RESOLUTION OE THE CITY Of SAN BERNARDINO PRELIMINARILY DETER~lINING THAT
PlBLIe CONVENIENCE AND NECESSITY REQUIRE THE FORMATION OF A LANDSCAPE
MAINTENANCE ASSESSMENT DISTRICT; DECLARING ITS INTENTION TO PROCEED TO ORDER
\\OR" WITHIN THE DlSTRICT, TO BE KNOWN AS ASSESSMEi>T DISTRICT NO. 997; AND
SETTING AND D[RECTING PUBLICATION OE NOTICE OF A TIME AND DATE OF A PUBLIC
HEARgC;.
WHEREAS, the City of San Bernardino (hereinofter called
7 "City") as an exerci.se of its mUllicipd.l affairs powers has enacted an
8 Assessment District Onlinance (::unicipa 1 Code Chapter 12.90) to provide for
9 the procedure for the formation of assessment districts within the City; and

WHEREAS, it has now become necessary to cons ider the formah on 0 f
a landscape maintenance assf'ssment district within the City, to be knml,:ll as
Assessment District No. 997; and
WHEREAS, as a further exercise of the powers vested in the Ci tv bv
15 vir'tue of Section ]9. Article XVI, California Constitution, the City intends
16 to conduct a hearing and hear protests, if any, as to why the district shm,ld
17 not be formed and the acquisitions and improvements completed, without
18 compliance with the Special Assessment Investigation, Limitation and ~!ajority
19 Protest Act of ]93];

NOW, THEREFORE, BE [T RESOLVED BY THE MAYOR AND COMMON COUNCIL OE THE
CITY OF SAN BERNARDINO THAT:
23 SECTION 1. Pursuant to Chapter 12.90 of the San Bernardino ~!unicipal
24 Code, the Mavor and Common Council of said City hereby prelintinarily find
25 and determine that the public convenience and necessity require, and it is

improvement and a proposed assessment roll which Repllrt and Assessment
Dist.rict Map are hereby approved.
SECTION 2. It is the intention of said '~'lY<lr and Common COllnc i I to
order improvements \\'i.thin the district whi ch improvements consist of. but are
nor limited to, the maintenance of landscaping in the v..Heated portion of
Chestl1ut Avenue between Ohio Avenue dnd Irvington Avenue.
The estimated cost ot said maintenance, including incidental custs
is 531,354.00 for the first Yf~ar contract when necessar)-' aft.er tJlf,' one year
plant. guarantee perina required of the Developer.
SECTION 3. Said contemplF.lteci work and improvements is of more than
lOCdl or ordinary publi,: benet-it, ilnd that said Mayor' and Common Council do
hereby make the expen,c;(-~ of such work rwd impruvement chargeable upon the

SECTION 4. The assessment benefit procedure to be fo I lowed clnd the
amount to be assessed against- each particular parcel will be d proportion of
the total sum of the cost of the maintenance and incidentals within the
area in relation to the number of potential single family parcels within the
district. Referene" is hereby made fe, said Engineer's Report on tile in the
oiiiee of the Citv Clerk for a detailed estimated individual assessment.
SECTION 5. The assessment financing alternative to be followed shall
be as follows. to-wit:
The costs shall be pre-funded by the City and the assessment levied,
collected d.lld enforced in the same manner~ at the same time, ,=md with the
Sdme penalties and interest as in the case of taxes levied tor the City f~r'
the repayment to the Citv of said pre-funding.
The City shall recover interest on each year's pre-funding of cost
maintenance of landsc,'ping. Said inter-est shal I be at the average ulte as
the City is receiving on oth~[' City funds during the period of expenditure.
The costs of the maintenance contract, energy costs and incidentdl':.
wi II be collected in perpetuity unless other-wise terminated by the City.

At said hearing, any and aJ 1 persons interested may appear and sljnw
causp, if any they have, why the Mayor and Common Council should not tinei and
determine that the public convenience and necessity require the formation of
the p,'oposed district without compliance with the Special Assessmenl
Investigation, Limitation and Majority Protest Act ot 1931; on the question
of estimated cost, and the intention of tile Mayor and Common Cl1uncil to
proceed to order work within the district.
SECTION 7. At said public hlearing, all persons wil i be heClrd, any
holder of title to taxable real property within the boundaries of the
proposed district may file a protest in wI'iting wilh the City Clerk, not
later than the hour" hereillahove set fUI' hearing, containing therein a
description of the property in which the signer thereof is interested
suff i cient to identity the same, and 1 if the sj gIlcrs are not shown on the
last equalized assessment roll as the owners of such property. must c:untain
or be accompanied by written evidence that such signers are the owners of

SECTION 8. The City Clerk is authorized and dir'ected to cause a cop'

ddoption of this resolution to be posted and mailed as required by' Spction
12.90.040C of the MUllicipal Code of the City of San Bernardino.
SECTION 9. A copy of this resolution and a map showing the exterior'
boundaries of the proposed improvement distl'ict with relation to t.he
territory immediately contiguous thereto and to the proposed improvement will
be on file with the City Cleek and will be availabJe foe i,'spectlon by any'
