HomeMy WebLinkAbout1990-321 .,. 1 RESOLUTION NO. 570 -~21 2 A RESOLUTION OF THE CITY OF SAN BERNARDINO FINDING AND DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE AMENDMENT OF BOUNDARIES 3 OF ASSESSMENT DISTRICT NO. 975 BY EXPANDING THE BOUNDARIES THEREOF TO INCLUDE ADDITIONAL TERRITORY IN THE DISTRICT FOR THE MAINTENANCE OF LANDSCAPING IN 4 THE AREA OF MILL STREET AND PEPPER AVENUE; ORDERING THE AMENDMENT AND EXPANSION OF THE DISTRICT AND THAT THE SPECIAL ASSESSMENT, INVESTIGATION AND 5 LIMITATION ACT OF 1931 SHALL NOT APPLY AND APPROVING AMENDED ASSESSMENT DISTRICT DIAGRAM MAP NO. 975. 6 7 WHEREAS, by Resolution No. 87-8 adopted January 5, 1987, the Mayor 8 and Common Council of the City of San Bernardino created Assessment District 9 No. 975 for the maintenance of landscaping in the area of Mill Street and 10 Pepper Avenue: and 11 12 13 14 15 WHEREAS, the Mayor and Common Council of the City of San Bernardino have preliminarily found that the public interest, convenience, and necessity require the amendment of the boundaries of Assessment District No. 975 by the expansion thereof to include additional territory; and 16 WHEREAS, the Mayor and Common Council of the City of San Bernardino 17 have, on the 16th of April, 1990, passed and adopted Resolution No. 90-127 18 entitled: 19 RESOLUTION OF THE CITY OF SAN BERNARDINO PRELIMINARILY DETERMINING 20 THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE AMENDMENT OF BOUNDARIES OF ASSESSMENT DISTRICT NO. 975 BY EXPANDING THE BOUNDARIES THEREOF TO INCLlIDE 21 ADDITIONAL TERRITORY IN THE DISTRICT; DECLARING ITS INTENTION TO PROCEED TO ORDER THE AMENDMENT AND EXPANSION OF THE DISTRICT; AND WAIVING NOTICE AND 22 HEARING. 23 which said resolution indicated that the City elected to proceed without 24 Notice and Hearing pursuant to Section 12.90.040C(5) of the Municipal Code as 25 the request to expand the boundaries of the existing District represents 100% 26 of the property owners liable to be assessed for the said maintenance. 27 28 06-25-90 " - , RESOLUTION EXPANDING BOUNDARIES AD 975 1 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 2 3 SECTION 1. That the public convenience and necessity require, and the Mayor 4 and Common Council of the City of San Bernardino hereby declares by not less 5 than a 4/5ths vote as defined in Section 12.90. 040D of the San Bernardino 6 Municipal Code, that the public interest, convenience, and necessity requires 7 and hereby orders, the amendment of the boundaries of Assessment District No. 8 975 by expanding the boundaries thereof to include additional territory in 9 the district; the work described in said Resolution No. 90-127 to be done as 10 provided in said Resolution and that the Special Assessment, Investigation 11 and Limitation Act of 1931 shall not apply. 12 13 14 SECTION 2.
