HomeMy WebLinkAbout1990-253 " , I' " , 1 RESOLUTION NO. 90-253 2 RESOLUTION OF THE CITY OF SAN BERNARDINO REVISING SECTION 1 OF RESOLUTION 90-2 RELATING TO THE AMOUNT OF AN INFRASTRUCTURE 3 FEE TO BE LEVIED FOR RIGHT-OF-WAY IMPROVEMENTS AND PUBLIC IMPROVEMENTS. 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 WHEREAS, the City of San Bernardino, California (the "City") has on January 3, 1990, previously adopted an Urgency Ordinance (MC-695) which established and authorized the levy of an infrastructure fee (the "Infrastructure Fee") for the purposes of funding the costs of certain Right-of-Way Improvements and Public Improvements, all as more fully described in the January Urgency Ordinance; and WHEREAS, in connection with its adoption of the January Urgency Ordinance, the City on January 3, 1990, also adopted a Resolution (Resolution 90-2) setting the amount of the Infra- structure fee; and WHEREAS, the City deems it necessary to adopt this Resolution in order to provide for a revision to the amount of the Infrastructure Fee set in the January Resolution which revision is attributable to the exclusion within the definition of Right-of-Way Improvements as defined in the ordinance, of all water system improvements contemplated in the Engineer's Report. NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY 22 OF SAN BERNARDINO, CALIFORNIA, DO HEREBY FIND, RESOLVE, DETERMINE AND ORDER AS FOLLOWS: 23 24 25 26 27 28 / / / / / / / / / / / / / / / / / / / / 06-06-90 GRK:rs ~ ~ . RESO.: REVISING SECTION 1 OF, RESG>LUTION 90-2 RELATING 1'0 AN INFRASTRUCTURE FEE TO BE LEVIED FOR RIGHT-OF-WAY IMPROVEMENTS AND PUBLIC IMPROVEMENTS. 1 SECTION 1: Section 1 of Resolution 90-2 is hereby 2 amended to read: , 3 "SECTION 1: Infrastructure Fee. The Infrastructure Fee 4 as established pursuant to the Urgency Ordinance and set by 5 Resolution No. 90-2 is hereby revised to be the amount of 6 $6,068.00 per Equivalent Dwelling Unit as said term is defined in 7 the Ordinance. Said Infrastructure Fee shall be subject to 8 further increase pursuant to the terms of any subsequent 9 resolutions to be adopted by the Mayor and Common Council as may 10 be deemed necessary in the best interests of the City.
