A RESOLUTION OF THE CITY OF SAN BERNARDINO
DETERMINING THE RESULT OF THE SPECIAL
ELECTION HELD IN CITY OF SAN BERNARDINO
COMMUNITY FACILITIES DISTRICT NO. 995
(VERDEMONT AREA) ON JUNE 26. 1990

WHEREAS. the City Clerk of the City of San

Bernardino. as the designated election official the ("Election
9
Official"). has duly canvassed the votes cast in the City of
10
San Bernardino Community Facilities District No. 995

(Verdemont Area) (the "District") at the special election held
12
in the District on June 26. 1990. by the landowners of the
13
District upon the proposition hereinafter set forth. ~nd has
14
certified to the Common Council of the City of San Bernardino
15
(the "Common Council") the result of the votes cast at such
16
election upon said proposition. which said Certification of
17
the Election Official (the "Certification") is attached hereto
18
as Exhibit A;

NOW THEREFORE. BE IT RESOLVED BY THE MAYOR AND
20
COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. At the special election held on June 26.
22
1990 in the District the Proposition (AI was submitted to the
23
qualified electors. being the landowners in the District. as
24
follows:

PROPOSITION (A):
Shall City of San Bernardino
Community Facilities District
No. 995 (Verdemont Area) be
authorized to finance certain
public facilities. including all
or a portion of the Verdemont

Area infrastructure development fee. representing
the acquisition, construction and installation of
full-width street improvements, including full-width
paving, curbs and gutters, sidewalks, street lights,
sewer mains, storm drains, catch basins, together
with auxiliary structures and appurtenances and
including the acquisition of all necessary easements
and rights-of-way, and school facilities to serve
the development within the Verdemont Area of the
City of San Bernardino, by incurring a bonded
indebtedness in the principal amount of $11,000,000
and shall an appropriations limit in the amount of
$1,100.000 per fiscal year in connection therewith
be established for the Community Facilities
District. and shall a special tax with a maximum
rate and method of apportionment as provided in
Exhibit C to Resolution No. 90-140 adopted by the
Common Council of the City of San Bernardino on
April 16, 1990, which is incorporated by reference
herein, be levied to pay for such public facilities,
including the payment of current and future
principal of and interest on such bonds and the
annual administration expenses of the City and the
Community Facilities District in determining,
apportioning, levying and collecting the special
tax, and including the repayment of funds advanced
to or on behalf of the Community Facilities District?

SECTION 2. The canvass of the votes cast in the

District, including the total number of votes cast for and
17
against such proposition at the special election held in the
18
District on June 26, 1990 as shown by the Certification, is
19
hereby approved and confirmed.

SECTION 3. Based on the Certification. the Common
21
Council finds and determines that more than two-thirds (2/3)
22
of all the votes cast at such special election were cast in
23
favor of such proposition, and such proposition passed.
24
SECTION 4. The Common Council further finds and
25
determines that the facilities to be financed by the District,
26
including the infrastructure development fee. are necessary to
27
meet increased demand placed upon the City and other local

agencies as the result of development or rehabilitation
occurring in the District.
SECTION 5. The City Clerk is hereby directed to
enter this resolution on the minutes of the Common Council,
which shall constitute the official declaration of the result
of such special election.
SECTION 6. This Resolution shall be effective upon
adoption.

I. SHAUNA CLARK, City Clerk of the City of San Bernardino,
acting as designated election official, do hereby certify
that, pursuant to a Resolution adopted by the Common Council
of the City of San Bernardino on June 18. 1990. I did conduct
a Special Election for Community Facilities District No. 995
(Verdemont Area) for the Special Bond and Special Tax Election
on June 26, 1990 and that said election was conducted by
mailed ballot to the landowners of said Community Facilities
District.

I further certify that the following shows the full text of
the measure submitted to the voters at said election held on
June 26. 1990, and the full and true totals of all votes cast
for and against said measure.
