrical Code and NEMA
Publ i cati on FA-I. Pol e cl amps are not U. L.

2. Manufacturer's Warranty
Luminaire assembly shall be warranted in
writing by the manufacturer for a period of
two years and shall be submi tted wi th the
bid. Any parts that shall be found defective
shall be replaced free of and material or
labor charges to the customer.
Lamps are warranted not to fa i 1 for one
year from installation date. Lamps which
fail during this warranty period will be
replaced and installed at no cost to the
owner. Lamps which fail during the second 12
months will be replaced, but not installed by
the manufacturer.
3. Aiming Alignment Warranty
The alignment of the luminaires shall be
warranted by the manufacturer against
movement on the luminaire assembly for a
period of five years from the date of
installation. Labor charges for re-aiming
during the warranty period shall be the
responsibility of the manufacturer.

Protection of Work and Equipment
1. The Contractor shall protect all work,
materials and equipment from damage, from any
cause whatever, and shall provide adequate
and proper storage facilities during the
progress of the work.
He shall provide for the safety and good
conditions of all work until final acceptance
of the work by the Owner, and replace all
damaged or defective work, materials and
equipment before requesting final acceptance.
2. The Contractor shall be held responsible
for the protection and correction of the work
of all trades from smears, splashes, stains
or damages that mught occur in the process of
the work.

Cleaning of Equipment and Materials
1. All parts of the equipment shall be
thoroughly cleaned of dirt, cement, plaster,
etc., and all cracks and corners scraped out
clean. Surfaces to be painted shall be
carefully cleaned of grease and oil spots and
left smooth, clean and in proper condition to
receive paint finish.

Record Drawings
1. The Contractor shall provide and keep
up-to-date a complete "As Built" record set
of blue prints, which shall be corrected
daily and show every change from the original
Drawings and Specifications and the exact "As
Built" locations, sizes, and kinds of
equipment.
This set of prints shall show all
changes in conduit runs, circuits, and size
and number of conductors. Pri nts for thi s
purpose may be obtained from the Engineer.

J. Excavations
1. Do all excavating necessary for the
proper installation of the electrical work

Specifications. Underground secondary
feeders shall be buried not less than 24"
below finished grade; and other conduit runs
containing circuits of 600 volts or less
shall be not 1 ess than 18" below fi ni shed
grade.
2. After the installation of work requiring
excavations has been inspected and approved,
all excavations shall be filled with clean
earth and tamped to 80% compaction (turf
areas), 90% compaction (paved areas), so that
no settlement will occur, and the ground left
firm as natural grade. All excavated earth
which is not used for backfill shall be
removed from the premi ses or otherwi se
disposed of as directed.
3. All sidewalks, driveways or other cement
or asphalt surfaces which are damaged during
excavations shall be repaired to match the
adjacent work in material and finish.
K. Safety
1. Contractor shall be solely and
completely responsible for the condition of
the premi ses on whi ch the work is performed
and for safety of all persons and property on
the site during performance of the

2. Contractor agrees to receive and accept the prices as
set forth in the bid schedule as full compensation for
furnishing all materials and doing all the work contemplated
and embraced in this agreement; also for all loss or damage
arising out of the nature of the work aforesaid or from any
unforeseen difficulties or obstructions which may arise or be
encountered in the prosecution of the work and for all risks of
every description connected with the work; also for all
expenses incurred by or in consequence of the suspension or
discontinuance of work, and for well and faithfully completing
the work and the whole thereof, in the manner and according to
the Plans and Special Provisions, and requirements of the
Engineer under them.
3. City hereby promises and agrees with the said
Contractor to employ, and does hereby employ the said
Contractor to provide the materials and to do the work
according to the terms and conditions herein contained and
referred to, for the prices aforesaid, and hereby contracts to

pay the same at the time, in the manner, and upon the

terms of this instrument and the bid or proposal of said
